1. Mr. Joe developed a new site called ‘Face [Link]’ (FTV) in the year 2006 which allowed users to
share (Upload & download) daily soaps broadcasted in U.K., U.S. and India for free of cost. Soon
they gained the popularity in all the above mentioned territories. The accessibility to the content is
available to the users for free, but it makes a considerable amount of money from advertisements
viewed by million users flocking to his website.
In mean time Mr. Joe applied for a trademark for both name ‘Face TV’ and its logo (presented
below).

Application was examined successfully but it faced opposition from The Facebook Inc. on the
ground of taking unfair advantage of their well-known trademark, creating likelihood of confusion
and association in the mind of public and they also contended that the applicant’s nature of
services are illegal as its facilitating piracy. So, the application must be rejected.
In reply to this opposition Mr. Joe contended that they have worldwide reputation for his services ,
he is a honest & Concurrent user, the class of opponent’s services is different from applicant’s
services and so, it will never cause likelihood of confusion, lastly they established that Facebook
incorporation never registered their trademark in India, so, the opposition must be rejected. The
logo of the Facebook Inc. is presented below.

Answer the following questions in the light of above mentioned facts: (Marks 8+2=10)
a) In your opinion would Mr. Joe be able to register the trademark? Limit your arguments to
the grounds of opposition raised by Facebook Inc. and the reply contended by Mr. Joe.
Substantiate your answer with the applicable provisions and relevant case laws.
b) Explain the concept of ‘well – known Trademarks’.
2. Graphical representation and distinctiveness are essential requirements, which in certain cases
create barrier for registration for unconventional trademarks. Considering the mentioned criteria
comment on the registrability of following marks with the test laid in relevant cases.

labour employed by the company. The practice of the company was that the cleaning and

1. According to the will of his parents, Dharmendra would get the legal ownership of the farm house
on 2nd April 2017. There was a grand party in the same farm house on 3rd March 2017- on the eve
of Dharmendra’s 25th Birthday. During the party, some fire performers were called to perform.
Dharmendra didn’t want anything to go wrong; therefore to prevent himself from any loss he took
fire insurance on the farm house on 1st March 2017 claiming that he has contingent interest.
Unfortunately, his fear turned into reality and during the party because of a mishap in a fire
performance; farm house caught fire. Now, Dharmendra is claiming for reinstatement of farm
house from the Insurance Company.
Answer the following question based on the given fact. (GIVE LEGAL REASONING FOR ALL
THE ANSWERS)
a. Is it a valid insurance policy? Yes or No. Support your answer with case law.
b. What do you mean by Reinstatement? Assume that insurance policy is valid; can Dharmendra
claim for reinstatement of farm house? Give reasons.
c. To call fire performers was the decision of Dharmendra. Will it be considered as breach of
warranty and why? How many types of warranty are there and what is usually the result of

2. (a) Mr. Mehra was injured in an accident and was unable to walk. While lying on the ground he
caught cold which developed into pneumonia and as result of this, he died. Mr. Mehra had
Personal Accident Policy which covers injury or death caused due to accident. Mr. Mehra’s
Nominee is claiming money under this policy but Insurance Company has refused to make the
payment stating that cause of death is pneumonia- which is not covered under the policy. Should
insurance money be given in this scenario? Support your answer with the help of case laws and
