SALES AGREEMENT: CASH TRANSACTIONS WITHOUT ANCILLARY SERVICES

Applicable to a natural person (i.e. a human being) or a juristic person (such as a close corporation or company) with an asset value or annual turnover less than R 2 000 000 not requiring
finance or any of the ancillary services* offered by WeBuyCars
*The ancillary services include but are not limited to Extended Warranties, Licence & Registration & Service and Delivery.

IMPORTANT NOTICE AND DISCLAIMER

Please carefully read the following terms of sale, which forms a binding agreement between you (i.e. the buyer) and us (i.e. WeBuyCars) as soon as
you sign the Sales Agreement.
The provisions that are printed in bold font may limit our liability, place liability on you, or draw a fact to your attention. Please do not sign the Sales
Agreement or buy a vehicle from us unless you agree to all of these terms and conditions, including the ones that are printed in bold font.

At WeBuyCars, there are thousands of vehicles for sale, ranging from nearly new, with very low kilometres to well-used cars with substantial
kilometres and wear, needing reconditioning, mechanical checks, servicing and repair (“repair-work”). Unless, you are clearly informed otherwise by
us in writing, we are not responsible or liable (i.e. we do not pay for it) for such repair-work or to arrange a roadworthy certificate for the vehicle you
decide to buy from us in terms of the Sales Agreement. Without the necessary repair-work, the vehicle may suffer mechanical problems, including
(but not limited) to its engine and gearbox.

All these terms are subject to applicable law and are severable. If any law restricts or prohibits the use of any of them such restriction or prohibition
shall not invalidate the remaining terms.
We strongly recommend that you get an expert of your own choice to assess the vehicle before buying it.
If you have any questions, feel free to ask any of our friendly sales executives who will gladly assist.

By signing this Sales Agreement, you agree, confirm and understand the following:

1. The vehicle will only be delivered to you once the full purchase price has been paid to us. We will give you written details for such payment.
2. Delivery of the vehicle will take place at our premises, during normal business hours.
3. You have inspected the vehicle and confirm that it is adequately suited for the purpose you intend to use it and we have not influenced you in this regard.
4. You were given enough time and opportunity to inspect the vehicle before you decided to buy it and signed this Sales Agreement.
5. You confirm that you have read the Dekra condition report issued in respect of the vehicle you are buying and that you were made fully aware of any required reconditioning,
repair work and or service work as highlighted in the report.
6. You will adhere to the manufacturer’s specifications in respect of maintaining the vehicle and not alter or change the vehicle contrary to the manufacturer’s specifications after
leaving our control.
7. We will only deliver goods, such as spare keys, a spare wheel, tools, service records and owner’s manual, if it was received when we bought the vehicle. We will have no
obligation to buy, refund or replace such items.
8. We do not warrant that the components of the vehicle conform to the manufacturer’s specifications.
9. Should you buy a warranty in respect of the vehicle you will be obliged to use the warranty in case of any defect or failure of the vehicle and we will not be responsible for any
shortfall in the event of a claim paid out to you under the warranty.
10. We do not warrant that the odometer reading of the vehicle is correct as we do not know the full history of the vehicle. WeBuyCars can further not warrant that the vehicle has
never been damaged or, if so, that it has been repaired to the manufacturer’s specifications.
11. The vehicle is sold without any warranty and we do not guarantee that the vehicle is in a mechanically good condition. The vehicle has not been subjected to a roadworthy test
and you are responsible to do a roadworthy test together with the required repairs to make the vehicle safe for use on a public road.
12. If the vehicle is financed and sold without a manufacturer’s warranty, we will require of you to purchase an extended mechanical warranty, available separately and at an additional price,
which will be used in the event of a failure or defect occurring in the vehicle after its delivery to you.
13. You confirm that you were made aware of our terms and conditions in a clear and conspicuous (noticeable) manner at the entrance to our business premises. You will further have no
recourse (action) against us for any latent (hidden) or patent (not hidden) defects in respect of the vehicle.
14. We have no obligation to register the vehicle in your name or to roadworthy the vehicle before delivery to you.
15. Upon delivery of the vehicle / receipt of the purchase price, we will submit a notification of change of ownership with the relevant registering authority. You must register the vehicle in your
name as soon as possible and no later than 21 days after taking delivery of the vehicle.
16. It is unreasonable to expect WeBuyCars to have discovered any unsafe characteristic, failure, defect or hazard, in any of the vehicles we sell having regard to our role in
marketing the vehicles to consumers and the fact that we did not manufacture the vehicle. For this reason, we cannot accept any liability for any failure in the vehicle or any
consequential losses that may result from such failure.
17. You confirm that apart from the clear and conspicuous (noticeable) notice you observed when entering our business premises, by signing the Sales Agreement, you agree to
the terms and conditions of this Sales Agreement and that these terms were explained to you.
18. We charge a documentation fee on all transactions as reflected on the tax invoice and you will be liable to pay such amount to us before taking delivery of the vehicle.
19. By signing this agreement and/or providing personal information to us, you agree that we may process your personal information (including store and share), as set out in our
Privacy Policy. This personal information may include but is not limited to name, address, contact information, identity number, voice recordings and images.
20. This agreement constitutes the whole agreement and all additions, variations or amendments to this Sales Agreement must be done in writing and signed by all parties.
