BILL NO. 01 - PRELIMINARIES/ GENERAL

CONDITIONS

PRICING NOTES

A Where an item has been priced as “included” it

will be construed as the price of that item having
been distributed in other items and adjusted
where appropriate.

B Where an item has not been priced it will be

treated as an item not to be valued for any
purpose but the Contractor bears the risk of
fulfilling the intended obligations.

C The payment in interim certificates for

preliminary items stated as sums (or items)
shall be based on the actual physical progress
of the Works on Site and not by dividing the
sum stated by the Contract Period.

D Where the Contractor has included a sum

against Clause 6 in this Preliminaries Bill, such
sum shall be taken as the sum required for
providing the programme in accordance with
Contract requirements and making all revisions
and updates of the approved Clause 6
programme. The Contractor will be required to
submit a breakdown indicating cost of preparing
the programme and subsequent updates up to 4
updates during the whole Contract period.
Payment will be made accordingly.

E Any sum stated against Clauses 7, Contractor’s

Personnel and Clause 8 for Plant, Materials and
Workmanship shall be supported by the
Contractor with a month by month cash flow
based on the manpower histogram spread over
the whole Contract period to qualify for costs
associated with Relief for Delay and will be
based on actual physical progress on Site for
interim payments.

F For purposes of calculating any costs

associated with Relief for Delay under Clause
9.3 (for qualified delays only) the sums stated
against any item shall not be divided by the
whole Contract period to obtain a rate. The cost
of extending the Performance Guarantee under
Clause 1.11 and the Insurances under Clauses
16 shall be supported by invoices from the
respective Bank and Insurance Company to
qualify for payment.

A Notwithstanding what is stated in item B

above, where the Contractor has included a
Sum against Clause 9 in this Bill, that
amount shall be considered as the cost
associated with all extensions to time for
completion granted under Clause 9 and no
further payment whatsoever shall be made.

B Items in this Preliminaries Bill of Quantities

described as “Fixed Charges” will be
considered as fixed for the duration of the
whole Contract period or any extended
period under Clause 9 and no adjustment
shall be made. For purpose of interim
certificates, payment will be calculated
proportional to and as a percentage of the
actual physical work executed and not
simply by dividing the sum stated by the
whole Contract period.

C Items in this Preliminaries Bill of Quantities

described as “Time Related Charges” shall
be treated as such and used for calculating
any costs associated with Relief for Delay
under Clause 9 if applicable subject to item
B of G1/2 herein.

D All other priced items (except those

identified in items A to E of Page G1/1 &
items A to D of Page G1/2) in this
Preliminaries Bill of Quantities shall be
included in Interim Payment Certificates
calculated proportional to and as a
percentage of the actual physical progress
at the time such Certificate is issued and
not simply by dividing the sum stated by the
whole Contract period.
