Appointment Letter and Identity Card (Section 5)

• No employer shall appoint a worker without issuing a letter of appointment.


• Every worker shall be given an identity card with photograph of the worker

Service Book (Section 6)


Every employer shall, at his own cost provide a service book for every worker employed by
him

Every service book shall be kept in the custody of the employer

The employer may claim the previous service book of the worker

If the worker want to keep a copy of the service book, he may do so at his own cost

The employer shall hand over the service book to the worker on the termination of service

Service Book (Section 6)

If the worker losses the service book, then the employer


shall provide him a copy of it at the cost of such worker.

Nothing in this section shall apply to an apprentice,


substitute or casual worker

Commentary on Service Book (Section 6)

• Service book is not mandatory for every types of worker. As per the provision
of this section only the permanent, temporary and the probationer workers are
under the ambit of service book.
• Service book is one of the cardinal document to ensure the employment
benefits of worker. Its role in ensuring the accountability of the employer of
the establishment is undeniable. Therefore, service books should be provided
for all types of workers.

Particulars of Service Book (Section 7)


• Name of the worker, parents name/spouse name, address
• Date of Birth
• Special particulars necessary for identification
• Name and address of the previous employer
• Duration of service
• Profession or post
• Wages and allowances
• Leave enjoyed
• Conduct of the worker
• A photograph of the worker

Entries in the Service Book (Section 8)

• The employer shall entry necessary information under chapter 2


(Employment and conditions of service)
• Employer and the worker shall sign under those entries

Register of Workers (Section 9)

• The employer shall maintain a register for all the workers


• It is to be kept ready during all working period for the inspection by the
inspector

• Name and date of birth of every worker
• Parents name of the worker
• Date of work
• Designation of worker
• Division of branch
• Working time
• Obtainable day for taking rest
• Attached group
• Attached relay
• Ticket/ card

Ticket/Card for Workers (Section 9)


• The employer shall supply every worker a ticket/card
• Every permanent worker shall get a permanent ticket with a number
• Every temporary worker shall get a temporary ticket
• Every Badli worker shall get a badli card
• Every casual worker shall get a casual card
• Every apprentice shall get a apprentice card
• Card/ticket shall be returned while leaving the job or if any changes of the job
occurs

Procedure for Leave (Section 10)

A worker who desires to obtain leave of absence shall apply to his employer in
writing and shall state therein his address during leave.
The employer or an officer authorized by him shall issue an order within 7
(seven) days of receipt of the application or 2 (two) days prior to the
commencement of leave applied for, whichever is earlier,
Provided that if due to any urgent reasons the leave applied for is to commence
on the date of application or within 3 (three) days thereof, such order shall be
given on the day of receipt of the application.

Procedure for Leave (Section 10)


If the leave prayed for is granted, a leave pass shall be issued to the worker.
If the leave prayed for is refused or postponed, the fact of such refusal or
postponement and the reasons thereof shall be communicated to the worker
before the date on which the leave would have expected to be commenced.
If any worker, after he went on leave, desires an extension thereof, he shall, if
such leave is due to him, apply in writing by registered post before reasonable
time of the expiry of the leave to the employer, who shall send a written reply
either of granting or of refusing the extension of leave to the worker to his
leave-address.

Payment of wages for unavailed leave (Section 11)

If the service of a worker terminates, due to retrenchment,


discharge, removal, dismissal, retirement, resignation or
any other reason and any annual leave is due to him, the
employer shall pay him wages in lieu of the unavailed leave
at the rate he is entitled to the payment of wages during the
period of leave.
