Subject: Land measuring 3.9 acres in Survey No. 367/8, situated in Kanchipuram District (Registration),
Chengalpattu District (Revenue), Tambaram Taluk, Perungalathur village Plan originally
approved for Construction of Commercial Mall under the Planning Permit No. 11190 dated
23.01.2018– Proposal to construct Health Care Unit in the said Land Plan originally approved
for Construction of Commercial Mall – Representation sent by way of Objection not to
consider for the registration– requested – regarding.
We, the Shriram Properties Park63 Flat Owners’ Welfare Association, submit this
Representation/Objection to express our strong objection to register the land originally approved for
the construction of Commercial Mall, situated in Survey Nos. 367/8 No. 16, G.S.T. Road, Perungalathur,
Chennai-600 063 under Planning Permit No. 11190 dated 23.01.2018.
As submitted already, the said land was initially approved for the development of a commercial
mall, as per the aforementioned planning permit which was originally applied only by Shriram
Properties and not by any of their subsidiary companies. The Site Plan approved by Executive Officer,
Perungalathur also reflected the same. This was a key factor in attracting investments from all the
apartment owners in Shriram Properties Park63 hereinafter called as “Builder.” The members of the
said Association have purchased their respective Flats under the fond hope that the value of their
respective Flats will certainly be increased in future, if the commercial mall is constructed.
We submit that the said Builder has sold the Flats called “Shriram Properties Park63” to the
members of the Association by showing and promising construction of commercial mall. This is the
main reason for the members of the Association to take a decision to invest their hard earned money
in the purchase of their respective Flats.
We further submit that as per the recent Press Release (Copy enclosed), we came to know that
the said Builder has sold the said land already earmarked for the construction of Commercial mall to
large healthcare and educational institution.

We further submit that the action of the Builder is In direct violation of the commitments made to
the members of the Association at the time of purchasing their respective Flats.
We further submit that the sale of the said land in which commercial mall is marked, is not only
unethical but also constitute a breach of trust made to the members of the Association. Further, the
action of the said Builder amounts to violation of Promissory Estoppel also.
Hence, we request you not to approve or grant permission with regard to the aforementioned land
for any other purpose except the purpose of constructing a commercial mall.
We further request you to afford all the legal opportunity of personal hearing before taking a
decision on this Representation/ Objection and conduct a detailed and thorough enquiry in this regard
and further request you to verify all the documents pertaining to the Planning Permit already granted
to the said land and subsequent transactions involving in the land in question.
