APPLICATION FOR DIRECTIONS UNDER SECTION 151 OF CODE OF


CIVIL PROCEDURE

MOST RESPECTFULLY SHOWETH:

1. That the present application is being filed by the Respondent (mother) in the
above-mentioned case seeking necessary directions from this Hon'ble Court
regarding the non-compliance of the court's order dated 04.09.2024.
2. That vide the order dated 04.09.2024, this Hon’ble Court had directed the
Petitioner (father) to bring all three children for a meeting with the
Respondent (mother) on the second and fourth Saturday of each month
between 02:00 PM - 03:00 PM at the Children Room of the Family Court,
Karkardooma Complex, Delhi.
3. That in compliance with the said order, the Respondent (mother) reached the
Children Room of the Family Court on the second Saturday, i.e., 7th
September 2024 at the time fixed by the court. However, the Petitioner
(father) failed to bring the children for the said meeting.
4. That again, on the fourth Saturday of the month, i.e., 21st September
2024, the Respondent (mother) reached the Children Room of the Family
Court at the scheduled time, hoping to meet her children. Unfortunately, the
Petitioner (father) once more failed to bring the children for the meeting as
directed by this Hon'ble Court.
5. That the Petitioner neither made any prior communication nor left any
message explaining his inability to bring the children to the court on both
7th and 21st September 2024, which caused grave inconvenience to the
Respondent. The Respondent, being a very poor lady, faced additional
financial and emotional hardship due to the repeated non-compliance of the
order by the Petitioner.
6. That the Petitioner’s failure to comply with the Hon’ble Court’s order has
deprived the Respondent of her visitation rights, and the lack of
communication has further aggravated the situation. The conduct of the
Petitioner amounts to wilful disobedience of the court's direction.
7. That the Respondent, being a mother, is deeply distressed and seeks
intervention from this Hon'ble Court to ensure compliance with the said
order and to prevent any future non-compliance by the Petitioner.
8. That it is in the interest of justice and welfare of the children that appropriate
directions are issued to ensure the presence of the children during the
scheduled meetings as ordered by this Hon'ble Court.

PRAYER:

In view of the aforesaid facts and circumstances, it is most respectfully prayed that
this Hon'ble Court may be pleased to:

a. Direct the Petitioner to ensure strict compliance with the court's order dated
04.09.2024 and bring the children for the scheduled meetings at the Children
Room of the Family Court, Karkardooma Complex, on every second and fourth
Saturday of the month as directed.

b. Issue necessary directions to ensure that the Petitioner communicates any


unforeseen circumstances that prevent him from complying with the order in
advance, so that appropriate steps can be taken.

c. Impose appropriate penalties or initiate contempt proceedings against the


Petitioner for willful disobedience of the court's order, if deemed fit by this Hon'ble
Court.

d. Grant any other relief as this Hon'ble Court may deem fit and proper in the facts
and circumstances of the case.
