LEAVE AND LICENSE AGREEMENT
THIS INDENTURE is made on this ___th day of ________, (Two
Thousand Twenty Five) 2025,
BETWEEN
Mr. SUDIP DUTTA (Aadhaar No-7870 7084 3874), Son of Late
Bhanulal Lal Dutta, by faith Hindu, by occupation Business,
residing at 8/11. Bijoygarh, P.S. Golfgreen, Kolkata-700032,
hereinafter referred to as the LICENSOR / FIRST PARTY
(which term or expression shall unless excluded by or
repugnant to the context be deemed to mean and include his
hairs, executors, administrators, legal representatives and
assigns) of the ONE PART.
AND
1. SUMANA MANDAL (Aadhaar No-2659 8485 1873), d/o
Sri Sukhdev Mandal, of Chanchal Thana Para, PS- Chanchal,
Pin-732123, Dist- Malda, 2. AAKRITI SINGH d/o- Mahendra
Kumar, of 175/40, Peer Jalil, Golagunj, Lucknow 226018, 3.
ANAMIKA PAUL, d/o Goutam Paul of Chanchal Bazar Para, PS-
Chanchal, Pin-732123, Dist- Malda, hereinafter referred to as
the LICENSEE/SECOND PARTY (which term or expression
shall unless excluded by or
repugnant to the context be deemed to mean and include his
hairs, executors, administrators, legal representatives and
assigns) of the OTHER PART.
WHEREAS the First Party herein in the absolute owner of the
Residence Property at P-9/11/1, Bijoygarh, P.S- Golfgreen, Kolkata- 700
032.
AND WHEREAS the First Party herein due to urgent need of money
intend to let-out the portion of Ground Floor measuring about approx.
500 Sq.ft. be the same a little more or less consisting of 2(two) bed
rooms, l(one) Kitchen, 1(one) Living cum Dining and l(one) bathroom
which is more fully described in the Schedule herein below.
AND WHEREAS the Second Party herein is in search of suitable
accommodation and having knowledge of the intention of the First
Party agreed to stay in the schedule property on Leave and Licensor
basis under certain terms and conditions as stated herein below:-
TERMS AND CONDITIONS
1. That the Second Party herein will be inducted in the Schedule
property as Licensee from 10th day of September, 2024.
2. That the Second Party shall pay Rs.9,000/- (Rupees Nine
Thousand) only per month as License Fee excluding electricity
charges and the said amount shall be paid within 10th day of
each on every English Calendar Month in advance. The CESC
electric bill will be paid by the Licensee of the Schedule premises
era and paid bills will be deposited in every month to the Licensor
positively.
3. That if the Second party fails to pay the license fee for
consecutive two months or if the license fee is due more the
Security Deposit the Licensee shall be liable to be evicted from
the Schedule property without any prior notice.
4. That the Second Party shall always keep the schedule property in
good and habitable condition.
5. That the Second Party shall not change the nature and character
of the schedule property without permission of the First Party or
damage the same in any manner whatsoever.
6. That the Second Party shall pay a sum of Rs.10,000/- (Rupees
Ten Thousand) only to the First Party as Security Deposit before
induction and the same will be refunded to the Second Party after
expiry of the agreement and at the time of handing over the
possession of the schedule property to the First Party in habitable
condition without interest. If the Licensee leave the licensed
portion before 11 (eleven) months, security deposit will be paid
by the Licensor after the payment of security deposit by the new
Licensee.
It is pertinent to mention that if any damage in the inner portion
of the schedule property caused by the Second Party the
repairing charges will be deducted from the Security Deposit.
7. That the License period will be commenced from the 10 th day of
September, 2024 and the same will be ended in 9 th day of July,
2025 ie.,it is exclusively for 11 (eleven) months. If the Second
Party leave the property before 9th day of July, 2025. They
should must inform First Party two months before hand over
schedule property.
It is pertinent to mention that time is the essence of this
agreement and the stipulated period of License as mentioned
above shall be extended in any manner whatsoever and the
Second Party herein is liable to vacate and handover the peaceful
possession of the schedule property to the First Party Within the
stipulated period as mentioned above
8. That any maintenance issues during residing period the party will
have to bear the cost to fix it.
9. That the Second Party shall use the Schedule property for
residential purpose and the First Party herein shall not raise any
objection over the same. Two months notice period will be
effective from either side.
10. That the Second Party herein shall not store any inflammable or
highly combustible goods inside the Schedule property except
cooking gases. Any type of misbehaviour, violence, illegal activity
of the Licensee will lead to cancellation of this Agreement
immediately.
11.That the Licensee will use only the licensed portion and not outside
schedule premises. If any maintenance is required the Licensee will
pay the maintenance Fee in every month.
12.That the Second Party shall not keep any obnoxious goods inside
the schedule property or put article on the common passage or
Open space of the building.
13.That both parties shall strictly follow the terms and conditions of
this agreement if any party violate any terms arid conditions of this
agreement other party has every right to take necessary legal
action both Civil and Criminal against other.
SCHEDULE OF THE PROPERTY
ALL THAT piece and parcel of a Residene on the Ground Floor
measuring about approx 500 sq.ft. consisting of 2(two) bed rooms,
Mon Kitchen, lone) Living cum Dining and lone) bathroomwhich ying
and situate at P-9/11/1, Bijoygarh, P.5-Golfgreen, Kolkata-700 032.
NOW IN WITNESS WHEREOF both the parties put their respective
sign, seal and hand in presence of witnesses herein.
