CONTRACT OF LEASE
KNOW ALL MEN BY THESE PRESENTS:
This agreement made and entered into this _____________day of___________2025 in Angono, Rizal,
Philippines by and between:
PIERANNE KARLA P. SAN JUAN, a duly registered single proprietor, with residence and postal address
at 207 Garcia Compound, Muzon, Taytay, Rizal now and hereinafter referred to as “LESSOR”.
88 GRAND PACIFIC CONSTRUCTION, addressed at YAB DESIGN COMPOUND M.L. QUEZON AVENUE,
BRGY. SAN ISIDRO, ANGONO, RIZAL, with its representative, TONY LANDERO RAMOS, now and
hereinafter known as the “LESSEE”.
WITNESSETH That:
WHEREAS the LESSOR is the owner of the Two-story residential building located at Block 3 Lot 4
Sunstrip Greenvillage, Brgy. Kalayaan, Angono, Rizal.
Whereas, the LESSEE desires to lease the aforesaid premises to which the LESSOR agrees subject to
the following terms and conditions herein below specified:
1. PERIOD OF OCCUPANCY: This contract shall be for a minimum period of six (6) months starting
from January 1, 2025, unless sooner terminated as elsewhere provided herein, renewal and or
extension of the term of this contract shall be at the sole option of the LESSOR and must express
so in writing.
2. RENTAL RATE: The LESSEE shall pay to the LESSOR for the use and occupancy of the said
residential building hereby leased a monthly rental of P15,000.00 (Twenty-Five Thousand) Pesos
Philippine Currency payable in advance every 1st day of the month and every month thereafter.
The LESSEE shall upon signing of this contract pay to the LESSOR the amount of P45,000.00
(Forty-Five Thousand) Pesos Philippine Currency to be paid as follows:
The sum of P15,000.00 (Fifteen Thousand) Pesos Philippine Currency as payment for one (1)
month advance rental for the month of January.
The sum of P30,000.00 (Thirty Thousand) Pesos Philippine Currency as deposit which is non
interesting bearing, to answer for water consumption, electricity and other public utility bills or
damages to the leased premises and is nonrefundable/non-convertible to rental fee.
The LESSEE will only pay its rental solely to the LESSOR, the LESSOR is not accountable when the
LESSEE paid the rent to someone else.
3. DESCRIPTION OF PREMISES:
a. Furnishings: The premises has been furnished as described below:
i. Sofa (Sofa Bed)
ii. TV rack
Notwithstanding normal aging and wear, the Tenant shall maintain this furniture in its
original condition as far as possible.
b. Appliances: The premises include the following appliances:
i. Air Conditioning
The LESSEE shall maintain these appliances in their original condition as far as possible.
4. USE OF PREMISES: Subject leased premises shall be used only as residence of LESSEE.
Said premises may not be used for any other purpose and by any other person nor may it be
subleased by the LESEE. The LESSEE hereby covenants with the LESSOR as follows:
a) To pay aforesaid without the necessity of express of demand therefore, the residence or
collector of the lessor;
b) To pay for the rent of the un-expired term of this contract should the LESSEE voluntarily
vacate the premises before the expiration of the term;
c) Should the LESSEE FAIL to pay the rent herein stipulated in the accordance with the term
above mentioned or violated the terms of contract, the LESSOR shall have the right to eject
the LESSEE from the premises, and to collect and recover from the latter all accrued rents.
The LESSEE further promises and agrees to vacate premises voluntarily within a period of
Fifteen days (15) upon due notice in case breach of any terms further agrees to leave part of
his/her belongings not exempted from the execution to answer for his/her debts.
d) In case of court litigation by virtue of non-payment of the agreed rent or any other breach of
terms of this contract on the part of the LESSEE, LESSOR shall entitle to collect Ten Thousand
(10,000.00) Pesos Philippine currency as Attorney’s fees exclusively of legally taxable cost.
5. DELIVERY AND OCCUPANCY OF THE PREMISES: To use the premises as RESIDENTIAL ONLY and
not for other purpose such as sari-sari store, warehouse, commercial nor to construct a stable for
the keeping of the dogs, cats, horses, cows, pigs, chicken, detrimental and obnoxious to the
neighborhood.
It is being expressly agreed that if, anytime during the exercises of this contract and without the
previous written consent of the LESSOR, said premises use for other purpose the LESSOR has the
choice to rescind this contract and compel the LESSEE to stop the new activities.
The LESSOR reserves the right to reasonably limit the weight of any appliances or heavy
equipment which is deposited inside the premises. The corridors, entries, passages and stairways
shall not be obstructed.
6. UTILITIES: All expenses for water, electric current, internet, house and pest control, garbage fees,
monthly dues and other public utility bills shall be for the account of the LESSEE and should be
paid on time. Any arrears and unpaid accounts will be shouldered by the LESSEE.
7. IMPROVEMENT & ALTERATION: The LESSEE shall not make any structural changes, installation,
alterations or improvements in the occupied premises without the written consent of the
LESSOR. It is further agreed that all alterations, installation or additions and improvement except
the movable furniture’s and fixtures introduced by the LESSEE shall, if so elected by the LESSOR
becomes the latter’s property and shall remain on & be surrender with the premises upon the
termination of this contract without any obligation on the LESSOR’s part to refund its value or
cost to the LESSEE if the LESSOR does not elect to retain such alteration, addition, installation or
improvement, the premises shall be restored to their original condition by the LESSOR at the
expense of the LESSEE.
8. ASSIGNMENT & SUBLETTING: The LESSEE shall not assign or transfer its right in this contract nor
sublease all or any part of the leased premises without the written approval or consent first
obtain from the LESSOR. Request to transfer from occupied unit to another unit is not allowed.
9. INSPECTION & MAINTENANCE: The Lessor or its authorized agent may enter the leased premises
at reasonable hours to examine the same, or for any purpose which may deem necessary. For the
purpose of seeing to it, for the convenience of all concerned that the condition of the premises is
maintained in good condition. The LESSOR reserves the right to enter and inspect the premises.
The LESSEE may allow and give access to the LESSOR of the leased premises for the purpose of
making repairs, remodeling or repainting, conservation, improvements or decoration of the
building or any part thereof. No compensation or claim shall be allowed against annoyance or
injury to the LESSEE’s business that may arise by virtue of the above undertaking.
10. CARE OF PREMISES: The LESSEE acknowledges receipts of the premises in good condition &
agrees to keep and maintain & return to the same condition when vacating the premises. The
LESSEE shall, at his own expense, maintain the leased premises in a clean and sanitary condition,
free from obnoxious, disturbing noises and other nuisance. The LESSEE is responsible in keeping
the sink, lavatory, toilet bowl free from clog. The LESSEE shall not drive nails, screw hooks or
other abutments on the wall or frames in other portion of the building if these deface the wall of
the unit/premises.
The LESSEE shall keep all the interior of the leased premises in good, clean and tenable condition
and shall preserve paint and lime wash the same whenever appropriate. The LESSEE agrees to
replace any broken or damage part of the leased premises caused by the willful act or negligence
of the LESSEE, members of the family, his/her relative, servants, guest or visitors etc. The LESSOR
reserves the right to clean the premises at the expense of the LESSEE if the latter does not keep
proper maintenance of the same.
11. RESTRICTIONS: The LESSEE shall not bring or store the leased premises any flammable or
explosives goods or materials, not any articles which may be expose the leased premises to fire or
increase the fire hazard of the building or any article which the LESSOR may prohibit.
Anything to the contrary herein contained notwithstanding LESSOR reserves the right to
terminate this contract should at any time chemical odor, noise or other emanations from and
within the leased premises caused injury, damaged or inconvenience or discomfort to tenants or
occupants of adjoining or contiguous property or to the public, or upon the complaints if such
persons.
Parking Area is allowed for LESSEE only who has a vehicle but not more than one vehicle per
leased unit to park on the parking space provided. The LESSOR is not responsible/ liable for any
damage or any loss of valuables in the vehicle.
12. DEFAULT: If the rental herein stipulated or any part thereof, at any time, fail or neglect to
perform or comply with any of these covenants, conditions, agreements or restrictions stipulated,
or if these LESSEE become BANKRUPT or INSOLVENT or shall compound with their creditors,
then and in any of such above cases, this leased contract shall become automatically terminated
and cancelled, and rendered without further force and effect at the LESSOR to hold henceforth as
if these presents have not been made and it shall be lawful for the LESSOR or any person duly
authorized in his behalf, without prejudice on the part of the LESSOR to exercise any and all rights
from the contract of leased and those given by law, and upon such cancellation of the contract,
the LESSOR may enter and take possession of the leased premises as thought the term of this
contract has expired.
13. That, upon the termination of this lease, for whatsoever cause or causes and without the
necessity of a court order, the LESSEE shall promptly and peacefully surrender possession of the
lease premises together with the keys appertaining thereto, in the same good condition as it was
upon the commencement of this lease ordinary wear and tear excepted, devoid of all occupants,
removable furniture, fixtures, articles & effects.
14. That, if the said premises is not surrendered to the LESSOR In the manner provided for in the next
preceding paragraph, the LESSEE shall be responsible to the LESSOR for all damages which the
LESSOR may suffer by reason thereof and will indemnify the lessor against ay all claims made by
any succeeding tenant against the LESSOR, resulting from delay by the LESSOR in delivering
possession of the premises to such succeeding tenant.
The LESSOR, at its option may remove any and all furniture, fixtures, articles and effects of the LESSEE
in the leased premises upon the termination of this lease without any obligation on the part of the
LESSOR for the safekeeping, care and maintenance thereof, and the obligation of the LESSEE under
this Contract shall not terminate until the premises leased shall have been surrendered to the LESSOR
in the manner provided for in paragraph 12 hereof.
