Dear Mrs. GANDAHAN,

The undersigned counsel is writing this letter on behalf of our


client, your sibling, FELIPPE P. MALAKAS. This is in connection with the
property left by your late mother, CATHY D. MALAKAS, specifically the
portion of a parcel of land located in Don V. St., Poblacion Quezon City,
Metro Manila, with an area of Two Hundred Sixty-Two (262) square
meters and identified as Lot 13.

It has come to our client's attention that you are currently in


possession of and occupying the aforementioned parcel of land,
thereby unlawfully barring our clients from accessing and exercising
their rightful ownership and enjoyment of the said property.

Under the law on succession, upon the death of a parent, the


properties left will be EQUALLY divided among the legal heirs. However,
you have barred our clients from entering the said parcel of land
without any valid and just cause.

As co-heirs to this property, my clients seek an amicable


resolution to divide or otherwise settle their respective shares in the
estate. To this end, we demand that a partition of the property be
undertaken.

This letter serves as a Formal Notice and Demand from our


clients for the partition of the aforementioned property. Our clients
seek to resolve this matter amicably and out of court to avoid
unnecessary litigation and associated expenses. However, should you
fail to comply with this demand, we will have no alternative but to
initiate the appropriate legal proceedings to safeguard our clients'
rights and interests. In such an event, you may also be held liable for
damages, attorney’s fees, and other related costs.
Should you want to settle this matter amicably, you may reply on
this letter within Seven (7) days from receipt hereof.
