Dear Sirs,

With reference to the above, MPPGCL is pleased to issue this work order for subject work at your quoted rate of
<.7,42,800t' for complete job ( {. Seven Lakh Forty Two Thousand Eight Hundred Only) excluding GST. The GST
shall be paid extra. (Present rate of GST is 18%).
TERMS & CONDITIONS:-

1. BASIS OF ORDER:- The work will be governed by the "standard Bid Document' (SBD) in our NtT and scope of
work' Annexure attached herewith. Our tender specification and your offer mentioned above along with
subsequent correspondence if any shall be the basis of this order and the terms and conditions therein shall
apply for execution of this contract, main terms and condition are as under:-
2. The S.E.(Ser)-|, MPPGCL, SGTPS, Birsinghpur will be the officer in-charge for subject work. The contract
period will commence as per directives of OIC of contract.

D PRICES:- Price are firm and shall remain unchanged throughout the contract period.
iD PAYMENT:- Payment will be made within 45 days or on turn as per queue, whichever is later, on submission of
bill in triplicate to The O/o S.E.(Ser)-|, SGTPS: MPPGCL: Birsinghpur, after satisfactory comptetion of work. The
Company shall not be liable to pay any interest in delay of payment.
iii) CONTRACT PERIOD:- The contract shall be valid up to 01 year from the date of order, however, work shall be
completed within.90 days after handing over the site. The contract may be further extended on mutual consent of
contractor and MPPGCL if required.
iv) QUANTITY VAR|ATION CLAUSE:- As per clause no. 2.37 at page no. 48 of SBD, the quantity indicated in the
order are approximate. Theses quantity/period may vary according to the requirement. Company reserves the
right to increase or descrease the quantities or award contract for same work to more than one party. The
contractor will be bound to accept any such increase or reduction in the quantities.
v) AGREEMENT:- Please attend the office of the S.E.(Ser)-I, SGTPS, MPPGCL Birsinghpur along with a non-
judicial stamp paper worth Rs. 500/- for order value up to Rs. fifty lakh & order value more than rupees fifty
lakh
worth 0.1% subject to maximum of five lakh rupees & revenue stamp worlh Rs. 2/- affixed on agreement.
vi) INSURANCE OF WORKER & LABOUR LICENSE:- The contractor shall get their workers insured and obtain
labour license before start of work. Photocopy of these documents must be submitted before commencing the
work.
vii) COMPLIANCE OF FACTORY ACT & LAEQUR LAWS :- The contractor shail be liabte for the due observation
and implementation of the statutory conditions and requirement of factory act and other labour laws as applicable
to his workmen. lf any penalty is imposed on factory occupier / Factory Manager due to non compliance of labour
laws the same shall be borne by the contractor. Also the contractor shall be liable to the like punishment as if he
was the occupier / Manager of the factory and the occupier / manager as the case may be shall be discharged
from any liability. Jhe contractor is fully responsible for legal action initiated by labour officer. E.P.F. Enforcement
officer for payment of minimum wages / E.P.F. etc.

viii) IMPLEMENTATION OF FAIR WAGES & EPF ACT:- Employee's provident fund (EPF) code for the manpower
engaged by the contractor shall be obtained from competent authority and documents should be submitted tc the'office'
of Engineer ln- charge within reasonable time, failing which payment for running/final bill may be lvithheld. In addition to
this, EPF No. Slip (UAN) obtained from the competent authority shall be distributed to each of his workers by the
contractor. The contractor is fully responsible for legal action, if any, initiated by labour officer/ E.P F. Enforcement
officer for issues regarding payment of minimum wages / E.P.F. etc. due to violation of Govt. rules /acts.
ix) sAFETy MEASURES AND SAFETy AppLIANCES :- Contractor shall provide to workers all safety appliance like
safety shoes, hand gloves, h'elmets, safety belts, tester, dust guard and work shall be got done in the manner keeping
safetv of workers on top priority. First aid kits shall be provided at work places and all necessary medicines and
appliances shall be made available by the contractor.

his workers.
xii) pAyMENT OF LABOURSMORKERS :- The contractor shall be responsible for compliance of lr/adhya Pradesh
Iilinimum wages act 1973 and he will also be responsible for payment of wages to his employees through cheque or
bank transfer as per Govt. Rule and implementation of Govt. EPF rules. Monthly wage slip shall invariably be issued to
each worker and duly signed copy of the same from the individual worker be endorsed to Officer-in-charge of the
contract. The worker monthly wages and any other payment as per Govt. norms shall be made through cheque or bank
transfer in presence of OIC and duly certified worker payment sheet shall be submitted along with bill positively.
xiii) SECURITy DEPOSTT:- Contractor has to deposit 10% of the total order value toward* security deposit. The S.D.
amounting to'10% of totalordervalue should be furnished in the form of D.D.l Cash lB.G. {As perclause no. 2.8
at pahe no. 38 of SBD) in favour of Jt. Dir. (F&A), MPPGCL, Birsinghpur. The securily deposit shall be retained till
satisfactory completion of work and fulfillment of all statutory formalities as per tender terms and conditions stipulated in
tender specification booklet. The aforesaid Bank Guarantee shall be executed on non-judicial stamp paper worth 0.25%
of BG value ( Rounded up to multiple of t 10/-) subject to minimum { 500/- and maximum { 25000/- onlv & revenue
stamp worth ( 2/- affixed on Bank Guarantee. ln addition to this, the firm shall also deposit <. 6,64,8121- in shape
of cash/BG as additional perforrnace security before start of the work. This amount alongwith 10% security
deposit will be kept till the completion of contract period. ln case of non compliance of statutory liabilities of
the contract, the performance guarantee and SD amount will be encashed as per demand to meet out duch
expenses.
xiv) RELEASE OF SECURITY DEPOSIT:- The concern S.E. of respective circle shall complete all the formalities i.e.
fiieparation of No dues related for release of S.D., after successful execution of order in all respect. The S.D. amount
shall be released from site accordingly after obtaining due concurrence of this office.
xv) PENALTY:- (a) ln case of delay in work, a penalty calculated @ [Link] per week or part thereof subjected to maximum
10% shall be imposecl on total order value of work. The earnest money/ security deposit shall be forfeited, if contractor
fail to complete the work satisfactory, within prescribed time, and if Company feels then the work may be got completed
from other agencies & the amount whatever so paid shall also be deducted from any sum payable to you.
(b) Penalty for the incomplete work shall be as per MPPGCL rules.
(c) ln case, if any worker is observed not following the safety rules and regulations as per requirement of fac1ory act
and other relevant law, penalty as deemed fit. (Not exceeding < 600/- per day) shall be imposed by Engineer-in-
charge/safety officer.

xvi) SUBMISSION OF BILL & PAYMENT :- R.A. bill along with copy of relevent documents as desired by the OIC shall be
submitted to O/o The Superintending Engineer (Ser)-|, IMPPGCL, Birsinghpur who will arrange to process the same as
per existing practice and countersign the same before sending it to O/o Jt. Dir. (F&A), tVIPPGCL, SGTPS, Birsinghpur.
xvii) T&P :- Contractor shall provide all necessary tools & tackles to ensure execution of work in most efficient & safety
manner.
xviii) INCOME TAX DEDUCTION AT SOURCES :- lncome tax will be deducted from contractor's bill as per Govt. rule.
xix) SUBLETTING OF CONTRACT :- A) The contractor shall not sublet, transfer or assigri whole part of the contract on
back to back basis or the core activity as specified in pre-qualifying reqr-rirement for which the contractor has been
judged before award of contract. ln case if contractor sublets, transfer or assign the contract as stated above then
MPPGCL shall have the rlght to cancel the contract and to get work/services done from elsewhere and contractor shall
be liable to MPPGCL for any loss or damage along with 24o/o overheads which I/PPGCL may sustain in consequence
or arising out of such services and the contractor shall indemnify such loss or damage to tvlPPGCL.
(B) Enga-ging workers through labour contractor and statutory compliances thereof to this effect does not come under
ine purview of sub-letting. However, in such case, prior permission shall have to be obtained from order issuing
authority.
xx) TRANSPORT :- Contractor shall provide his own transport for men and material deployed by him.

xxi) GST :- GST will be paid extra as per prevailing rate of Govt. rules on submission of the documentary evidence towards
the same. Contractor will be fully responsible to deposit the GST to the concerned Govt. Department as per rule &
prevailing rates, policy introduced by the central govt. w.e.f. 01 .O7.17 for payment of GST shall be applicable.
xxii) The contractor shall arrange and install biometric based attendance system for the complete work force against this
contract at its own expenditure and labour payment sheet shall be verified accordingly by the site incharge before
processing the monthly invoice of the work.
xxiii) lf any of the condition of the contract is not followed by the contractor then it will be treated as breach of contract & in
such case, contract shall be terminated & S.D. /E.M.D. shall be forfeited. Further panel/legal action as per MPPGCL
rules may also be Iaken.
xxiv) MPPGCL reserveS right to foreclose the contract partially or fully at any time without assigning any reason whatsoever.
xxv) All the future coirespondence related with the NlT/order/contract shall be addressed to the OIC of the contract.
xxvi) DISPUTE:- Any dispute what so ever will be settled under Umaria/Jabalpur jurisdiction only.

All other terms & condition shall be as per tender specification No. 2023_MPPGC_255357_1

Scope of work
Part - A (4x210MW. GHP-I)
1 All T&P, welding machines, welding electrodes, cutting gas, safety equipment, gr,inder machine etc shall be
arranged by contractol.
2 Shifting of M.S. plate/flat from O&M store and fabricate Jali/grill/plate as per drawing by cutting, chipping,
grinding is in scope of contractor work.
3 Welding in each frame of whole jail/grill of both sides to be done properly.
4 After welding & grinding two coats of red oxide paint shall be painted by contractor.
5 Free electricity and M.S. Plate, M.S. flat, MS angle (Scraped/new one as per availability) shall be provided by
IVIPPGCL.
6 Transportation of material from store and remaining scrap after completion of work back to store shall be
done by contractor(dumper & crain provided free of cost, if available) .
7 Required manpower, machines, clamps and other consumables for successful execution of above said
works shall be in scope of contractor.
B Free water supply and electricity remains in MPPGCL's scope.
9 The Screen slots to be cut as per drawing, however necessary modification may be done as per requirement
and as per instruction of Engineer in charge. ( For Sr. no. 4&5)
10 The C.S.K. holes on kick of plates & Tramp liner plates shall be drilled only after confirming the actual
matching with the crusher surface where the plates to be fixed. ( For Sr. no. 4&5)
11 Special purpose hard facing electrode shall be in scope of the contractor. Average 4mm hard facing shall be
done on top surface of kick off & Tramp Liner plate with L&T make special purpose hard facing electrode.

Part - B (1x500MW. CHP-ll)
1. All T&P, welding machines, welding electrodes, cutting gas, safety equipment, grinder machine etc shall be
arranged by contractor.
2. Shifting of M.S. plate/flat, cutting, chipping, grinding is in scope of contractor work.
3. For jointing of flats, deep slot upto 75 mm shall be cut on 150 mm flat and further 75 mm flat shall be inserted
into each other and welded together on all four side of the joint.
4. Both Flat shall be joint by welding. Welding is to be done on all four faces of each joint. For welding work good
quality lSl mark welding electrode shall be used for fabrication of grills.
5. After welding & grinding two coats of red oxide paint shall be painted by contractor.
6. Free electricity and M.S. plate/flat shall be provided by MPPGCL
7. Transportation of material from store/site and remaining scrap after completion of work back to store shall be
done by contractor.

TERMS & CONDITIONS

01 The contractor has to deploy sufficient manpower to execute the work within specified duration.
02 ACCIDENT :-ln case of accident during commencement of work all responsibility of the injured person shall
rest with the contractor, MPPGCL shall not be responsible for providing transport or medical facility.
n2 The contractor shall submit following documents within 07 days of placement of work order/LOl before start
of work :-
(A) Agreement Bond.
(B) Valid Labour License issued from labour officer, Umaria.
(c) Labour lnsurance.
(D) Letter of attorney of authorized representative, who shall be available to the Engineer-ln-Charge all the time
during the period of contract in absence of the contractor.
o4 The contractor shall arrange all required T&P, safety appliances to carry out work under his scope.
05 The contractor should be responsible for compliance of Madhya Pradesh minimum wages Act-1973 and he
will also responsible for payment of wages to employees through cheque/bank account as per Govt. rule.
06 The contractor should get independent EPF code No. allotted by conoerned enforcement officer (EPF) and
furnish the same before starting the work.
07 LABOUR LICENCE/ INSURANCE:- The contractor shall posses necessary Labour License issued from
Distt. Labour Officer, Umaria as per M.P. Govt. rules and arrange necessary insurance of contractor's
personnel employed at site as required under Workmen's Compensation Act against subject order.
Documents in this respect should be submitted to OIC within a week.
08 The contractor shall be responsible for obtaining gate passes for his personal and getting them renewed as
and when required.
09 All consumable like D.A. & Oxygen gas, general purpose welding electrodes cotton waste etc. have to be
arranged by the contractor at his own cost.
'10 The contractor has to follow all rules and regulation of the MPPGCL/State Govt./MPPGCL.
11 Quality of work should be standard and guaranteed for a period of 12 months from the date of
commissioning.
12 All the existing and future legalifinancial/other liabilities of the contract shall be in the scope of the contractor
13 The contractor sh.a-ll make payment to the manpower engaged for the work strictly through bank only.
14 All other terms & eonditions as per standard norms of MPPGCL
15 The contract shall be valid for one year, however, the work shall be completed within 90 days from date of
instruction of OlC.
