Affidavit of Arrest
We SPO 1 JAYLORD BASIUANG and PO2 JOVEL LOYOLA, both members of the
Philippine National Police, presently assigned at the Police station of Tuao Cagayan, do hereby
depose and state THAT:
01. We are among the members of Tuao Police Station who conducted the hot-pursuit
operation located at Cato Tuao Cagayan.
02.The said operation is stemmed from a call of Mrs. Kim Chiu for an alleged murder case
which is received by our station.
03. On the call dated May 15, 2024,for an alleged murder case.
04. Upon receiving the call, our office send police officer to conduct an investigation and after a
successful investigation, the suspect was identified and our office immediately planned a hot-
pursuit operation. At about 2:00 in the afternoon of May 15,2024 ,the undersigned together with
the witness proceed to possible place where the suspect might stayed .
05. Upon arrival there at, luckily the suspect was present there and has been identified directly
by the witness. The undersigned together with the other police officers immediately
arrested the suspect.Informing his rights ,while commencing the arrest.
06. Suspect was brought to the Municipal Police Station of Tuao Cagayan for
booking and proper disposition. Likewise the arrested person was apprised for his rights as
provided for under the Constitution of the Philippines.
07. We executed this affidavit to attest the truthfulness of the forgoing facts and to support the
filling of the Criminal Case against Mario Loyola for violation of Article 248 of the Revised
Penal Code of the Philippines (MURDER)

AFFIDAVIT OF WITNESS
I,Jaylord Basiuang, 23 Years old,single,resident of Barangay Cato , Tuao Cagayan,after having
sworn in accordance with law do hereby depose and state THAT;
1. On May 15 2024 at aproximately 9: 30 AM in the morning,I witnessed a theft at Cato,Tuao
Cagayan.The theft involved a 12 inches I PAD pro which belong to our neighborhood named Christian
Blam
2. The Perpetrator of the theft was identified as Mark Bitun,who I recognized from prior encounters in the
neighborhood.
3. I observed Mark Bitun, unlawfully taking taking aformentioned items from the house of Christian
Blam.I am certain of their identity as I had a clear view of the incident.
4. Following the theft ,I immediately contacted the authorities and provided them with a detailed description
of the events,including the appearance and actions of the perpetrator
5. I am willing to testify to the above-stated facts in any legal proceedings related to this incident.

against Mark Bitun, for violations of theft

THE UNDERSIGNED, Inquest Prosecutor accuses MARC MOLINA of Fugu,Tuao,
Cagayan, of the crime of Homicide, committed as follows:
That on or about May 15 2024, in the Municipality of Tuao Cagayan, the said accused,
did then and there wilfully, unlawfully and feloniously with intent to kill, attack , assault and
use personal violence upon one Jovel Loyola, by then and there hitting him on the head with
a piece of woodthereby inflicting upon the latter mortal wounds which were the direct
andimmediate cause of his death thereafter.

Q- What is your name and other personal circumstance?
A- I am Jomar Malobag 23 years old,single bartender at SISSIWIT BAR
and presently residing at Barancuag Tuao Cagayan.
Q- Mr.witness on the night ofApril 15 2024 were you working at the
SISSIWIT BAR?
A- YES ,I was
Q- Did anything usual happen that night?
A- Well around midnight there was alteration between two
patrons,one of them latter identified as Mark Mabborang ,got into
a heated argument with the other man at the Bar
Q- Could you describe what happen to that altercation?
A- Mark Mabborang and the other man were exchanging words ,and
escalated quickly.I couldn’t here everything they were saying,but
seemed like they were arguing about money.The Mark Mabborang
suddenly pulled a knife and stabbed the other man.
Q- Did you see what happened after stabbing?
A- Yes Mark Mabborang fled the scene immediately after stabbing.I
called the POLICE hotline and they arrived shortly afterward.
Q- How certain are you that the person you saw stab the victim
indeed?
A- I m postive. Ive known Mark Mabborang for years.We grew in the
same neighborhood,and he’s regular at the bar.

I,PO2 Jaylord Basiuang , of legal age, Filipino, a member of the Philippine National Police
(PNP) assigned as Tuao Municipal PoliceStation, under oath, hereby state:
1. Last May 15, 2024 at about 11:00 in the evening, my companion PO2 MARCO LAMER and
I was going on a routine police patrol using the station’s patrol car along Tuao Cagayan;
2.Suddenly, from out of the tall grasses beside the road, a lying man was no life in the ground,
and my companion saw it, so I stop the Police Patrol mobile.
3.My companion suddenly stopped while the man was lying near us. Sensing that something was
wrong, I got out and took out my gun, just in case;
4.The lying man, whom I later came to know as JOVEL LOYOLA who resides at Bulagao Tuao
Cagayan, was lying on the ground with no life. I saw two (2) male person rapidly walking away
from the scene.
5.With the purpose of inquiring from them about the possibility of being witnesses, I thus fired a
warning shot and shouted at the two (2) male to stop or else I will shoot them. Instead to stop,
they immediately ran prompting me to chase and apprehend them.
6.Basing on the ID’s recovered and a finger print latent in the
blooded weapon with fresh blood in it, from the person I arrested,it was established that the
murderers name was Charlie Jose (23 years old) and James Harden (25 years old), both residents
of Bulagao Tuao Cagayan
7I also recorded these series of events at the MPS Blotter, an-excerpt of which is here to attached
as thereof;
8.I am executing his statement to attest to the truth of the statements I made above and for
whatever legal purpose this may serve.

1. That I am the complainant in Criminal Case No. 123-45, entitled People of the Philippines Versus
Romarico Turo, pending before the Regional Trial Court in Pata, Tuao Cagayan
2. That I am executing this Affidavit of Desistance to formally manifest my intention to withdraw
and discontinue the criminal complaint I filed against Romarico Turo for the offense of Direct assault, as
charged in the aforementioned case.
3. That I have carefully considered the circumstances surrounding the incident that led to the filing
of the said complaint, and after much reflection and deliberation, I have come to the decision to no
longer pursue the case against the accused.
4. That my decision to withdraw the complaint is voluntary and free from any form of coercion,
intimidation, or promise of any kind from any person or entity.
5. That I am fully aware of the consequences of my action, and I hereby undertake not to institute
any further criminal or civil action against the accused arising from the same incident.
6. That I am executing this Affidavit of Desistance to formally request the honorable court to dismiss
the criminal case against the accused base on my withdrawal of the complaint.

COMPLAINT OF AFFIDAVIT
I ,JAYLORD BASIUANG, of legal age, single, with residence at Brgy.
Cato,Tuao Cagayan, after having been sworn to in accordance with law, do hereby depose and
state:
1,That I am the incumbent Punong Barangay of Brgy.Cato,Tuao,Cagayan
2.That Jovan Dangue (KAG, DANGUE, for brevity) is one of the members of the
Sangguniang Barangay of the same barangay.
3.That on May 15 2024 at 3:00 in the afternoon, in the vicinity of Barangay,
KAG.Dangue, poked the pointed tip of his umbrella at my face and uttered the
words in front of my constituents, “pesti ka nga kapitan awan mu nga kwenta”.
4. That Direct Assault was committed by KAG.Dangue against me.
5. That all the elements for the crime of Direct Assault are present, to wit:
a.Being the Punong Barangay, I am a person in authority;
b.KAG. Dangue employed force and seriously intimidated me by using his umbrella
and pointed it on my face and uttered slanderous words;
c.Even though I was not in the actual performance of my duties, I was intimidated by
KAG. Dangue by reason of my official functions.
6. That I am executing this complaint-affidavit to attest the veracity of the foregoing
statements, SPECIFICALLY, FOR FILING A CRIMINAL COMPLAINT FOR DIRECT
ASSAULT AGAINST BARANGAY KAGAWAD Jovan Dangue dealt with under Article
146 of the Revised Penal Code and for all legal intents and purposes it may serve.

AFFIDAVIT OF COMPLAINT
I,JAYLORD BASIUANG ,Filipino, of legal age, and residing at Bulagao,Tuao Cagayan, accuses
DAVE BITUN and two other persons of the crime ROBBERY, committed as follows:
That at around 4:50 PM of May 15, 2024, I was driving along Manuel A.Mamba Highway with
my motorcycle, about 400 to 500 meters away from Kristoray Park , when two other riders suddenly went
beside me (each side).
That one of them wore black jacket, black helmet, and brown long pants who was driving a
Yamaha N-Max colored matte black and had someone behind him (back ride) who wore red helmet,
denim short pants, and black Adidas Sandal
The back ride pointed a gun (revolver) at me and shouted, “Itabi mo, itabi mo puputukan kita!”
That the other rider drove in front of me to block me and prevent me from accelerating and getting
away from them. He wore blue hoodie jacket, denim long pants, and blue Nike shoes (which were the
same clothes my co-worker,DAVE BITUN, worn whom I met from the bank I went to)
who rode a Yamaha Mio i125 colored yellow.
That the rider in front of me shouted at the other two who were driving the other motorcycle
beside me, “H’wag niyong saktan!” This is when I confirmed that he and my co-worker,DAVE BITUN,
had the same voice. Hence, DAVE BITUN was one of my offenders.
That I parked in front of the INHS along the same highway. DAVE BITUN and the two other
unknown men immediately followed me and forcibly took my bag containing cash amounting to PHP
10,000,000.00 while holding me at gunpoint
After they took my money, they immediately rode their motorcycles and leave to drive toward the
northbound of Manuel Mamba Highway.
That I am executing this complaint-affidavit in order to file a case of Robbery against DAVE
BITUN, and the two other unknown men who conspired with the former.
That all these stated herein are true and were stated freely without any force or intimidation done
against me.
