Dear Mr. Manalo:

Greetings!

The undersigned counsel is writing this letter on behalf of my


Client, Ms Lariza Pilao of Culasi, Matnog. This is in connection with
the properties you have acquired with my client, more particularly
described as follows:

1.) Parcels of land located in Sariaya Quezon with TCT No.


066-2022004204 and TCT No. 066-2022004209
2.) A house and lot located in Blk 36, Lot 52 Bria Homes
Brgy. Banadero, Calamba, Laguna;
3.) A ninety (90) square meters lot with a n assessed value
of Two Hundred Forty Thousand Pesos located in Sariaya,
Province of Quezon;
4.) An Investment amounting to One Hundred Fifty
Thousand Pesos;
5.) Motor vehicle detailed as 2021 Mitsubishi Xpander GLS
1.5 G;
6.) Motor vehicle described as Suzuki Raider 125;
7.) Appliances, furniture and other improvements.

Ms. Lariza sought the advice of the undersigned with regard to


the partition of the said properties. My Client intimated that she
has a disagreement on how the properties are to be divided
amongst you.

Under Article 147 of the Family Code, when a man and a woman
who are capacitated to marry each other, live exclusively with
each other as husband and wife without the benefit of marriage or
under a void marriage, their wages and salaries shall be owned by
them in equal shares and the property acquired by both of them
through their work or industry shall be governed by the rules on
co-ownership, upon the death of a parent, the properties left will
be divided equally among the legal heirs. However, you have
been refusing to partition the property despite repeated
demands.

Please be advised that it will be to your advantage to comply with


this Formal Notice and Demand, otherwise, my Client will be
constrained to file the necessary legal action(s) against you
without further notice to protect their rights and interests. In
which case, you shall be charged additionally with attorney’s fees,
costs of litigation, damages and other legal fees, aside from the
inconvenience occasioned by court litigation.

Should you want to settle the matter amicably, my Client is willing


to discuss the matter with you in person/ via online platform on or
before December 22, 2024 at any time you will be
available. You may opt to secure the services of a counsel of
your choice to assist you through the process. Please do not
