4
CHAPTER 1: The Problem and its Background

INTRODUCTION

From the original two genders, there are now four genders. Man, woman, “masculine

female-bodied” and the “feminine male-bodied.” In this generation and in present times, they are

called Lesbian, Gay, Bisexual, Transgender and Queer (LGBTQ). A lesbian is a homosexual

woman. The word lesbian is also use for women in relation to their sexual identity or sexual

behavior. Gay is a term that primarily refers to a homosexual person or the trait of being

homosexual. Bisexual is a romantic attraction, or sexual behavior toward both males and

females, or to more than one sex or gender. Transgender is a denoting or relating to a person

whose sense of personal identity and gender those not correspond with their birth sex. Queer is

an umbrella term for sexual and gender minorities who are not heterosexual or are not cisgender.

LGBTQ equality has increasingly focused on the need to protect transgender people from

discrimination. And one of the places where transgender people routinely experience harassment,

mistreatment, and even violence is in public restrooms. As President Rodrigo Duterte idea for

lessening the discrimination against LGBTQ+ people is to put up “3rd restroom” for them. So

President Duterte suggests the third comfort room for LGBTQ.

There are already several laws that protect the rights of an individual. If a member of

LGBTQ community feels offended by the bullying of another person, we have the laws under the

Revised Penal Code and special laws like the “Anti-Bastos Law” that protect them. People will

understand if a gay will enter a male rest room and a lesbian enter a female comfort room. But if

gay enter the female comfort room and lesbian enter the males comfort room it will be

uncomfortable so having a third comfort room is a best solution.

For those who are in LGBTQ community, walking through the public restrooms can be

stressful for them. Simply, fear of discrimination and physical assault. Everyone should have the

right to use public restroom without the fear of discrimination. They shoudn’t be treated

differently just because of their appearance as for who they are. They are still human being that

needs respect and acceptance.

5
This research will focus in having a third comfort room, to avoid mistreatment. Every

information that will be provided by the researchers will give the readers the idea of having the

third comfort room for LGBTQ.

American Split over New LGBTQ Protections, Restrooms Policies

Justin Mccarthy | May 18, 2017

WASHINGTON, D.C. – Americans are about evenly divided on whether new civil rights

laws are needed to protect lesbian, gay, bisexual and transgender people. Fifty-one percent of

U.S. adults say such laws are needed, while 46% say they are not. These data, from Gallup’s

annual Values and Beliefs poll conducted May 3-7, come as Democratic members of Congress

plan to reintroduce a bill that would provide protection for LGBT people from housing,

employment and other forms of discrimination. The bill’s potential for passage is unclear, as few

in the majority Republican caucus have given their support.

Trump Rescinds Rates on Bathroom for Transgender

Jeremy W. Peters, Jo Becker and Julie Hirschfield | Feb. 22, 2017

A key protection issued by former President Barack Obama. Obama’s 2016 “dear

colleague” letter required schools that receive federal funding to accommodate a transgender

student’s gender identity when granting access to comfort rooms or other gender-specified

facilities. In his explanation of Trump’s directive, Secretary of Education Betsy DeVos argued

that although “protecting all students, including LGBTQ students” is “a key priority for the

department,” the issue of transgender comfort room access is “best solved at the state and local

levels.”

More Than Just A Bathroom

Caryn | July 25, 2018

Many public battles for transgender students have centered on the comfort rooms they

want to use. And according to a new paper, gender-neutral comfort rooms are the

accommodation transgender and gender-nonconforming college students want most on their

campuses. But there’s much more on their wish lists that would make them feel safe and

comfortable. Researchers at Clark University and the University Of Massachusetts at Amherst

surveyed more than 500 transgender and gender-nonconforming undergraduates and graduate

students, as well as a handful of recent graduates. They wanted to know what situations are

offering those students—what policies and accommodations are in place—and how important

they are to students.

North Carolina Keaches Settlement on “Bathroom Bill”

Dan Levin | July 23, 2019

A federal judge in North Carolina approved a settlement on Tuesday that prohibits the

state government from banning transgender people from using comfort rooms in state buildings

that match their gender identity, ending a yearlong legal battle that prompted a divisive cultural

debate. The settlement proposed by civil rights groups and Gov. Roy Cooper, a Democrat, could

also end a lawsuit challenging the constitutionality of two comfort rooms bills that thrust North

Carolina into the epicenter of the nation’s culture wars over protections for LGBT people. The

settlement concerns the use of comfort rooms in public buildings like state offices and highway

rest stops. Left unresolved, however, was a part of the lawsuit challenging a moratorium on local

anti-discrimination ordinances.

Transgender Bathroom Lans in California: What Employers Need to Know

LARA A. H. SHORTZ | July 5, 2017

The rights and civil liberties of transgender people have become an important topic

openly discussed and debated nationwide. Clearly, the issues confronting the transgender

community are many, but it seems press coverage has boiled its plight down to a rather narrow

question: which public restroom should transgender men, women, boys and girls use? State

governments have weighed in, some enacting controversially restrictive laws that have led to

consumer boycotts – can you say North Carolina? The Trump administration has made its voice

heard, rescinding guidance that came under former President Obama instructing schools to allow

transgender students access to bathrooms and other facilities that aligned with their gender

identity. As society comes to grips with transgender issues, it is important that businesses here in

California fully understand the status of relevant access laws. Toward that end, I offer this rather

brief overview – brief because the law is very straightforward and narrow in scope.

Esquire Philippines | March 28, 2018

The discussion about LGBTQ rights with regards to public comfort room policies were

sparked a new when it was announced last week that Ateneo de manila installed all gender

new restrooms, which accommodate only one person each, maybe used by anyone, regardless of

gender identity or expression. This new comfort room are part of Ateneo’s “effort to create an

environment of inclusivity.” Unsurprisingly, the announcement was met with a lot of

insensitivity from the general public on the internet. Some of male and female are agree of

having third comfort room for LGBTQ for their own safety and privacy.

Oranne Mariano | July 26, 2018

Catriona Gray was asked to share her thoughts about having a “ third comfort room” for

transgender on Boy Abunda’s “The Bottomline”. The beauty queen explained why she is not

keen on the idea. “I do not agree. I believe if you are a transgender, you identify as that gender.

So i feel that we should accept them and allow them to use the comfort room which they identify

with, which would either be the men or women’s comfort room”. “I think this promotes

inclusivity and allows them to understand what they want as a transgender and that is to be

accepted by us, not just tolerated.”

Bato on Women Sharing Comfort Room with Transgender: “will they be safe”

Jamaine Punzalan, ABS-CBN News Posted | Aug 20 2019

MANILA - Women might experience sexual harassment if transgender women are

allowed to share their comfort rooms, Sen. Ronald Dela Rosa said Tuesday, as lawmakers

tackled a proposed law prohibiting gender-based discrimination. Straight men could pretend to

be transgender, enter a female comfort room and harass women there, said Dela Rosa, a former

national police chief who said he backs gay marriage. "What if the guy are pervert and he will

wear the clothes of a girl? And to pretend to be gay then he will enter to the comfort room of

girls, there is a chance that he will harass the girls," said Dela Rosa. "Are our sisters and

daughters safe there in bathroom?" he added during a Senate hearing on a proposed bill. “I also

have a daughter. That could happen to my daughter, someone might look in on her”, he said.

“There are no proven cases of transgender women harassing females in shared comfort rooms in

the Philippines”, said Naomi Fontanas, president of LGBT group Ganda Filipinas.

GENDER INCLUSIVE RESTROOM TASK REPORT

According to the research of Dot brauer and Sherwood Smith entitled "Gender Inclusive

Restroom Task Report" and research of Matthew Kopas entitled "The Ilogic of Separation:

Examining Arguments about Gender Neutral Object Bathrooms" those researchers say that third

gender restroom is a must to prevent crimes or discriminations for the non-gender confirming

people. Although some of the individuals judgment might not change, but promoting the third

gender restroom can help those who are in third gender lessen their decretion of the

discrimination that they'll receive.

LPU APPROVES GENDER NEUTRAL BATHROOM IN UNIVERSITY

The article was made by Koji Arsua, released at year 2017 the Lyceum of the Philippines

University (LPU) approved request to install two gender neutral restroom. Allowing students

regardless of gender identity to use it. The relationship if this article to the researchers

Proposition, having a restroom for third gender individuals in a university has a lot of good

benefits and if the Lyceum of the Philippines University (LPU) has already approved this. The

SEX, GENDER, TOILETS AND SOGIE

The article was published by Sylvia Claudio and has been released at year 2012. According to

Sylvia Claudio the presence of other movements like those working to end poverty and the rise

of the movements of Gay, Lesbian, Bisexual and Inter sex peoples have been presented real

challenges to our early conceptions of sex gender. So to end gender inequality, promoting of

segregated restroom for the third gender individual is a must. The connection of this article to the

researcher proposition is to promote the gender inequality which is connected in promoting.

Segregated restroom for the third gender individuals.

15
Synthesis

This research is all about having a third comfort room to separate the Lesbian, Gay,

Bisexual, Transgender and Queer and having this third comfort room is a best solution for

LGBTQ. Any gender is important and everyone deserves to be respected, everyone are fighting

for their rights that will say to prioritize them.

This research will provide the information to the leaders, that respecting is more

important. Respecting is one of the best way to communicate with others. This research topic is

to provide third comfort room for LGBTQ to avoid mistreatment.

Theoretical Framework

According to Dale O’leary’s theory about the gender theory in 1950’s, the word sex

refers to the reality of being male and female. Gender is how people identify for who they are

and for people to know what their sex preference. “Sex” is for how the community sees the

people, female and male biologically. Dale also mentions that false beliefs should be eliminated

so that men and women will be able to participate in every activity of society in equal numbers,

both male and female should be treated equally.

The gender theory’s connection to the researcher’s proposition is to also promote gender

equality for LGBTQ community. The LGBTQ individuals will not only have benefits for the

segregated comfort rooms, but it will also resort to having them lessen the discrimination and for

them to feel wanted and accepted.

DEFINITION TERMS

Discrimination – Treating a person unfairly

Equality - State of being equal

LGBTQ - Lesbian, Gay, Bisexual, Transgender and Queer

Mistreatment – The act of treating a person or animal badly, cruelly or unfairly
