TO ALL JUDGES, CLERKS OF COURT, AND ACTING
CLERKS OF COURT/ OFFICERS-IN-CHARGE OF THE
FIRST AND SECOND LEVEL COURTS
SUBJECT: REMINDERS ON THE IMPOSITION OF PENALTIES FOR
CASES FALLING UNDER REPUBLIC ACT 11862
Pursuant to the aims of Republic Act (R.A.) No. 11862 or the Expanded
Anti-Trafficking in Persons Act 0/2022, which amended R.A. No. 9208, or the
Anti-Trafficking in Persons Act 0/2003, all judges of the first and second level :
courts who are to impose fines, forfeiture and/or confiscation of proceeds and
properties as penalties for cases falling under R.A. No. 9208, as amended, are
reminded to consider that:
(l) the dispositive portion of the Decision shall indicate that the fines
imposed, and the proceeds and properties forfeited and confiscated pursuant to
Sec. 14 of R.A. No. 9208, as amended, shall accrue to a Trust Fund to be
managed and administered by the Inter-Agency Council Against Trafficking
exclusively for the programs provided under the said Act, I with the following
details:

(2) the proceeds and properties forfeited and confiscated, if any, shall
now include those collected by the Anti-Money Laundering Council in
