Gun Control and Laws

American politics

Yosef Kahenzadeh

History of the U.S.A

Guns have been a big part if the United States of America even before their independence. When
the United States of America was founded, congress voted to accept the Declaration of
Independence. The Declaration of Independence had a few major ideas, people have certain
Inalienable Rights including Life, Liberty and Pursuit of Happiness. All men are created equal
and that individuals have a civic duty to defend these rights for themselves and others.

On September 17, 1787, thirty-eight delegates signed the constitution, the constitution defines
the laws of the U.S federal government. In summary [[Link]] “the constitution of the
United States established the national government and fundamental laws and guaranteed basic
rights for its citizens.” The American Revolution started mainly because colonies rejected the
imperial rule of Britain, and essentially wanted to be free.

The second Amendment. The Second Amendment is what gives the American citizens the right
to own guns. And it states as follows, “a well-regulated Militia, being necessary to the security of
a free State, the right of the people to keep and bear Arms, shall not be infringed.” The second
amendment was put in place to allow the people the right to bear arms, defend themselves
against the government and any other threat to their freedom. The second Amendment gave the
citizen’s the right to defend themselves and their property. It states that their right to bear
firearms should not be “infringed” meaning the government can’t take away those rights.

Congress H. R. 7910

Congress has recently passed a bill regarding gun laws in the U.S. One of them being the age in
which citizens could purchase or get firearms. They have also put on the bill the restrictions of
large capacity ammunition on firearms. The plan is limiting the amount of ammunition a firearm
could hold to 15 rounds not more. For some people restriction and the ban of firearms is a good
thing. Some people in America believe if guns should be banned, that would stop the shootings
and gun related homicides in the U.S. Theirs an international compression of gun killings and
U.S has more then the UK, Canada, and Australia. Gun laws differ from state to state, some more
strict or lenient then others.

There’s no question that the United States citizens, and even non-citizens have firearms. The
question is, would the ban of firearms bring the shootings down significantly and would it go
against the constitution or not. If citizens right to bear arms were taken that would infringe their
rights and go against the constitution of the United States. Though some might argue, and some
may even say to put more restrictions on guns is the solution. What ever you might believe is
your opinion, and no one has the right to restrict.
GUN CONTROL

Gun control is a term to limit or restrict guns laws in the United States. The gun control act was
in 1968. Congress passed this act to help fight gun violence and crime in the United States. Its
purpose was to have strict laws and regulations on guns and ammunition. At the time handguns
were related to lots of gun violence. The Gun Control Act was to stop gun related homicides but
“There was no statistically or numerically significant impact on homicide levels.”

There are many sides to this argument on whether guns should be banned or be more regulated.
In the U.S over 40 thousand people die every year due to gun violence. That stat by EveryStat
tells that 12.2 deaths per ten thousand, which is a pretty big number. done by non-law abiding
citizens who aren’t. This year there has been more than a few school shootings in the U.S. In
California were gun laws are strict, there has been school shootings. In Texas where gun laws are
not so strict theirs has also been school shootings. Although Texas school shooting was more
devastating due to their being more deaths, it still happened in a state were gun laws are strict.

Democrats & Republicans

Democrats

“With 33,000 Americans dying every year, Democrats believe that we must finally take sensible
action to address gun violence.” Is a quote from the Democratic party platform. In their article
the Democratic party talk about how kids should not be scared to go to school, and people should
not be scared to walk home. “And no human being should be afraid to go to a shopping mall or
baseball field, nightclub or movie theater, concert or college campus.” While they make a good
point no one should have to be scared to walk home or go to a bar, unfortunately we do not live
in that kind of world. The point the democratic party is trying to say, is that if guns were banned
in the U.S people would just be able walk home or go places and not be scared for their lives.
Parents wont be scared to send their children to school and, people could walk worry free in their
neighborhoods.
Republican

The republicans view on guns in America is that people have the right to own guns and use it.
They believe that it is a “fundamental principle that calls for upholding certain rights that the
nation was built upon”. If the government regulates guns it goes against the constitution and the
right of American citizens. There main point is that Americans have a right to defend “himself,
his family, and his property.” According to Republicans if the government bans firearms the
people who are not biding citizens would still have guns whether or not its legal, the citizens
would be defenseless. In Fort Worth, TX it would take police about 9 minutes police to arrive
after dialing 911. Nine minutes is a lone time, a lot could happen, but the argument is that if you
had a fire arm and you could defend yourself, your family and, property. The republican stance
on gun laws in the U.S is that law bidding citizens should have the right to defend them self and
gun control is going against their right to “Bear Arms”.

Nancy Pelosi

Nancy Pelosi is a democratic politician and a former speaker of the House. Democratic politician
Nancy Pelosi is one of the many politicians advocating for stricter gun laws and the ban on
certain ammunition. She has spoken a number times about the “issues” regarding gun laws and
regulation. She like many others wants to pass new gun laws and regulations, she has said in a
conference 'We Have to Act Now' on the issue of gun laws and regulations in the U.S. She also a
in support for the ban of assault weapons as she has stated several times. She has stated “ more
kids die from gun violence then any other cause.” And that assault weapons have been used in
massacre after massacre.”

National Rifle Association

The NRA is an organization, founded in 1871 it was made a charter by New York state.
Ambrose Burnside was the first president, the NRA was founded to "promote and encourage rifle
shooting on a scientific basis". The organizing is a gun rights advocate and today they teach gun
safety, educate people on firearms, the right to “bear arms” and that the government has no right
to restrict the people of their rights. According to the NRA in a study 0.27 of all fatal accidents
injuries due to fire arms and, the number of fatal firearms related injuries have been much less
than ever.

According to the NRA the firearms related violence among children is an “excuse for restricting
firearms owned by adults.” The “assault weapons ban” of 1994-2004 had no impact on crime,
along with the fact that all refill types have only been responsible for only two percent of
murders in the U.S. “Murder rates were 19.3% higher when the Federal [assault weapon] ban
was in effect.” The NRA also explains that Semi- Auto rifles are not “military-grade” as Nancy
Pelosi states, they are not Fully automatic. The NRA also states that assault weapons and large
magazine resulted in less crime in the past. From 1991 -2007 the total crime rate has decreased
as long with an increase in guns purchased, among the guns purchased over 18 million AR-15
witch are classed as “Assault weapons were purchased.

The NRA believes that most gun related violence is in the urban areas and, done by illegally own
firearms. The ban of fire arms including assault weapons will help to solve that issue.

The ban of Assault weapons Unconstitutional?

Nancy Pelosi and many other want to ban the use of Assault weapons in the U.S. An assault
weapon according to Chipman who was nominated by joe bidden to run ATF, is “Any semi-
automatic rifle capable of accepting a detachable magazine above the caliber of .22.” Cotton the
senator who asked the question to Chipman, that would “basically cover every single modern
sporting rifle in America today.” That is a not a large part of the guns in the U.S in fact there is
about 400 million guns in the U.S but only 20 million assault rifles. According to Former FBI
agent Brad Garret most gun murders in the U.S are handguns.

Nancy Pelosi said that police officers should not have to confront “ weapons that is designed for
the battle field” but that is not true. The guns that the military uses are fully automatic and for
citizens to own those guns it would be hard. According to the ATF there are roughly 630,00
Automatic weapons in the U.S out of more than 393.3 million. According to former assistant
director of the ATF, it’s very unusual for law enforcement to run into Fully automatic firearms.

The Assault weapons ban would ban the use of semi- pistols , semi- shotguns, semi-rifles, and
ammunition feeding devices that hold more than 10 rounds of ammunition. “Along with 157
specifically named firearms” this would mean that law abiding citizens will not be able to sell,
transfer along with manufacturing and importing guns.

The bill excludes over two thousand hunting and sporting rifles and shotguns. According to the
NRA the only people who will affected by the ban of certain firearms will be the law bidding
citizen’s of the U.S. this will not solve crime gun related cases because they wont hand in their
guns thus not addressing the issue of gun violence in the U.S.

The ban of “assault weapons” and ammunition magazines that hold more than ten, are a big part
of guns used by the “People” to defend themselves, family and their property. The Firearms that
the government is trying to ban goes against the United States Constitutions second Amendment.
It sates in the second Amendment of the Constitution as follows, “the right of the people to keep
and bear Arms, shall not be infringed..” By having “Assault weapons banned you would
essentially go against that infringe on the people’s right to bear arms. Will gun safety laws don’t
go against the U.S Constitution as we see from Columbia v. Heller, the ban of Assault
weapons will.
Thank you Professor for a pretty great class, I did enjoy getting educated on politics I learnt a lot
of new things and changed my perspective on politics a little. I was going to hand this in last
week but my laptop was having issues and I had to send it to best buy.

Again thank.
