This is a case of Fatal road accident which is occurred on 25.11.2020 in
between 2100 hours to 2310 hours near Roopa school Bhadrachalam and
reported on 26.11.2020 at 0030 hours by the complainant Pittala Laxmi
Deepthi W/o Venkata Ramana, 30 Years, Kapu, House wife R/o Drivers colony
Bhadrachalam, where in the accused Surendar Reddy R/o Medical Colony
Bhadrachalam has been drove his car bearing No: TS28C1112 in a rash and
negligent manner with high speed an endanger to human life and lost control
over the vehicle and dashed to complainant husband motor cycle bearing No:
AP37BT4590, In which the complainant husband namely Pittala Venkata
Ramana S/o late Janaiah,40Years,Kapu,TSNPDCL Employee R/o Drivers colony
Bhadrachalam died on the spot and her nephew Kamma Prasad has been
received injures.
The facts of case are that on 26.11.2020 at 0030hours the complainant
came to Bhadrachalam Town Police station and lodged a Telugu written
petition in which she stated that on 25.11.2020 at 2100hrs the complainant
husband by name Pitta Venkataramana and her son-in-law by name Kamma
Prasad both are going to her brother home at Shanthinagar colony
Bhadrachalam on their motor cycle bearing no.AP37BT4590, after at about
2130hrs her brother phoned to her and saying one car bearing No:
TS28C1112 driver drove his Car TS28C1112 in a rash and negligent manner
with high speed an endanger to human life and lost control over the vehicle
and dashed to complainant husband motor cycle bearing No: AP37BT4590 in
opposite direction. In which the injury persons shift to Hospital for treatment
on the way the complainant husband died and her nephew Kamma Prasad
has been received injures and shifted to Private hospital for treatment. Later
the car driver name came to know that Ponugoti Surender Reddy s/o Ram
Gopal Reddy, 36 yrs., Reddy, Contractor r/o Medical colony, [Link]. 9-1-99
Bhadrachalam. In this regard the complainant is requested to take necessary
action and do justice.
On receipt of the above petition of the complainant, registered a case
in Crime No.407/2020 U/Sec.304 (A), 337 IPC, issued FIR and submitted the
original FIR and copies thereof to all concerned and took up the investigation.
During the course of investigation examined the LWs-1 and 2 at police
station and recorded their detailed statements in part-II CDs.
Later visited the scene of offense which is situated at ITDA road Near
Roopa School Bhadrachalam at a distance of 2KMs towards East direction
from the Police Station and observed the scene minutely and drafted the
same in the concerned columns of the CDF before two responsible mediators
i.e. the LWs-8 & 9. Later, Secured the presence of witnesses i.e. LWs-3, 4 and
6 and 7 examined and recorded their statements in part-II CDs. Summoned a
private photographer i.e. the LW-5 and got photograph of the deceased dead
body and recorded his statement in part-II CDs. Later examined deceased
dead body in very close and conducted inquest in presence of the LWs-10 &
11, after completion of the inquest a PME requisition had been given to
Medical Officer, then the medical officer held autopsy over the deceased
dead body. After completion of all proceedings, the deceased dead body
handed over to his blood relatives for his last rites.
Today I.e. 26.11.2020 at 1400hrs the accused came to PS and
voluntarily surrendered before to me, then interrogated them thoroughly;
during the course of interrogation the accused voluntarily confessed and
admitted his guilt in this offense. Later prepared Sec 41(A) Cr.P.C notice and
same served to accused by giving an instruction to attend the court at the
time of the Trial when summons received by the court
From the evidence collected the investigation done so far it is
established that the LW-1 is the wife of deceased and circumstantial
witnesses, LW-2 is the brother-in-law of the deceased and circumstantial
witnesses, the LWs-3 and 6, 7 are the eyewitness. On 25.11.2020 at 2100hrs
the deceased and his son-in-law both are going to Lw-2 home at
Shanthinagar colony Bhadrachalam on their motor cycle bearing
no.AP37BT4590 at about 2130hrs the Lw-2 phoned to Lw-1 and saying as the
accused drove his car bearing No: TS28C1112 in a rash and negligent
manner with high speed an endanger to human life and lost control over the
vehicle and dashed to deceased motor cycle bearing No: AP37BT4590 in
opposite direction. In which the deceased and is pillion rider of crime vehicle
also fell down from motor cycle on the road and received injuries to the head.
The Lws-3, 6 and 7 informed the incident to the Lw-2, immediately the Lw-2
reached said place and injury persons shift to Hospital for treatment on the
way the deceased died and Lw-1 nephew has been received injures and
shifted to Jagruthi Orthopedic Surgeon Hospital Bhadrachalam for treatment.
I will shortly collect the PME report from the medical officer and finalize the
case.

Today I have resumed further investigation into this case. During the
course of investigation examined the Lw-12 and recorded his statement in
part II CDs and obtained the wound certificate from Jagruthi Orthopedic
Hospital, in his opinioned the injury is Grievous in nature, as per the wound
certificate altered the section of law from 304(A), 337 IPC to 304(A), 338 IPC.

Inspector Bhadrachalam came to Police station and Inspected the crime
vehicle Car bearing No: TS28C1112 and verified all the related documents
of the crime vehicle and opined that an accident was not due to any
mechanical defect of the vehicle involved in the accident and all the
vehicle documents were up to date and issued an accident cause report in a
prescribed format and also issued released order of the crime vehicle, the
PME report yet to be received from the medical officer.

duty constable and given an instruction to bring the PME report of the
deceased from the Govt. Area Hospital, Bhadrachalam. Accordingly, said PC
went to Govt. Area Hospital Bhadrachalam and obtained the same from
medical officer and same was produced before to me. In this report, the
Medical officer opined that the cause of death of the deceased is due to
“Head injury due to Road Traffic accident leading to cardio palmary
arrest, as early as possible I will file the Form-54 and same will be filed
before the concerns and finalize the case.
