DOCUMENTARY REQUIREMENTS FOR LAND USE CONVERSION


SPECIAL PROJECT UNDERTAKING

Landowners who would like to apply for Conversion under Section 11.12 of DAR
Administrative Order No. 03, Series of 2021 shall only be required to present the following
ORIGINAL documents in their application with three (3) additional photocopies, to wit:

1. Official receipt showing proof of payment of filing fee and inspection cost bond in
accordance with the terms and conditions set forth in Section 2 of DAR A.O. No. 03,
Series of 2021 to accomplished upon submission of the COMPLETE documents and
the acceptance thereof by the Land Use Cases Division of the concerned DAR
Regional Office;

2. Duly accomplished application for conversion (LUC Form No. 1) for Special Project
Undertakings which are Critically Important subscribed and sworn to before a notary
public or any person authorized to administer oaths;

3. An electronic copy (e-copy) of the Original Certificate of Title (OCT) or Transfer


Certificate of Title (TCT) of the subject land, as provided under Section 6 of DAR A.O.
No. 1, Series of 2019;

4.
a. Proof of financial and organizational capability of the applicant to under the
Special Project Undertaking which are Critically Important duly signed by a
certified public accountant;

b. Project Feasibility Study as provided under paragraph 10.7 of DAR A.O. No. 1,
Series of 2002 duly signed by a certified land use planner; and

c. Statement of Project Cost and potential funding source(s) for the development of
the proposed project as provided under paragraph 10.10.1 of DAR A.O. No. 1,
Series of 2002 duly signed by a certified land use planner;

5. Socio-Economic Benefit-Cost Study of the proposed project under paragraph 10.11 of


DAR A.O. No. 1, Series of 2002 duly signed by a certified land use planner;

6. Affidavit of Undertaking (LUC Form No. 2) committing to comply the required


statements as provided under paragraph 10.13 of DAR A.O. No. 1, Series of 2002
subscribed and sworn to before a notary public or any person authorized to
administer oaths;

7. Development Plan duly signed by a certified land use planner; and

8. Posting of the applicant-landowner in a conspicuous place(s) within the subject


property, a public notice contained in a billboard made of strong weather-resistant
material such as plywood, galvanized iron, tin, panaflex, or other similar durable
material, measuring 1.22 meters by 2.44 meters (4 feet by 8 feet). If the landholding
has an area of more than twenty (20) hectares, the applicant shall erect one (1)
billboard for every twenty (20) hectares, on strategic and visible points in the
landholding, preferably along a road. The billboard shall be written in the local dialect
and shall display all the information as required under Section 11 of DAR A.O. No. 1,
Series of 2002.

9. Certification issued by the Bureau of Internal Revenue for the latest Zonal Values of
the barangay over which the applied landholding is located.

Hereinafter provided are the additional specific requirements for Special Project
Undertakings as provided under Section 3 of DAR A.O. 03-A, Series of 2021, to wit:
1. A conversion application for an ENERGY PROJECT (I.E., POWER GENERATION,
TRANSMISSION, OR DISTRIBUTION) shall be certified by the Department of
Energy if it is the proponent agency, or the National Electrification Administration if it
is the proponent agency, or the local government unit involved in the project, or by
the agency which is the proponent of the project, that it is a priority energy project
based on Section 1 of these Rules;

2. A conversion application for SOCIALIZED HOUSING PROJECTS AS DEFINED


UNDER DAR A.O. NO. 1, SERIES OF 2002 which include, but is not limited to, i.e.
those which are undertaken by government entities; or subsidized housing or housing
programs of National Housing Authority (NHA), or by the Local Government Units
(LUs), or by a private entity which complies with the low-cost housing standards of
the NHA as determined by the Socialized Housing Finance Corporation (SHFC); or
those which are under the coverage of the National Home Mortgage Finance
Corporation and such other similar projects shall be certified by the Department of
Human Settlements and Urban Development (DHSUD) if it is the proponent agency,
or the NHA if it is the proponent agency, or the local government unit involved in the
project, or by the agency which is the proponent of the project, that it is a priority
housing project base on Section 1 of these Rules;

3. A conversion application for TELECOMMUNICATION SITE OR AREAS AS DEFINED


UNDER SECTION 3(A) OF R.A. NO. 7925 OR THE PUBLIC
TELECOMMUNICATIONS POLICY ACT OF THE PHILIPPINES shall be certified by
the National Telecommunication Commission if it is the proponent agency, or the
Department of Information and Communications Technology if it is the proponent
agency, or the local government unit involved in the project, or by the agency which
is the proponent of the project, that it is a priority telecommunication project based
on Section 1 of these Rules;

4. A conversion application for WATER-RELATED PROJECTS IN ACCORDANCE WITH


THE STATE POLICIES UNDER SECTION 1 OF R.A. NO. 6234 (MWSS
CERTIFICATION) OR INFRASTRUCTURE FLAGSHIP PROJECTS AS PROVIDED ON
WATER SECURITY UNDER ADMINISTRATIVE ORDER NO. 32 OF THE OFFICE OF
THE PRESIDENT (O.P.) WHICH WAS PASSED ON 26 AUGUST 2020 AND SUCH
OTHER SIMILAR PROJECTS shall be certified by the Metropolitan Waterworks and
Sewerage System if it is the proponent agency, or the Local Water Utilities
Administration if it is the proponent agency, or the local government unit involved in
the project, or by the agency which is the proponent of the project, that is a priority
water based on Section 1 of these Rules;

5. A conversion application for RESETTLEMENT OR RELOCATION SITES FOR


DISASTER-STRICKEN AREAS FOR DISPLACED INFORMAL SETTLERS shall be
certified by the National Disaster Risk Reduction and Management Council (NDRRMC)
if it is the proponent agency, or the local government unit involved in the project, or
by the agency which is the proponent of the project, that it is a priority resettlement
or relocation project based on Section 1 of these Rules;

6. A conversion application for THE USE OF AGRICULTURAL LANDS ACQUIRED


UNDER R.A. NO. 10752 (RIGHT OF WAY ACT OF 2015) AS SITE FOR NATIONAL
GOVERNMENT INFRASTRUCTURE PROJECTS shall be certified by the proponent
agency (i.e. DWH, DOTr, NIA, etc.) or the local government unit involved in the project
that it is a priority infrastructure project based on Section 1 of these Rules;

7. A conversion application for AN AGRO-INDUSTRY (AGRO-INDUSTRIAL) PROJECT


shall no longer require any certification from the Department of Agriculture or any
agency. It is sufficient that the local government unit, if any, which is involved in the
project shall certify that it is a priority project based on Section 1 of these Rules. In
the absence of any participating local government unit, the DAR shall evaluate the
merits of the application and make the determination.

Filing Fee: P2,000.00


Inspection Cost: P10,000.00
Cash Bond upon approval of application: Latest BIR Zonal Value x Area (sq. m.) x 2.5%
