COUNTER- AFFIDAVIT
I, DANIEL KRISEL H. CRUZ, of legal age, Filipino, and a resident of Barangay Libsong
West, Lingayen, Pangasinan, after being duly sworn to in accordance with law, do hereby depose
and state that:
1. I am the respondent in the complaint for homicide filed by PCpl Eleanor S. Paltep,
dated October 6, 2024.
2. I resolutely deny the allegations contained in the complaint and assert that I am innocent
of the crime charged.
3. On October 4, 2024, at around 6:00 PM, I was indeed at my residence in Barangay
Libsong West when Armenda Labasan, my neighbor, approached my property and began
shouting insults and threats towards me. She accused me of trespassing on her property
and damaging her plants, which were false accusations.
4. For months, Armenda Labasan had been harassing me and my family with constant noise
disturbances and unfounded accusations. Despite attempts to resolve these issues
amicably through barangay mediation, she continued to escalate the situation.
5. On the evening of the incident, Armenda Labasan, in a fit of rage, charged towards me
with a large kitchen knife. I was in fear for my life and acted in self-defense. I did not
intentionally stab her, but I was forced to defend myself against her violent attack.
6. I admit that I was holding a kitchen knife, I snatched it from Armenda's hands and used it
for self-defense. However, she forced herself to grasp the kitchen knife, and as a result, it
got stabbed in her.
7. I am deeply saddened by the tragic outcome of the incident. However, I maintain that I
acted in self-defense and did not intend to cause Armenda Labasan's death.
8. I respectfully request that this Honorable Court consider the facts of the case and dismiss
the complaint against me.
