LEGAL NOTICE
Dear Sir/Madam,
Under instructions and on behalf of my client, Mr. Ajay Shetty (hereinafter
referred to as “the Plaintiff”), I hereby serve you with this Legal Notice
regarding the disputed property, an ancestral house situated at HSR Layout,
Bangalore, measuring approximately 500 square yards, including a two-story
house and an adjoining garden area (hereinafter referred to as “the Property”).
The facts pertinent to the case are as follows:
1. The Property was inherited by all legal heirs of Late Mr. Ramesh Shetty,
who passed away intestate in the year 2017.
2. The legal heirs include:
o Mrs. Lalitha Shetty (wife of Late Mr. Ramesh Shetty)
o Mr. Ajay Shetty (elder son of Late Mr. Ramesh Shetty)
o Ms. Kokila Shetty (daughter of Late Mr. Ramesh Shetty)
o Mr. Rohit Shetty (younger son of Late Mr. Ramesh Shetty)
3. Being an ancestral property, all legal heirs have equal and undivided
rights in the Property as per Hindu Succession Act, 1956.
4. Despite several discussions held in 2021 and 2023 to resolve the matter
amicably, you have:
o Refused to acknowledge the co-ownership rights of the Plaintiff.
o Alleged that the Plaintiff is attempting to sell the Property without
your consent.
5. My client categorically denies any attempt to sell the Property unilaterally
and states that such baseless allegations have caused him mental agony
and distress.
In light of the above, my client demands the following:
1. Recognition of Co-Ownership Rights: You are to acknowledge and affirm
the equal and undivided rights of the Plaintiff in the Property.
2. Partition of Property: You are called upon to cooperate with the Plaintiff
for an amicable division of the Property, failing which the Plaintiff shall
be constrained to approach the appropriate court of law for partition.
3. Cease and Desist: You are instructed to refrain from making defamatory
or baseless allegations against the Plaintiff.
You are hereby required to respond to this Notice within 15 days from the
receipt hereof. Failure to comply will leave my client with no option but to
initiate appropriate legal proceedings against you for partition, declaration of
co-ownership, and any other reliefs available under the law, entirely at your cost
and risk.
I trust you will treat this Notice with the urgency and seriousness it deserves.
