PETITION FOR DIVORCE
The humble Petition of CLIFF LULE of C/o KIYN Advocates, Plot 75, Bukoto
Street, Kamwokya, P.O. BOX 75545, Clock-Tower, Kampala showeth:
1. That the Petitioner is a male adult Ugandan of sound mind, a resident of
Kisaasi, Nakawa Division, Kampala District.
2. That the Respondent is a female adult Ugandan believed to be of sound
mind and my advocates undertake to effect court process on her.
3. That the Petitioner and Respondent are Ugandans domiciled in Uganda.
4. That both the Petitioner and the Respondent profess the Christian faith.
5. That the Petitioner customarily got married to the Respondent on the 2 nd
day of January, 2016 in accordance with the Customs and Traditions of
Tooro and the marriage was solemnized under the laws of Uganda. (A copy
of the marriage certificate is attached hereto and marked as
annexure A).
6. During the subsistence of the marriage, the Petitioner and Respondent were
blessed with two (2) issues; Lule Nara Crystal and Najjemba Manuella Carla
Lule. (Copies of their birth certificates are attached hereto and
marked as annexures B and C respectively).
7. That the Petitioner brings this petition on the grounds of cruelty and
desertion by the Respondent.
8. Particulars of desertion
a) That for the past 3 years, the Respondent has deliberately refused to
sleep in the same room as the Petitioner.
9. Particulars of cruelty
a) That the Respondent has been cruel to the Petitioner by denying him
conjugal rights as a result the Petitioner has suffered mentally and
psychologically.
10. That their marriage has irretrievably broken down and the Petitioner
finds it impossible to continue in the marital relationship with the
Respondent.
11. That this petition is not prosecuted in collusion or connivance with the
Respondent or any person connected in any way to the proceedings.
12. Your humble Petitioner states that this Honorable court has
jurisdiction to hear and determine this petition.
WHEREFORE your Petitioner humbly prays this Honourable Court for orders that:-
a) The marriage to the Respondent be dissolved by this court and a decree
nisi be granted.
b) That joint custody of the issues of the marriage be granted to the
Petitioner and Respondent
c) Any other remedy that this court may deem fit.

SUMMARY OF EVIDENCE
The Petitioner shall adduce evidence to prove that the Respondent deserted the
Petitioner. The Petitioner shall also prove that the marriage has irretrievably
broken down with no possibility of reconciliation. The Petitioner shall further
adduce evidence to the effect that dissolution of the marriage is in the best
interest of the parties.
