Herein referred to as the MORTGAGEE.

(Whereas, the term Mortgagors and Mortgagee, unless repugnant to the context shall mean
and include their representatives’ heirs, successors, executors, administrators, trustees, legal
representatives and assigns) Whereas the Mortgagor is the absolute owner of All that piece
and parcel of residential converted ImmovableI Property bearing Property
No.154/1(Grama Panchayath Dhakale), PID No-152100200900300685, situated at
Dunddahalli Village, Mallinakuppe Grama Panchayath, Athuguru Hobli, Maddur Taluk,
Mandya District, measuring East to West. 9.7536 mtrs and North to South: 12.192 mtrs
in all measuring 118.9 Sq. meters, and bounded on the: Since then, Mortgagor is in
peaceful possession and enjoyment of the schedule property and paying taxes and levies
thereon, as absolute owner thereof and holding the Title doc’s and documents pertaining to the
SCHEDULE ‘A’ PROPERTY, which are briefly described in the SCHEDULE here under and herein
after referred to as the SCHEDULE ‘B’ PROPERTY.

Whereas, the Mortgagor is the absolute owner of the schedule property, who has acquired the
same through 23.11.2023 Gift Deed executed by Smt. Sanamma in favour ofhis son Sri.
GoPala, registere 07703-2023-24, Book-I, registered In Maddur SubRegistrar office, in
respect of Property No' 154/1, measuring 118.9 Sq. meters, situated at Dunddahalli
Village, Mallinakuppe Grama Panchayath,Hobli Athuguru Maddur Taluk, MandYa
District d as Doc No. MDR-1-.07703-2023-24, Book-I, registered In Maddur SubRegistrar
office, in respect of Property No' 154/1, measuring 118.9 Sq. meters, situated at
Dunddahalli Village, Mallinakuppe Grama Panchayath, Athuguru Maddur Taluk,
MandYa District

Whereas Mortgagors needing money for the purpose of personal and family necessities, the
Mortgagors requested the Mortgagee to lend him a total sum of Rs.5,14,500/- hereinafter
referred to as the Rs.5,14,500/-, which the Mortgagee has agreed to do on the Mortgagor
executing this equitable mortgage by deposit of title deeds with a view to secure the
repayment thereof with interest as herein after provided.
The Mortgagors hereby covenants with the Mortgagee that the Mortgagor will repay to the
Mortgagee the total loan amount on the monthly installment basis of Rs.12,240/- on every 7th
day of English calendar month (herein after referred to as the ‘due date’) which includes
interest on the loan amount hereinafter referred to as the “equated monthly installment (EMI)”
loan amount at the rate of 15.00%However, the interest rate is Fixed.

And therefore, the total loan amount of Rs.5,14,500/- , ” lent and advanced by the Mortgagee
to the Mortgagor on the execution of these presents and the receipt whereof the Mortgagor
hereby admits.

The Mortgagors further covenants with the Mortgagee that in the event of the Mortgagor
failing to pay any ‘EMI’, he will be liable to pay additional interest on the said ‘EMI’ in default at
the rate of 4.5% per month on the arrears of ‘EMI’ by way of compound interest.

Without prejudice to the right of the Mortgagee to take any action on default as herein under
provided, and it is agreed and declared that in the event of Mortgagor committing default in
payment of any installment of interest or committing breach of any other term of this deed, the
whole amount of principal then due with interest thereon will at the option of the Mortgagee
become payable forthwith as if the said date had expired.

And this deed further witnessed that in consideration aforesaid, the Mortgagor hereby created
Equitable mortgage by way of Deposit of Title Deeds pertaining to the SCHEDULE ‘A’
PROPERTY described hereunder written as a security for repayment of the loan amount with
interest and all other moneys due and payable hereunder with a condition that on the
Mortgagor repaying the said Rs.5,14,500/-

And therefore, the total loan amount of Rs.5,14,500/- ,,” lent and advanced by the Mortgagee
to the Mortgagor on the execution of these presents and the receipt whereof the Mortgagor
hereby admits.

” with all interest and other moneys due to the Mortgagee (hereinafter referred to as the
Mortgage amount) the Mortgagee will release the SCHEDULE B title deeds pertaining to the
SCHEDULE A PROPERTY from equitable mortgage and shall if so required by the Mortgagor
execute a deed of release but at the costs of the Mortgagor after receiving the preclosure
penalty as per loan agreement on the outstanding principle amount.
And it is further agreed and declared by the Mortgagor that in the event of the Mortgagor
failing to pay the said principal sum with all interest and other moneys when the same shall
become due and payable under these presents.

And it is further agreed and declared by the Mortgagor that, he/she shall also be liable to pay
all the costs, charges, and expenses that the Mortgagee will incur for the protection of the
mortgage security and or for the realization of the Rs.5,14,500/- ,, And therefore, the total
loan amount of Rs.5,14,500/- ” lent and advanced by the Mortgagee to the Mortgagor on the
execution of these presents and the receipt whereof the Mortgagor hereby admits.

” and the same shall be deemed to form part of the Rs.5,14,500/- ,, ” and the security
therefore as aforesaid and agree to pay all the necessary charges costs fines and fees which
would fall due in the event of change in the rules of RBI or change in the company’s policy.

And it is further agreed that, during the pendency of the security hereby created and until
repayment of the Rs.5,14,500/- ” Mortgagor will get insured and keep insured the building
and structures standing on the said land against loss and damages due to fire or any other
accident in the sum of at least Rs.5,14,500/- ” with some Insurance

Company of repute and pay all premium on the insurance policy as and when it becomes due
and payable in respect thereof to such company and shall hand over the policy to the
Mortgagee duly endorsed in his name as assignee and in the event of the Mortgagor failing to
do so or to pay the premium, the Mortgagee will be entitled to insure the said buildings and
structures and/or to pay the premium thereon and the amount paid by the Mortgagee in
respect thereof will be deemed to form part of the Rs.5,14,500/- , ”

And it is further agreed that in the event of the said SCHEDULE PROPERTY being destroyed or
damaged by fire or any accident as aforesaid. The Mortgagee will be entitled to receive the
insurance claim under such policy to the exclusion of the Mortgagor and to appropriate the
same first towards all arrears of interest and then the principal amount or as any part thereof
as may be sufficient to pay the mortgage amount due and if any surplus remains the same only
will become payable to [Link] Mortgagor herein admit and agree all the contents of
the Home equity agreement which he/she has signed along with this Memorandum of Deposit
of Title Deed to be part and parcel of this deed. Charge created over Schedule B Property only.

Mallinakuppe Grama Panchayath, Athuguru Hobli, Maddur Taluk, Mandya District, measuring
East to West. 9.7536 mtrs and North to South: 12.192 mtrs in all measuring 118.9 Sq. meters,
and bounded on the:
