Dear Sir,

I hope this letter inds you in good health and high spirits. We are writing to formally notify
you of the commencement of arbitration proceedings in reference to a dispute with Uber
Stitch, represented by Mr. Vipul Gupta and Mrs. Nimisha Gupta, regarding the delayed
payment under Chapter V & Section 18 of the MSMED Act 2006. This dispute arises from work
at Plot No. 637, Sanand GIDC-II, Sanand, Ahmedabad.

The payment dispute irst came to our attention on 13th January 2023, coinciding with the
auspicious day of Uttaryan. Despite our best efforts to resolve this matter amicably, it
remained unresolved. Consequently, we sought the intervention of the Micro and Small
Enterprises Facilitation Council (MSEFC) on 18th February 2023.

MSEFC, in response, issued a notice to Uber Stitch bearing reference number MSME-D/
MSEFC/DP-4462/1382/23 dated 1st April 2023, indicating an outstanding amount of Rs.
68,45,612/-. Subsequently, our irst conciliation meeting was scheduled for 26th July 2023.
However, Uber Stitch opted to approach the High Court on 21st July 2023, seeking an
adjournment in the aforementioned case.

To our disappointment, no hearings have taken place in the High Court since that time. The
High Court has communicated the following adjournment dates:
• 24th July 2023
• 7th August 2023
• 2nd September 2023
• 3rd October 2023

Furthermore, on the 3rd of October 2023, a new date, i.e., 11th December 2023, has been
scheduled, prolonging this unresolved matter.

In light of the persistent delays and the apparent unwillingness of Uber Stitch to ful ill their
payment obligations, we kindly request your immediate intervention to initiate arbitration

proceedings. It is evident that Uber Stitch is exploiting these delays to avoid making the
required payment.

In addition to the inancial impact of this delay, we would like to highlight that we have
incurred bank interest expenses due to the overdraft facility we have availed of for our
business. These inancial burdens further underscore the urgency of resolving this matter
promptly.

We believe that arbitration is the most expedient and equitable means of resolving this
dispute and securing the payment that is rightfully owed to us. We trust that you will treat this
matter with the urgency and attention it deserves, ensuring a fair and just resolution.
