CIRCUMSTANCE OF THE REFERRAL

Rafael, 16 years old, a Child in Conflict with the Law has allegedly
committed an offense of Direct Assault and Robbery which situated at Tubod,
Carmen, Davao del Norte on January 29, 2021. He was apprehended
through Inquest proceedings by PNP-Carmen. Meanwhile, the Chief of Police
of Carmen was directed to immediately transfer the custody of the latter to
Bahay Pag-asa, New Corella, Davao del Norte while the case is pending for
trial as ordered by the Executive Judge of RTC branch 4, Panabo City; HON.
JUDGE DOROTHY P. MONTEJO-GONZAGA, dated February 1, 2021.

PROBLEM PRESENTED

Rafael, was 16 years old when he allegedly committed an offense of


Direct assault and Robbery. Considering his minority, he was referred to
Bahay Pag-asa, New Corella of Davao del Norte for rehabilitation and
pending case proceedings.

HISTORY OF THE PROBLEM

On January 29, 2021 at around 9:00 o’clock in the evening, Rafael


together with his friends were having a Rugby sniffing session near their
house at Purok 5A-2 barangay tubod, Carmen, Davao del Norte. While
having fun, they decided to rob a sari-sari store near them to take cigarettes
and other things, and when someone saw them Rafael punched and kicked
him. Other resident of the said barangay saw what happened and
immediately called the police to report the incident. Hence, a complaint was
filed at the Police Station of Carmen, Davao del Norte and later endorsed to
the MSWDO since Rafael is a minor.

BACKGROUND INFORMATION

A. Client’s Information or Psychosocial History

Rafael is the 3rd child of Hermie Gonzales and Lailane Gonzales. He is


fondly called as “Raf2x” in their community. He was enrolled as a grade 6
student at Tubod Elementary school. Due to his age, he was bullied at school
since he is the oldest among the students of his class and decided to always
skip classes and went to his friends to do their vices. He got exposed to
peers that are Out of School Youth, wherein he learned to sniff rugby, smoke
cigarettes, drinking alcoholic beverages and do gambling. According to him,
he tried to do these just to fit in with the group and to forget his unfortunate
life experiences in school and at home.
In line with the alleged offense, he is aware that what he did is wrong and
knows the possible consequences of his action. He really blamed his family
for the unfortunate happenings in his life and don’t know what else to do to
change it since he is full of anger and sorrow.

B. Family Information

Mr. Hermie and Miss Lailane are the parents of the minor. They were
blessed with three Children and are all boys. Mr. Hermie works as a laborer
at a small Banana Plantation near their house and he earns Three thousand
pesos (3,000) per month, while Mrs. Lailane is a plain housewife. When
Rafael was 10 years old, his parents got separated. He got so sad wherein
according to him it was his 10 th birthday when his parents had a conflict and
decided to separate. Currently, his biological mom had a relationship with
another man and his father also had a relationship with another woman. They
are renting a boarding house located at Purok 5A-2, Tubod, Carmen, Davao
del Norte, and his father is paying it monthly worth 500 pesos. His step-
mother lives together with them. Based on the description of the minor, their
boarding house is small and is just enough for them. They have electricity but
they don’t have television and a refrigerator. Rafael has no contact to his
biological mother and he doesn’t care for he was used to living a life without
feeling the love and care from the latter.

Mr. Hermie is always drunk and go home very late at night while his step-
mother always got angry towards the minor without any valid reasons. Due to
the situation of their family, Rafael always chose to go outside together with
his peers and sometimes he don’t want to go home for how many days to feel
relaxed and belong.

C. Community Information

The minor is a resident of Purok 5A-2, Tubod, Carmen, Davao del Norte
where gang groups and out-of-school youth are rampant. However, the
community is abundant with resources such as Police Station, Schools, Brgy.
Hall, Municipal Hall, Hospitals, Health center, Church, Wet and Dry market,
Internet Café, Transportation terminal, merchandise. In protecting the
children, there is a presence of Barangay Council on the Protection of
Children; Municipal Social Welfare and Development Office of Carmen, as
well as curfew to the minors is well-implemented in the community.

ASSESSMENT

This is the case of RAFAEL GONZALES, who is now 17 years old, a


Child in conflict with the law, who was allegedly accused of the offense of
Direct Assault and Robbery.
Minor is a product of a broken family. He grew up without experiencing
love and care from his mother and with lack of Proper guidance. As he was
growing up, he once had a complete family but he didn’t feel the presence of
his parents. His father got so busy at work and to his vices and his biological
mother shows no support towards them. Whenever his parents are at home,
they’re quarelling most of the time and he always hears and sees it. The
moment also when his parents got separated on his birthday, made a
negative impact towards the minor for he felt more unimportant for his
parents cannot even manage to fix their problem and even decided to get
separated on the time of his birthday. As far as he remembers, he just cried
and cried and experienced sadness but there is no one that he can talk with
to share his feelings and emotions. Hence, he grew up carrying problems and
worries and kept it personally. That was one of the reasons why he felt
distress. His father and his step-mother don’t have good relationship towards
him. His eldest brother is also busy working to suffice his personal needs
while his second sibling stays at the house of their neighbor for it is more
comfortable there. With this, they don’t have time to bond and share their
feelings.
Rafael is an introvert type of individual, according to Carl Jung introverts
whose interest is generally directed inward toward his own feelings and
thoughts. The typical introvert is shy, contemplative, and reserved and tends
to have difficulty adjusting to social situations. Rafael doesn’t talk that much
but he can easily get along with other people especially when it has the same
interest with him. When he was schooling, he experienced being bullied for
he is the eldest among the class since his age is inappropriate with his Grade
level. Some people tells him that he is stupid, and it resulted for him to have a
low self-esteem.
Ideally, the parents should be there towards the developmental stage of
their child. For if the child is properly guided, he will be a developed
individual. According to Erik Erickson in his 8 Stages of Human Development,
in the fifth psychosocial stage which is centered on identity versus role
confusion. At this point in development, the formation of a personal
identity becomes critical. During adolescence, teens explore different
behaviors, roles, and identities. Erikson believed that this stage was
particularly crucial and that forging a strong identity serves as a basis for
finding future direction in life. Further, family and home should be the place
for a person to feel belongingness and comfort but what happened is that he
founds no comfort within his own family. Hence, he got a wrong choice of
peers and that resulted for him to do some things that is wrong. Further,
Sigmund Freud in his Developmental Theories believed that many mental
illnesses are a result of a person’s inability to accept reality. Freud
emphasized the importance of early childhood experiences in shaping our
personality and behavior. In our natural state, we are biological beings. We
are driven primarily by instincts. During childhood, however, we begin to
become social beings as we learn how to manage our instincts and transform
them into socially acceptable behaviors. The type of parenting the child
receives has a very powerful impact on the child’s personality development.
Through the behaviors manifested by Rafael it is observable that he uses
some Defense Mechanisms to distort his reality so that the truth is less
painful, such as Displacement where he divert his frustrations and anger
towards his family and life as a whole through doing his vices or doing
physical harm to others, which he thought his frustrations can be forgotten or
dealt with. In addition, as per the Social Learning Theory of Albert Bandura,
Rafael thought that his vices and other hobbies are all helpful and acceptable
in their community since he was exposed to the wrong doings of his peers
and also within the family. That although he knows the effect of sniffing rugby
and other vices, he tends to do it since in doing that thing, he felt
belongingness with his peers and he feels that he cannot think of problems
and worries whenever he gets high.
Minor is aware that what he did is wrong. Currently, he doesn’t have a
strong support system and he don’t want to trust others in helping him since
he always points out that his life is always like that and he don’t have high
hopes for his future.

RECOMMENDATION:

 The minor must follow the rules and policies of the center

community

Psychological intervention in order for them to release their thoughts
and feelings as well as to know their skills and other capabilities.
