Appointment letter

Fixed Term Contract of Employment

A)
1. This contract is made between BERGER INDIA and Samrat Chatterjee (OCAMC0001) (“staff”).

The staff is engaged by OCAPL to perform specific fixed term work assignments (“Assignment”) for OCAPL customers
(“Customer”) under the terms and conditions of this Agreement and the Schedule A attached hereto for each new
Assignment.

2. The Contract Synopsis

(a) This agreement along with Schedule 1 represents a fixed term contract of service between

OCAPL and the staff. OCAPL & the staff shall complete and sign Schedule 1

(b) The staff is expected to complete the Assignment abiding by the rules & regulations once accepted.

(c) No alteration of these Terms will be granted unless approved by OCAPL in writing.

(d) Here Fixed Term Contract of Service only means Temporary Service.

3. It is clearly agreed by the staff that it is the nature of contract work that there may be periods when no suitable
work is available and agrees that:

(a)OCAPL only have the power to determine the suitability of the work.

4. OCAPL shall pay the staff remuneration which is prior calculated at an agreed rate for each working period
during an Assignment, to be paid or monthly. OCAPL has the right to deduct for the purpose of Provident Fund
and any other statutory deductions.
Apart from this OCAPL is entitled at any time to deduct from the staff’s remuneration in respect of sums due
from the staff to OCAPL & any over payment of any kind or any other debt

5. Employee would not be entitled for any Wages or Leave during the period he/she not assigned.

6. Though the Temp Staff is not bound to accept any assignment offered by OCAPL but if accepted he/ she is agreed to

(a) Co-operate always with Customer’s staff and always obey the supervision & leader ship of the authorized
person of Customer during assignment

(b) Abide by the rules and regulations of the Customer’s establishment (e) Not to claim any compensation or to
receive any payments of any nature whatsoever from the customer due to the Assignment, unless expressly
consented to by OCAPL.

(c) It is confirmed that your contract of employment shall be valid for a fixed period from 01-10-2023 to till you
resign.

At the end of the contract period the Company may, at its sole discretion renew the contract at revised terms &
conditions, subject to your acceptance of those revised terms of contracts.

ii. During the period of fixed contract, your services will be deputed at the sole discretion of the Management to
any of our clients’ company to do work pertaining to or incidental to the client’s business.

Currently you are being deputed with our client Management and Computer Consultants to support their
products in the field & would be stationed at DLF-2, NEWTOWN, KOLKATA You would be reporting to the
assigned manager of our client company & would take all instruction from him/her.
iii. Details of your salary and applicable benefits with break up are as below;

v. You will be eligible for any specific performance based incentives as may be announced by the client
company time to time, as per their terms & conditions. However the decision to award the same will be sole discretion
of the client company’s managers.

vi. Your leave Policy will decided by Management and Computer Consultants &

vii. You will be required to open a salary account which will be provided by OCAPL with bank & all your salaries & expenses
would be directly credited to that specific account. We will not be able to make any cash payments.

viii. During the course of your contract, you will be required to keep strictly confidential all information; documents
and other material obtained in the course of your contract with the Company or while working with its client, and
shall return all such information that may be in your possession to the Company on your separation.

Working Days & Hrs.

Monday to Saturday.

Working hrs.will be 9 hours including lunch and tea recess of 1 hour. Office timing will be 9:30 a.m. to
6:30 p.m
During work pressure you may have to work on Sundays or extra hours.

ix. You will be entitled to all other statutory benefits wherever applicable during the fixed period of contract.
x. Your income would be subjected to prevailing Income tax rules & other Act as applicable appropriate
deductions would be made by the company as required by law.

xi. This contract shall be terminable by either party giving 30 days’ notice in writing or salary in lieu of notice,
to the other.
