Pre-Bid EMD has to be paid to MSTC using "Pay Pre-Bid EMD" Link and MSTC Service Charge has to be paid to MSTC Vadodara using
"e-Payment" Link in Buyer Login vide NEFT / RTGS only. Any payment made other than mode mentioned above shall be refunded to
the Buyer & they shall be have to resubmit payment as mentioned above. LPC applicable due to wrong payment mode shall be
responsibility of the Buyer.
1) The bidders shall submit Earnest Money Deposit(EMD) through NEFT/RTGS within 7 days of e-Auction/acceptance of STA bid by
Seller for SOLD lot. Upon issue of the sale order the EMD will be converted into Security deposit and shall be adjusted in the final
payment. Incase of non fulfilment of the contractual obligation, the security deposit will be liable to be forfeited by Seller/MSTC.
2) In case EMD has not been submitted within 7 days, the buyer has the option to submit full payment for the sold lots within 17 days
(i.e. 7 days for EMD and 10 days for balance payment) counted as mentioned from the close of ea or STA approval date. In case only
EMD payment is received after 7 days but before 17 days, Sale Order shall not be issued and the amount shall be withheld with MSTC
till 17 days pending receipt of balance payment. In case balance payment is not received within the stipulated payment period, the
EMD amount shall be refunded to the buyer and the buyers login will remained deactivated for a further period of 6 months as per rule.
3) Pre-Bid EMD amount shall be converted automatically to SD after issuance of AL/Sale Order in case it is greater than or equal to the
EMD amount. In case no balance EMD is received within 7 days AL would not be issued. Payment can be received within 17 days
counted as above, failing which MSTC shall not accept the payment with or without penalty and such amount received after 17 days
shall be refunded to the buyer. The buyers Login shall remain deactivated for minimum period of 6 months and reactivation procedure
shall be as per GTC / BSTC . In case of lots with Pre Bid EMD, the Pre Bid EMD shall be forwarded to the seller for forfeiture and the
buyers login shall remain deactivated till confirmation of forfeiture by the Seller.
4) LATE PAYMENT PENALTY(ONLY FOR LOTS WHERE SDALE ORDER HAS BEEN ISSUED: If the payment is not made within the free
payment period mentioned in the Acceptance Letter/Sale Order, the payment may be accepted upto a period of 2 (two) weeks from the
due date of payment, on payment of late payment penalty @ 1% (plus GST@18%) per week on the total sale value. Acceptance of
payment beyond the late payment period of two weeks shall be at the sole discretion of Seller.
NEW METHOD OF PRE BID PAYMENT
Pre-Bid EMD must be paid by the bidder (NEFT/RTGS) using the "PAY PRE-BID EMD" link only. DO NOT PAY PRE-BID EMD BY "E-
PAYMENT" LINK OR DD/PO.
Refund to Bidder as per their online request will also be processed from MSTC, Head Office, Kolkata on the next working day using the
"EMD REFUND REQUEST" link which shall be active only between 6:00 a.m. to 12:05 p.m. one day after close of e-Auction.
This amount can be used as Pre-Bid EMD only & can not be used for any other purpose.
Pre Bid EMD paid through any other method shall subsequently be refunded without activating the bidder and the bidder shall not be
able to participate in e-A.
GST Clause
The Goods & Service Tax (GST) is implemented with effect from 01st July 2017 in India. Accordingly, VAT / Sales Tax will be
discontinued and these taxes will be subsumed to GST. GST will be payable on all goods (whether scrap or otherwise).
Hence all Buyers / Bidders having VAT Registration (TIN) need to register with GST for continuing transactions. Copy of certificate
mentioning GST Registration Number needs to be submitted with the respective office of MSTC Ltd. (from where Registration was
done) for updating Buyer Registration details. MSTC / Seller will not be able to issue any Sale Order / Delivery Order / Invoice, etc.
wherever GST Registration Number is not updated. Further the existing VAT / Sale Tax Rate shall be replaced by GST Rate and
differential tax, if any, will be paid by or refunded to Buyers.
In the same way, all Principals / Sellers need to submit copy of certificate referring GST Registration Number with the respective office
of MSTC Ltd. (from where Auction is conducted) for updating Seller Registration details. It will not be possible to conduct any Auction
or issue any Sale Order / Delivery Order, etc. wherever GST Registration Number is not updated. Further the Service Tax Rate on
Service Charge Bill, shall be replaced by GST Rate and differential tax, if any, will be required to be paid by Principals / Sellers.
INSPECTION SHALL BE DONE ON ALL WORKING DAYS DURING 10 A.M. TO 12:30 P.M. AND 2 P.M. TO 4:30 P.M. ONLY.
DELIVERY ORDER QUANTITY TOLERANCE SHOULD BE +20% IN CASE OF MEASURABLE ITEMS (NOT APPLICABLE FOR LOT WISE
ITEMS)
DD/PO DRAWN ON CO-OPERATIVE BANKS SHALL NOT BE ACCEPTED. NO ARRANGEMENT INSTRUMENT WHERE MORE THAN ONE
BANK IS INVOLVED WILL BE ACCEPTED.
a) After entering any Bid (in figures) on the Auction Floor, the Bidder must check/re-check, the same (including the number of zeroes)
before clicking the ~BID~ button. Once the ~BID~ button is clicked the Bid will be accepted by the system and no correction can be
made.
b) The Auction List and Special Terms & Conditions ( STC ) being displayed in the Auction Notification under View Forthcoming
Auctions on MSTC s e-Auction Website or being displayed in MSTCs Corporate Website ( www.mstcindia.co.in ) are tentative and
subject to last moment changes at MSTC s sole discretion till the start of e-Auction. Only the Auction List and Special Terms &
Conditions displayed on the Auction Floor under View Live Auctions ( and not under View Forthcoming Auctions ) on start of e-
Auction will be final and will form the basis for all sale contracts against this e-Auction and no representation / complaint in this regard
will be entertained by MSTC / Principal from the Bidders. Bidders should therefore download the Material List and Special Terms &
Conditions displayed only from the Auction Floor under View Live Auctions for their record purpose if required.
c) In addition to the Special Terms & Conditions ( STC ), the Buyer Specific Terms & Conditions ( BSTC ) will also form an integral part
of the Terms & Conditions of Sale through e-Auction. However, in case of any conflict between the two, the Special Terms &
Conditions shall prevail.
d) UNIT/UNIT OF MEASUREMENT ( UOM ) FOR BIDDING, SALE & DELIVERY: Each Lot will have to be bid, sold and delivered on the
basis of the Unit / Unit Of Measurement ( i.e. UOM ) stipulated in the Material List displayed on the Auction Floor of View Live Auctions
against the respective Lot. Any representation / complaint from the Bidders for the Bid to be made / having been made on the basis of
any other Unit/Unit of Measurement will not be entertained.
e) During Live Auction, only brief Lot / Item details will be shown under Lot Name on the Auction Floor where Bidders are required to
bid. The complete Item Details can be seen / accessed by the Bidders by clicking on the respective Item under Lot Name. It shall be the
responsibility of the Bidders to see the Items Details before bidding and no representation / complaint in this regard will be entertained
by MSTC / Principal from the Bidders.

1 MSTC Ltd. shall hereinafter be referred to as MSTC and the principal (owner of the stock) as mentioned above in the catalogue as
Seller .
2. All the offer shall be valied for a period of 04 (Four) Months from the date of closing of e-Auction, excluding the date of closing.
3. The materials offered for sale must be inspected as mentioned in the catalogue. For inspection bidders may contact the above-

4 . PAYMENT DETAILS: The successful bidders shall submit Earnest Money Deposit by Bank Draft in favour of as mentioned in the
Sale intimation Letter fired to your mail drawn on any nationalized/schedule bank within 7 days of confirmation of bid. The EMD must
be @25% of the net sale Value quoted (excluding taxes & and duties) Upon issue of the sale order the EMD shall automatically be
converted into Security Deposit. The Security Deposit as specified in Sale Order shall be adjusted only at the time of final payment.
4.1)In case of the lots under STA basis (subject to approval), the EMD would be 25% of the total quoted value (excluding taxes and
duties) by Bank Draft in favour of as mentioned in the Sale intimation Letter fired to your mail drawn on any nationalized/schedule
bank within 7 days of the STA bid. Balance of 75% payable on confirmation of the sale by (the principal)/MSTC.
4.2) The material value along with all the taxes and duties must be paid by the buyer in one installment within 10 days from the date of
issue of Sale Acceptance letter by MSTC and no installment payment will be allowed, unless otherwise stipulated in Lot / Item details.
4.3) DEFAULT IN PAYMENT: In case of default in payment of the balance Sale value within the prescribed time limits, the due payment
may be made together with additional charges @1% per week or part thereof calculated on the full 100% Sale Value for a minimum
period of one week or multiple thereof. The post bid EMD/SD will be adjusted towards material value only on receipt of the balance
Sale Value within the prescribed time. However, this shall not confer any right to the Bidder to make any late payment of balance Sale
Value or applicable duties and taxes and MSTC reserve the right not to accept the payment of the Balance Sale value with or without
the additional charges after the expiry of the free payment time.
4.4) INCOME TAX ON SCRAP @ 1.0 % IS TO BE COLLECTED ON THE SALE VALUE INCLUSIVE OF GST.
5.0) VALIDITY OF BIDS:
All Bids will be valid for acceptance by MSTC for a period of 04 (Four) Months from the date of closing of e-Auction, excluding the date

of closing. In case the last day of validity of bids falls on a holiday or remains closed for MSTC, such Bids will be deemed to be
automatically extended to be valid upto the next working day of MSTC.
6. All the materials are offered for sale on AS IS WHERE IS basis Ex-works Seller ,RATE MUST BE QUOTED ON UNIT BASIS FOR EACH
LOT SEPARATELY NOT PART THEREOF i.e.,in Rupees per Unit Only. The quantity indicated against the lot are purely indicative.
7. Rate must be quoted exclusive of GST as applicable will be charged.
8. Bidders shall submit his/their income tax clearance certificate (latest) partnership deed of org. as and when demanded by MSTC /
Seller.
9. The Bidders/customers workmen shall have to abide by the rules & regulation including safety & security regulation of the relevant
statutory Acts. Entry inside the works should only be against Gate pass for the men and equipment for which purchaser will have to
apply well in advance before lifting commences.
10. The Buyer will employ his own labour and means; at his own cost and risk for removal/collection/shifting of scrap as per schedules
and payment of wages/compensation to the labourers will be the sole responsibility of the buyer. The purchaser shall ensure that his
workmen do not loiter around within the stores area of the factory areas. They shall not touch any material except those material
shown to them. If any of his workmen is even found violating these restriction, the purchaser shall be responsible for making good the
loss to the Seller on which their decision shall be final and binding.
11. Delivery Period : Delivery Period will be 30 (Thirty) days counted from the date of issue of Delivery Order by MSTC as the case may
be (including the date of issue) in all cases.
11.1) In case of any Default in lifting of materials by the Buyer within the prescribed free time limit, the outstanding material may be
lifted within 14 (Fourteen) Days from the due date subject to payment of Ground Rent by the Buyer directly to the PRINCIPAL for the
period of delay. In case of Defence Depots/Units under Ministry of Defence and Ordnance Factories, the Ground Rent will be payable
@ 2% per day and in case of all other PRINCIPALS the Ground Rent will be payable @ 1% per week or part thereof. All matters relating
to charging of Ground Rate will be decided by the PRINCIPAL.
11.2) In case of Goods sold on Lot Basis, the Ground Rent will be calculated on the value of the entire Lot even if lifted in part, where
as in case of Goods sold on Unit Weight or Unit Number Basis, the Ground Rent will be calculated on the value of unlifted quantity.
11.3) However it must be noted by the Bidders that it will be the sole discretion of the PRINCIPAL not to allow the Buyer to lift the
Goods with or without the Ground Rent after the expiry of the stipulated free Delivery period or even within the aforesaid additional
period of 14 (Fourteen) Days and in such event, the sale of the material not lifted by the Buyer(s) will be automatically cancelled and
S/D amount equivalent to SD of the lot will be automatically forfeited. The buyer shall have no right to claim whtsoever on the materials
remaining unlifted.

12.0. ) PERIOD OF CONTRACT: Upto the validity period of the Delivery Order / Release Order issued by MSTC / PRINCIPAL or upto the
extended period of validity of the Delivery Order / Release Order in case the Delivery period is extended by the PRINCIPAL at his sole
discretion as the case may be.
13.0 The Principal reserves the right to withdraw in part of full or to close the contract any time during the currency of contract without
assigning any reason thereof. This will not entitle the buyer to demand compensation or right for delivery of full qty. by way of
extension of contract.
14.0) SALE OF VEHICLES:
14.1) In case of disposal of Old / Used Vehicles, the following procedure will be normally followed:
(a) For RTO Registered Vehicles sold with RC Book (if available with the PRINCIPAL) the sale will be deemed to be for Re-use and Sale
Tax will be charged accordingly. All charges for change to ownership shall be borne by the Buyer. In case the RC Book is not available
or lost, necessary Certificate in this regard will be issued by the PRINCIPAL to the concerned RTO with copy to the Buyer to enable
them to get the ownership transferred.
(b) In case of RTO Registered Vehicles sold as Scrap without RC Book, the sale will be deemed as sale of Scrap and GST will be
charged accordingly and a Remark will be put on the Delivery Order stipulating that Sale is for Scrapping & without RTO Documents.
However in all the above cases, the PRINCIPAL will have the sole discretion to decide whether they would sell the Vehicle for
Scrapping or otherwise and no complaint / representation will be entertained from the Bidder in this regard.
15.0) SALE OF HAZARDOUS WASTE ITEMS:
15.1) The sale of Hazardous Waste items, namely Waste Oil and specified categories of Non-Ferrous Metal Waste will be governed by
Hazardous Wastes (Management & Handling) Rules, 1989 and its Amendments and the sale of Batteries will be governed by the
Batteries (Management & Handling) Rules, 2001 and its Amendments. For such items, only those Parties shall be eligible to bid who
have Valid Registration Certificates from the State as well as Central Pollution Control Board (PCB) on the Starting Date of e-Auction. If
the Bidder had the said State PCB and /or CPCB Certificate(s) which expired within 30 (thirty) days before the date of starting of e-
Auction, he should submit a copy of the expired Certificate(s) and a copy of his Application for extension with a proof of submission
of the Application at least one working day before the starting date of e-Auction (within 3 PM).
15.2) In case of Sale of Waste Oil & specified Non-Ferrous Metal Waste involving transport of such material to the Buyer's Plant /
Processing Unit located in a State other than from where such items are being sold, the Buyer must obtain and submit 'No Objection
Certificate' from the State PCB where the Buyer's Plant / Processing Unit is located, to the Principal before taking delivery, failing
which the sale will be treated as cancelled and further action will be taken by MSTC / Principal as may be deemed fit by MSTC /
Principal.

15.3) In case of Items other than Waste Oil, specified Categories of Non-Ferrous Metal Wastes and Batteries, which fall under the
category of HAZARDOUS WASTE, the sale will be governed by the Hazardous Waste (M&H) Rules, 1989and its Amendments.
16.0) The Bidder(s) shall have no right to issue any addendum to these Special Terms and Conditions or Buyer Specific Terms and
Conditions to clarify, amend, supplement or delete any of the conditions, clauses or items stated therein.
17.0) ARBITRATION/ LEGAL JURISDICTION: This will be applicable as per the relevant Clauses stipulated in the Buyer Specific Terms
And Conditions already accepted by the Bidders at the time of Online Registration by him on the MSTC e-Auction Webs.
