The brief facts of the case.

Sir,

Brief facts of the case are that I, the ASI/SHO alongwith the police party was

present at the Delhi Gate Malerkotla when C. Mohinder Singh No. 339 came to me with a

Ruqa of Civil Hospital Malerkotla to the effect that –“Lal Singh s/o Kabli Singh, caste

Ramdasia injured alongwith five other injured persons is admitted in the Civil Hospital”.

Upon this, I-ASI/SHO alongwith the police party reached Civil Hospital Malerkotla

where injured Chand Singh son of Kabli Singh Ramdasia, resident of village Qila

Rehmatgarh was declared fit to make statement by the doctor. Thereupon Chand Singh

got recorded his following statement with me:-

“I am resident of Qila Rehmatgarh. In the adjoining house, Des Raj s/o Amar

Singh who is the son of brother of my grand father resides alongwith his family. He has

retired from the police department. Today an altercation took place between my wife

Manjit Kaur and Jaswant Kaur w/o Des Raj on account of throwing of garbage in front of

house. So, I alongwith my family including my two brothers namely Lal Singh and

Bhagwan Singh my son Shamsher Singh and my nephew Tirlok Singh came out of the

house in the street and Des Raj also came in the street alongwith his family armed with

12 bore gun and Des Raj told that if we raised more noise then he will ruin us. By saying

this, Des Raj fired from his gun which hit Manjit Kaur on the left side of her head and she

fell down. My son rushed towards his mother and placed his hand on the head of his

mother. Des Raj again fired at my son which hit on his right hand. Shamsher Singh

raised the alarm of “Marta-Marta” (Killed-Killed). When my two brothers Lal Singh and

Bhagwan Singh came forward Des Raj again loaded his gun and fired, which hit my
brother Bhagwan Singh on the left side of his chest and he fell down at the spot, Des Raj

again fired at my brother Lal Singh which hit him on his left flank who also fell down.

Three sons of Des Raj namely, Pargat Singh, Happy, Pavittar Singh, and his wife Jaswant

Kaur and his two daughter-in-law were raising lalkaras (exhortations) saying, today we

will not leave any members of their family, alive.” On their exhortation, Des Raj again

loaded his gun and fired upon me which hit on my right arm. Some pellets hit my

nephew Tirlok Singh and a little female child Rabina. My wife Manjit Kaur and my

brother Bhagwan Singh died at the spot while my other brother Lal Singh has died here in

this hospital. After leaving my father-in-law Shri Ginder Singh to safeguard the dead

bodies my nephew Tirlok Singh have brought me here on his tractor-trolley to Civil

Hospital. Chand Singh appended his signatures on his statement in Punjabi, which was

attested by me, then the statement was sent to the Police Station through C. Mohinder

Singh No. 339 and FIR No. 45 dated 16.2.2003 under sections 302/307/148/149 IPC and

27/54/59 Act, P.S. Malerkotla was got registered. The doctor declared other injured

persons unfit to make their statements. Then, I alongwith the police party reached the

spot at Qila Rehmatgarh. At the spot, photographs of the dead bodies were got prepared.

After preparing the inquest report on Form –25.35(1)b, dead bodies of Manjit Kaur and

Bhagwan Singh besides the inquest papers were sent for the post-mortem examination at

Civil Hospital Malerkotla through Constable Manjit Singh No. 71. I inspected the spot

and prepared the rough site plan and after conducting proceedings at the spot, I alongwith

the police party have reached the Civil Hospital Malerkotla, where after examining the

dead body of Lal Singh in the dead house. I have prepared the separate inquest report.
After conducting the post-mortem of the dead body of Lal Singh which is lying in the

dead house, the result (cause of death) may please be intimated.

Brief facts of the case:-

Sir,

Brief facts of the case are that today one ruqa has been received from C.H. (Civil

Hospital) Malerkotla to the effect that “Lal Singh son of Kabli Singh Ramdasia, resident

of Qila Rehmatgarh alongwith five other injured stands admitted in Civil Hospital

Malerkotla. There upon I, the ASI alongwith the police party reached Civil Hospital

Malerkotla from the Delhi Gate, Malerkotla, where after obtaining the written opinion (of

the doctor) about fitness of injured Chand Singh s/o Kabli Singh Ramdasia resident of

Qila Rehmatgarh, recorded his statement, and the same was sent to the Police Station for

registration of a case (FIR) through C. Mahinder Singh. Said Chand Singh got it

recorded in his statement that – “I am resident of Qila Rehmatgarh. My uncle Des Raj

s/o Amar Singh who is the son of my grand-father’s brother is residing in our adjoining

house alongwith his family. He has retired from the Police department. Today an

altercation took place between my wife Manjit Kaur and Jaswant Kaur w/o Des Raj on

account of throwing of rubbish. Thereupon, I alongwith my family members including

my two brothers namely, Lal Singh and Bhagwan Singh, my son Shamsher Singh and my

nephew Tirlok Singh came out of the house, in the street. Des Raj while armed with

his .12 bore gun also came out in the street from his house alongwith his family members.

Des Raj gave a threat to us, “In case you fall into altercation, I would ruin all of you.”

Saying so, Des Raj fired a shot from his gun upon my wife Manjit Kaur, which hit on the

left side of her head, as a sequel to which she fell down. My son rushed towards his

mother and placed his hand on the wound to close the blood which was oozing from
head. In the meantime, Des Raj again fired another shot at my son which hit him on his

right hand. Shamsher Singh raised the alarm of – “Marta-Marta” (Killed-Killed).

Thereafter when my two brothers Lal Singh and Bhagwan Singh came forward by

running, Des Raj again loaded his gun and fired a shot towards them, which hit my

brother Bhagwan Singh on the left side of his chest, due to which he fell down at the spot.

Then Des Raj again fired a shot at my brother Lal Singh whit hit him on the left side of

his flank and he fell down at the spot. Three sons of Des Raj namely Pargat Singh,

Happy, Pavittar Singh, his wife Jaswant Kaur wife of Des Raj and his two daughter-in-

law were raising lalkaras (exhortation) saying “Papa! Don’t leave any member of their

family alive today”. On their exhortation Des Raj again loaded his gun and fired a shot at

me, hitting me on my right arm. Some pellets hit my nephew Tirlok Singh and a little

child Rabina. My wife Manjit Kaur and brother Bhagwan Singh died at the spot, whereas

my another brother Lal Singh died in this hospital. After leaving my father-in-law

Ginder Singh to safeguard the dead bodies, we have come to the Civil Hospital by our

tractor-trolley for getting my nephew Trilok Singh admitted for treatment”. The

statement was signed by Chand Singh and my attestation the same was sent to the Police

Station through C. Mahender Singh No. 339 to whereupon case (FIR) No. 45 dated

16.2.2003 under Sections 302/307/148/149 IPC and 27/54/59 A.Act, P.S. Malerkotla was

got registered and reached here at the spot i.e. Qila Rehmatgarh where after getting the

spot photographed and after conducting the examination of the dead bodies of Manjit

Kaur and Bhagwan Singh, with papers inquest reports on Form No. 25.35(1)b have been

prepared. Dead bodies of Manjit Kaur and Bhagwan Singh are being sent Civil Hospital,
Malerkotla for conducting post-mortem examination through C. Manjit Singh 71. After

conducting the post mortem examination, reports may please be intimated.

Brief facts of the case are that:-

Today, when I, the ASI/SHO alongwith the police party was present at the Delhi

Gate Malerkotla, in connection with patrolling, C. Mahinder Singh No. 339 came there

and handed over a ruqa of Civil Hospital Malerkotla, to the effect that injured Kabli

Singh, Ramdasia by caste, resident of Qila Rehmatgarh besides five other injured persons

is lying admitted in Civil Hospital Malerkotla. Thereupon, I-the ASI alongwith the

police party reached Civil Hospital Malerkotla where after obtaining opinion of the

doctor regarding fitness of injured persons namely Chand Singh son of Kabli Singh

Ramdasia, resident of Qila Rehmatgarh etc., his statement was recorded and the same

was sent to Police Station through Constable Mahinder Singh for the registration of a

case (FIR). Chand Singh has got it recorded in his statement that:-

“I am resident of Qila Rehmatgarh. Des Raj son of Amar Singh, who is the

grandson of my father’s brother is residing alongwith his family members in our

adjoining house. He has retired from the Police Department. Today, there had been a

quarrel between my wife Manjit Kaur and Jaswant Kaur wife of Des Raj on account of

throwing garbage in front of our house. Thereupon, I alongwith all my family members

including my two brothers namely, Lal Singh and Bhagwan Singh, son Shamsher Singh

and nephew Tirlok Singh came out of the house. In the meantime, Des Raj while armed

with a .12 bore gun came out in the street alongwith his whole family. Then Des Raj

gave a threat to us saying, “In case you open your mouth further, we would ruin all of

you”. Saying so, Des Raj fired a shot upon my wife Manjit Kaur from his gun which hit

her on the left side of the head, as a sequel to which she fell down. My son rushed

towards his mother and placed his hand on her wound in order to stop bleeding from the
head. In the meantime, Des Raj again fired a shot at my son which hit him on his right

hand. Shamsher Singh raised the alarm of “Marta-Marta” (Killed-Killed). Thereafter

when my both brothers Bhagwan Singh and Lal Singh stepped forward, Des Raj again

loaded his gun and fired a shot towards them, which hit my brother Bhagwan Singh on

the left side of his chest, as a sequel to which he fell down on the spot. Des Raj again

fired a shot at my brother Lal Singh, which hit him on his left flank. He also fell down.

At this all the three sons of Des Raj, namely, Pargat Singh, Happy, Pavittar Singh, his

wife Jaswant Kaur and his both daughters-in-law continued raising lalkaras (exhortations)

saying, “Papa! Don’t leave any member of their family alive today”. On their

provocation, Des Raj again loaded the gun and fired a shot towards me, which hit me on

my right arm. Some pellets hit me on my bare-heard, whereas some others hit my

nephew Trilok Singh and a small female child namely Ravina. My wife Manjit Kaur and

brother Bhagwan Singh expired at the spot itself, while my another brother Lal Singh

died here in the hospital. After leaving my father-in-law Ginder Singh for the

supervision of the dead bodies (at the spot), my nephew Trilok Singh brought us to the

Civil Hospital here and got us admitted (for treatment)”. Then, Chand Singh appended

his signatures on his statement and I appended his signatures on same, to which I

attested”. Having sent the said statement to the police station through Const. Mahinder

Singh 334, Case (FIR) No. 45 dated 16.2.03 U/ss. 302, 307, 148, 149 IPC and Sec.

27/54/59 Arms Act P.S. Malerkotla was registered in his report, the doctor declared other

injured persons unfit to make their statements. Then I alongwith my police party reached

the spot at Qila Rehmatgarh and after getting the dead bodies snapped and completing the

inquest report on Inquest Form No. 25.35(1)b, dead bodies of Manjit Kaur and Bhagwan
Singh besides inquest papers were sent to Civil Hospital through Constable Manjit Singh

71 for their post mortem examination. After conducting the post mortem, result thereof

may please be intimated.

Statement of Chand Singh son of Kabli Singh, aged about 50 years, Ramdasia

runs as under:-

I am a resident of the above-mentioned address and doing cultivation. We are

four brothers. I am the eldest Gurnam Singh is younger to me, Lal Singh is younger to

him and Rajwinder Singh is the youngest of us. The name of my wife is Manjit Kaur. I

have got three sons and a daughter. Out of them Shamsher Singh is the eldest, Udham

Singh is younger to him, Sohan Singh is the youngest son. My daughter Sonia Kaur is

the youngest of all. Des Raj son of Amar Singh who is the son of my grandfather’s

brother is residing in our adjoining house alongwith his family. He has retired from the

police department. Today, there was a Bhog ceremony of the Akhand Path on the eve of

auspicious birth anniversary of Baba Ravi Dass Ji at Qila Rehmatgarh. Said Des Raj is

the President of the Ravi Dass Committee, who had taken excessive liquor. After the

Bhandara (Community kitchen) was over, our whole family as well as the family of Des

Raj had returned to our respective houses. At about 4.00 P.M. my wife Manjit Kaur and

Jaswant Kaur wife of Des Raj quarreled with each other because my wife Manjit Kaur

had lodged a protest with Jaswant Kaur wife of Des Raj on account of throwing of

garbage in front of our house by them, whereupon Jaswant Kaur wife of Des Raj

remarked saying, “We will continue to throw the same as usual”. Who are you to stop

me from doing so?” On hearing their noise, all of our family members viz. my both
brothers namely, Lal Singh and Bhagwan Singh, my son Shamsher Singh and nephew

Tirlok Singh came out of our house. In the meantime, Des Raj armed with his double

barrel gun of 12 bore also came out from his house alongwith his family. Then, Des Raj

gave a threat to us saying, “In case you open your mouth further, we would ruin all of

you”. Saying so, Des Raj fired a shot upon my wife Manjit Kaur from his gun, which hit

her on the left side of head. As a sequel to which she fell down. My son rushed towards

his mother and placed his hand on the wound in order to stop bleeding from the head. In

the meantime, Des Raj fired another shot at my son which hit him on his right hand.

Shamsher Singh raised an alarm of “Marta-Marta” (Killed-Killed). Thereafter, when my

both brothers Bhagwan Singh and Lal Singh stepped forward, Des Raj again loaded his

gun and fired a shot towards them which hit my brother Bhagwan Singh on the left side

of his chest. He fell down at the spot. Again Des Raj fired a shot at my brother Lal

Singh, which hit him on his left flank, whereupon he also fell down. At this, all the three

sons of Des Raj namely Pargat Singh, Happy, Pavittar Singh, his wife Jaswant Kaur and

his both daughters-in-law continued raising lalkaras (exhortations) saying, “Papa! Don’t

leave any member of their family alive today”. On their provocation, Des Raj again

loaded the gun and fired a shot towards me, which hit me on my right arm. A few pellets

also hit my nephew Tirlok Singh and a little female child namely Ravina d/o Mazid

resident of Qila Rehmatgarh. While firing short(s) in the air, Des Raj raised exhortation

saying, “Today, we will breathe only after killing any other alive member of their

family”. My wife Manjit Kaur and brother Bhagwan Singh had died at the spot.

Whereas, my second brother Lal Singh died here in the hospital. On hearing the report of

first fire shot of Des Raj, residents of the Mohalla had closed their doors and windows
out of fear. The, Des Raj alongwith his family having put a lock (at the door) of his

house, fled away from there togetherwith his gun. Then, after leaving my father-in-law

Ginder Singh for the supervision of the dead bodies at the spot, my nephew Tirlok Singh

took us on his tractor trolley and got us admitted for treatment. I have heard the

statement, which is correct. Action in this regard may be taken.

Action taken by the Police:-

Today I, ASI/SHO, alongwith ASI Parminder Singh, HC Avtar Singh, HC

Gurmel Singh 1230, C. Balwinder Rai, 1142, C. Sikander Ram 431 and C. Manjit Singh

71 was present at the Delhi Gate, Malerkotla by an official Zypsy No. PB-13B-1619 in

connection with patrolling that Constable Mahinder Singh No. 229, produced a ruqa

received from C.H. Malerkotla regarding injured persons namely, Lal Singh, etc. before

me. Thereupon I the ASI/SHO alongwith my colleagues and Constable Mahinder Singh

reached Civil Hospital Malerkotla where injured Chand Singh son of Kabli Singh was

admitted and written opinion of the doctor regarding fitness to make a statement was

sought. The doctor declared Chand Singh fit to give statement. Thereupon above

statement of Chand Singh was recorded as per his dictation, which was read over to him

who after hearing and admitting the contents to be correct, put his signatures in Punjabi,

to which I attested. From the above statement, commission of an offence under sections

302, 307, 148, 149 IPC and Section 27/54/59 Act is made out and as such their statement

is being sent to the Police Station for registration of a case (FIR) against the aforesaid
persons through Constable Mahinder Singh 339. After registration of the case, its

number be intimated. Special reports be issued. Information be given to the higher

officers at the Control Room. I am busy in conducting the investigation of the case

alongwith my co-officials.

Statement of Chand Singh son of Kabli Singh, aged about 50 years, Ramdasia

runs as under:-

I am a resident of the above-mentioned address and doing cultivation. We are

Translation of Mark ‘A’, a clipping of the newspaper appeared in the ‘Daily Ajit’
in its issue dated 17th February 2003 under the Caption “3 died, 5 injured in the firing
incident of Qila Rehmatgarh”.

Malerkotla:- 16th Feburary (Kuthala Singla):-

In the fire incident which took place at Qila Rehmatgarh here, three persons have

died at the spot itself, whereas apart from a passer-by female child, four others got

seriously injured. As per the available information, one person namely, Des Raj had a

minor altercation with Lal Singh and Bhagwan Singh amidst the Nagar Kirtan held out on

the even of auspicious anniversary of Guru Ravi Dass Ji, as a sequel to which both the

parties resorted to a severe fight with dangs and soties this noon. In the evening, Des Raj

shot dead Lal Singh and Bhagwan Singh sons of Kabli Singh, Manjit Kaur wife of Chand

Singh (Ravidasiya) at the spot itself with his pistol. Besides, Chand Singh son of Kabli

Singh, Shamsher Singh son of Chand Singh, Soni son of Chand Singh, Tirlok Singh son

of Bhagwan Singh and one passer by female child Ravina were injured. The injured were

immediately got admitted in Civil Hospital Malerkotla, where their condition has been

described as serious. It has been learnt that the police has nabbed Des Raj from the spot.

2003 of the Jag Bani under the caption – “3 killed, 4 Injured in a fire incident at
Malerkotla”.

Malerkotla:- 16th February (Shahabuddin…):-

3 persons killed and 4 seriously injured as a sequel to the firing incident, which

took place between the rival factions here in the area of Qila Rehmatgarh this evening.

Today, personal grudge of the ladies of two factions took a serious turn. Retired

Havildar Des Raj killed Bhagwan Singh and Manjit Kaur at the spot itself by string shots

from his .12 bore gun and he also injured 5 persons. All the five injured were removed to

Civil Hospital Malerkotla, where Lal Singh son of Kabli Singh also succumbed to the

injuries sustained by him. Out of the four injured lying admitted in Civil Hospital

Malerkotla, Chand Singh son of Kabli Singh, Parmod Singh son of Bhagwan Singh,

Rubina d/o Majid Mohammed and shamsher Singh son of Chand Singh are amongst the

injured persons. The police party led by S.H.O. Harwinder Singh Cheema of Police

Station City Malerkotla having reached the spot immediately, arrested the Havildar Des

Raj and registered a case under sections 302/307, 27/54/59. Having also reached the

spot, Sh. Gurkirpal Singh S.P. (D) Sangrur, took stock of the situation.
