1. All the offer shall be valid for a period of 30 daysfrom the date of closing of e- auction.

3. Material list & STC displayed underview forthcoming auctions on MSTC's e-auction website are tentativeand subject to change at the sole discretion of MSTC/Principal
beforethe start of e-auction. Bidders should, therefore, download thematerial list and STC displayed only under view live auctions fortheir record purpose, if required, and bid
accordingly.
4. The bidders shall submit Earnest Money Depositby DD/PO/NEFT/RTGS in favor of Principalas stated in Sale Intimation Letter within 7days from date of e-auction for
accepted and STA lots. The EMD shall be@10% of the net sale Value quoted (excluding taxes & duties) forLots sold on Accepted and STA. Upon issue of the sale order the
EMDshall automatically be converted into Security Deposit. The SecurityDeposit as specified in Sale Order shall be adjusted only at the timeof final payment. It should be

noted that failure to submitpost bid EMD / SD within above stipulated time will result in automaticdeactivation of buyer's login from MSTC System for a minimum
period ofsix (06) months. Thus the bidders shall be debarred from participationin any auction being conducted by MSTC for a minimum period of six (6)months.
Buyers login may however be activated only if full payment(Material Value + Applicable Taxes & Duties) is received within22 days from the date of closing of e-
auction.
5. E-auction lot Status/result: The status of thehighest bids having been accepted on Confirmed or STA basis must bepersonally seen by the Bidders online through the link
Auction LotStatus immediately after closing of e-Auction which will be displayedup to 7 (Seven) days from the date of Closing of e-Auction (excludingthe date of closing of e-
Auction) and payment of Post-Bid EMD/SD mustbe made accordingly. Although immediately after closing of e-Auction, asystem generated automatic Sale Intimation Letter
will be issued bye-mail to the Highest Bidder for accepted/STA lots. The bidders mustalways keep their registered email account valid, failing which bidderswill be liable for
non-compliance of payment/delivery instructions ifissued by MSTC/SELLER from time to time.
6. The Contract shall be treated as having beenentered into upon issuance of signed sale order-cum-Acceptance letterby MSTC in favor of the successful bidders. The period
of contractshall be of sixty days from the date of last Delivery order by MSTCagainst full payment made by the party. The contract shall be deemed tobe complete as soon as
the Area is cleared of the entire materialallotted or on completion of the period of contract as mentioned above,whichever is earlier.
7.0 All the materials are offered for sale on AS ISWHERE IS basis Ex works Owners, RATE MUST BE QUOTED ON UNIT BASIS FOREACH LOT SEPARATELY NOT PART
THEREOF i.e. in Rupees per unit only. Thequantity indicated against the lot are purely indicative.
7.1 The quantity in actual may turn out to be moreor less than the estimated quantity. In the event of quantity turningout to be more than the estimated quantity the buyer has
to lift theallotted quantity(+/-10%). In the event of actual quantity turning outto be less than the estimated quantity, the buyer shall not be entitledto claim any damages, loss of
interest or compensation on this count.
8. Rate must be quoted exclusive of applicabletaxes and duties which will be charged as on date of delivery. Anyvariation in such taxes and duties will be borne by the
buyers.
9. The Bidders/customers workmen shall have toabide by the rules regulation including safety & securityregulation of the relevant statutory Acts. Entry inside the worksshould
only be against Gate pass for the men and equipment for whichpurchaser will have to apply well in advance before lifting commences.
10. The Buyer will employ his own labor and means;at his own cost and risk for removal/collection/shifting of scrap asper schedules and payment of wages/compensation to
the laborers will bethe sole responsibility of the buyer. The purchaser shall ensure thathis workmen do not loiter around within the stores area of the factoryareas. They shall
not touch any material except those material shown tothem. If any of his workmen is even found violating these restriction,the purchaser shall be responsible for making good
the loss to theowners on which their decision shall be final and binding.
11.0 PAYMENT PERIOD: In caseof confirmed Lots, payment for full material value plus all duties& taxes have to be made within 22 days from the date of closeof e-Auction.
Failure to deposit balance sale value (after depositing post bid EMD asstated in Clause 5 above) shall lead to forfeiture of EMD deposited bythe buyer.
11.1 If payment against basic cost only isdeposited and amount of GST and Late Payment Fee, if any, etc. is notdeposited by buyer then the seller/stockholder at its own
discretionshall issue relevant site delivery order for reduced quantities afteradjusting the GST/ Late payment charges etc.

11.2 For delayed payment of balance sale valuealong with taxes and duties, late payment charge @ 1% per week or partthereof for a maximum period of 14 calendar days
has also to be chargedwhich should also feature in the STC. However, this shall not conferany right to the Bidder to make any Late Payment of Balance Sale Valueor
applicable Duties and Taxes MSTC/Seller reserves the right not toaccept the payment of the Balance Sale Value with or without theadditional charges after the expiry of the
due payment time asmentioned above
11.03 GST rates as indicated in this e-auctioncatalogue are only indicative. Actual GST rates as applicable on thedate of lifting shall be applicable. Bidders are required to
satisfythemselves about GST rate through their own sources/means beforebidding in this e-auction and any discrepancy should be intimated toMSTC / Seller at least one
working day prior to the e-auction. Nocomplaint from any bidder thereafter, regarding any variation will beentertained after the e-auction goes on live floor. Nonpayment of
saleproceeds on the ground of any discrepancy of GST rate will be treatedas default and action as deemed fit including but not limited toforfeiture of EMD/SD will be taken
against the bidder.
12.1 DELIVERY PERIOD: Thesuccessful bidders shall lift the all allotted material lying in thelot allotted to them by employing their own labor and transport attheir own cost
within 30 Days (Thirty Days) from the date of DeliveryOrder (including date of issue)/or as stipulated by MSTC LIMITED.
12.2 In case of delayed lifting, the collection ofground rent in advance shall be the sole responsibility of the sellerbefore effective delivery. The rate of ground rent beyond the
freedelivery period shall be @ 1% per week or part thereof for a maximumperiod of 14 calendar days
12.3 In case of Goods sold on Lot Basis, the GroundRent will be calculated at the rate specified above on the value of theentire Lot even if lifted in part, where as in case of
Goods sold onUnit Weight or Unit Number Basis, the Ground Rent will be calculated onthe value of unlifted quantity However it must be noted by the Biddersthat it will be the
sole discretion of the Seller not to allow theBuyer to lift the Goods with or without the Ground Rent after theexpiry of the stipulated free Delivery period or even within
theaforesaid additional period of 14 (Fourteen) Days and in such event,the sale of the material not lifted by the Buyer(s) will beautomatically cancelled and all the moneys paid
by the Bidder /Buyerwill be automatically forfeited.
13. MSTC/SELLER reserves the right to withdraw inpart or full or to close the contract any time during the currency ofcontract without assigning any reason thereof. This will
not entitlethe buyer to demand compensation or right for delivery of full quantityby way of extension of contract.
14. After the submission of bid(s) by the Buyer, apresumption would be drawn that the buyer has inspected the materialand has satisfied himself about the nature, quantity,
quality, othertechnical specifications, taxes-duties and legalities prior to thee-auction. No complaint, whatsoever, on the points referred above,would be entertained after the
submission of the bid.
