SUB –LEGAL NOTICE UNDER SECTION 138 OF THE NEGOTIABLE INSTRUMENT ACT ,
1881.
Dear M/s Priyanka ,
Under the instruction of my Client M/s Ritika residing at HRBR layout Bengaluru
I serve on you this ‘Legal Notice’, informing you as follows:
1. That when you had visited my client’s Shop at HSR layout to buy the machinery worth Rs.
10,00,000 and issued the cheque , bearing No. 227820 and No. drawn on State Bank Of India
dated 12th of June (12.06.24 ) , for the same demanding the cheque to be honoured only after
one month from the purchase and as per your instruction my client went to the bank after a
month on 24th of July(24.07.24) deposit the said cheque in the bank.
2. That my client had deposited the cheque in her account , in the State Bank of India, during
the period of its validity on 24.07.24 which was returned unpaid to my client on 25th of July
(25.07.24) on account of ‘insufficient funds’ in her Bank Account in the aforesaid cheque to
meet the demand stated in the aforesaid Cheques. (Xerox copy of the Memorandum both dated 24.07.24
and 25.04.24 issued by the State Bank of India is enclosed for ready reference).
3. That it appears in order to cheat and defraud my client and without any intention on your part
on paying the aforesaid amount despite my client’s agreement on waiting for a period of one
month before presenting it to the bank . It appears that to defraud my client you had
deliberately and intentionally issues the aforesaid cheque , knowingly that it was bound to be
dishonoured .
4. That your act of not keeping sufficient fund in your bank account to an offence under section
138 of the Negotiable Instrument Act 1881, which is punishable with imprisonment up to 2
years and fine which may extend to fine of twice the amount of the cheque .
5. Under the aforesaid facts and circumstances, through this legal Notice, I on behalf of my
client, do hereby call upon you, to pay my Client, the aforesaid amount of Rs. 10, 00,000 on
or before 18th September ( 18.08.24), failing which my client shall initiate legal proceedings
for the recovery of the said amount and shall also prosecute you under section 138 of the
Negotiable instruments act and you shall be liable for the costs of the proceedings also.
Copy of the Notice is retained in my office for future Legal Action.
