Dear Sir,
SUBJECT: With reference to your inquiry, we are pleased to give you our offer for the following grade of
Concrete. This quotation is made on and is subject to the terms below.

TERMS / CONDITION
• GST Extra @18%.
• TCS Extra (if and as applicable)
• Pumping Charges will be extra @ Rs 250 /- per CuM (Basic Rate) for a minimum
quantity commitment to be 60 CuM for a single continuous pour. 18% GST will be
charged extra.
• Slurry if required will be charged @ Rs 3,800 (Basic/Per CuM), if and when
supplied in RMC TM.
• TCS will be collected, if applicable, as per Income Tax Act 1956, Section
206C(1H), Please note the price as quoted above is exclusive of such TCS.
• (If applicable) Customer/ Buyer must provide advance declaration that as per the
provisions of
Section 194Q of the Income Tax Act, they had turn over in the preceding financial
year (FY2020-21) for more than Rs 10 Crores. Hence, they are liable as buyer to
deduct tax at source on the payment for invoices issued by L & P RMC on or after
1st Jul 2021. Accordingly, L &P will not charge the TCS u/s 206C(1H) on your
invoices issued from 1st Jul 2021 onward.
• The above rates are as per the L & P RMC Standard mix design; any changes in
the mix design shall bring in proportionate changes in the quoted rates.
You are requested to provide 3 - 4 bags of cement free of cost before pumping
begins.
• The above prices exclude the following costs o Cooling of concrete

• Tax Invoice (Bills) of RMC will be raised by L & P RMC based on quantity of
RMC supplied through daily accepted & signed delivery challan and not on actual
site measurement basis. However, if any quantity discrepancy is seen, it should be
brought to our notice in writing immediately to ensure that any shortage is
investigated or eliminated, other than normal wastage at the site. No quantity
discrepancy will be entertained after 24 hours.
Validity:

Price Escalation:

Should default be made in paying any sum due, the company shall have right to
suspend all further deliveries until the default is made good. Offer for credit is at
the discretion of management of L & P RMC.

properly calibrated and we witness such testing. We encourage our customers to

and excessive loss of water might result in plastic shrinkage cracking of concrete
surface. Only good care while compacting and finishing can take care tocontrol

L & P Concrete is no way responsible for any plastic shrinkage or settlement
cracks, drying shrinkagecracks and restraining cracks nor shall entertain any claim
for repair, as these occur due to improper handling of concrete during casting of
structures and lack of crack control mechanisms like contraction joints, additional
reinforcement, early curing etc. in application which is beyond our scope.
Safety:
L& P Concrete representative is allowed within one-
meter vicinity of pumps and pipeline.
Customers are requested to follow this strictly by way of advance intimation to all
people concerned during pour. Injuries may happen due to moving parts of pump,
Hopper grills, high temperature of hydraulic units bursting or sliding of pipelines
and a number of causes.
Concrete representative should come near one meter
of transit mixers instatic position.
Please note that any person not following the Safety Norms / Rules / Instructions
isexposing himself to risk.
Warranty Clause:
Specifications. No one is authorized to make any modifications or addition to this
warranty. L & P
Limited makes no warranty or representation; either expressed or implied with
respect to this product and
disclaims any implied warranty of merchantability or fitness for a particular
purpose.
As L & P RMC has not control over the other ingredients mixed with this products
or the final
application, L & P RMC does not and cannot warrant the finished work.
In no event shall L & P RMC be liable for direct, indirect, special, incidental or
consequential
damages arising out of the use of this product, even if advised of the possibility of
such damages. In no case shall
L & P RMC liability exceed the purchase price of this product.
SUBJECTED TO STATE’S JURISDICTION
Force Majuro:
If the performance of obligations under this contract is prevented, restricted or
interfered with by reason of any
contingency, which could not have been reasonably avoided, the party so affected
shall not be liable to the other
for damages to the extent of such prevention, restriction or interference. Such
contingency shall include but will
not be limited to power cuts, equipment failures, lock outs, strikes or other
concerted acts of workmen, non-
availability of raw material, fire, flood, earthquake, explosion, riots, acts of God, acts
of Government, Government
Regulations, war whether declared or not, or enemy action. The obligations to
perform during the period of this
contract shall arise again immediately upon termination of the contingency or such
moderation of the contingency, so that performance is no longer prevented,
restricted or interfered with.
Notwithstanding anything contained in any other Agreement, Contract or other
document entered into or Executed whether prior to or subsequent to this quote,
the courts in the city of Mumbai shall alone have jurisdiction to try to any dispute
or difference between the parties to this quote with regard to the interpretation
of the terms of quote or any other matter relating to or arising out of this offer and
this shall be treated as aseparate contract.
