RENT AGREEMENT

This Rent Agreement is executed at Gurgaon on 23rd day of March 2023 between, Mrs. Meena
Malhotra (Aadhar Card No. 325902827026) R/o A1/260, Ground Floor, Near Kamal Cinema,
Safdarjung Enclave, Vasant Vihar, South West Delhi – 110029 (hereinafter called the
‘Lessor/Owner”), which expression shall unless repugnant to the context or meaning hereof,
mean and include his/her heirs, successors, legal representatives and assigns of the one part.
AND
Mr. Gafrej Ali S/o Rifakat Ali (Aadhar Card No. 648611675444) R/o Bhimtal, Ward No.5,
Kuantal, Joonstate, Nainital, Uttarakhand - 263136 (hereinafter called the “Lessee/Tenant”),
which expression shall unless repugnant to the context or meaning hereof, include his/her
successors and assigns of the other part.

WHEREAS the LESSOR is the lawful owner in possession of 3Bed rooms, 1Kitchen&1 Living room
(hereinafter referred to as “the said Premises”) Set, situated at IVY TOWER, Flat No. 404, Block
A, ShyamKhet, Bhowali, Nainital - Uttarakhand(hereinafter referred to as “THE SAID PROPERTY
WHEREAS the LESSOR has agreed to let out the said property to the LESSEE and the LESSEE has
agreed to take on rent.
NOW THIS AGREEMENT WITNESSETH AS UNDER:-

1. That the tenancy of the above premises shall commence from 01.04.2023 for a period of
11 months and subject to other provisions in this Agreement, the lease shall stand
automatically terminated and expire on 28.02.2024.

2. That the tenancy may be renewed with mutual consent of both the parties after
expiration of the above-said tenancy period. In the event of renewal of tenancy, the rent
Rs 8,000/-will be increased by minimum 10% of the total monthly Rent and ongoing
maintenance charges to be paid by Tenant upon renewal or whatever share is agreed
with landlord at the time of renewal.

3. That the Lessee shall pay the 5 month Advance Rent (April to August2023) of Rs.
40,000/- (Forty Thousand Rupees only), including maintenance, by CASH on signing this
lease.

4. That If the Lessee did not pay Advance rent of next 6 months for the period September
2023 to February 2024 within 1st week of September 2023, then there will be a penalty
of Rs. 100/- per day for the first 07 days followed by the penalty of Rs. 500/- per day
for the next 15 days. If there is any further delay in the payment of the advance rent,
then Lessor is liable to terminate the lease on an immediate basis followed by the
vacating of the apartment after full and final settlement in between Lessor and the
Lessee.

5. That the Lessee has paid an Interest free Refundable Security Deposit of Rs. 8,000/-
(Eight Thousand Rupees only) vide only CASH which would be refunded at the time of
Termination of the Lease after Inspecting the Property.

6. That For Clarification, Interest Free Refundable Security Deposit will not be adjusted in
last month rent (in any case). If the Lessee tries to do the same without prior
information to the Lessor, then the Lessee will be liable for the points discussed in
Clause#04.

7. That the Lessor is liable to refund the Interest Free Refundable Security Deposit to
Lessee at the time of vacating the apartment (After settlement of all repairs inside the
apartment). If the Lessor fails to do the same, then the Lessor will be liable to refund the
amount with an 18% P.a. interest for the delayed period.
8. That for clarification, the above rent is Inclusive of maintenance payable to the Society
which the Lessorwill pay directly to the Society within the prescribed period.

9. That the Common Area Electricity (if any), Electricity, Consume Electricity,Water Charges
and Sewerage charge bills, telephone, internet, cable television and other utilities and
charges shall be paid by the Lessee directly to concerned authorities/agencies/Society.

10. That the Lessee has inspected the premises, which is brand new and duly equipped with
the Fittings & Fixtures enlisted in Annexure I, besides regular electrical and sanitary
fixtures and fittings and has found them in good working order. The Lessee shall be
responsible to return/handover them in the same condition at the time of surrendering
the possession.
11. Lessee shall take reasonable steps to keep the interior of the Premises and the Fixtures
and Fittings in the same decorative order and condition throughout the Term as at the
start of the Tenancy and To keep the Premises and Fixtures and Fittings in a reasonably
clean and tidy condition.

12. That there is a lock-in Period of 06 Months i.e. 01.04.2023 to 31.09.2023 from the side
of Second Party. They are not allowed to leave the Premises before 31.09.2023,
otherwise First Party is not liable to refund the Security Deposit Amount or Tenant
should give the rent upto above date.

13. That if there is any complaint noticed from the neighbors/Security Guards against the
Behavior and Daily Routine of the Second Party, Then the Lease will be terminated with
the Immediate Effect and Applicable Penalty will be charged to the Second Party. (for
any loss/Damage)

14. That the Lessor has handed over 2 sets of original keys of all locks present in the
Apartment whose details are mentioned in Annexure I.

15. That the Lessee agrees that day-to-day repair and maintenance of the premises is the
responsibility of the Lessee and the same shall be at his cost and expenses.

16. That the Lessor is responsible for payment of municipal taxes and levies in respect of the
premises.

17. That on expiry/termination of tenancy the Lessee shall hand over peaceful vacant
physical possession of the rented premises to the Lessor. All repair& replacement and
relevant charges for the damage to the structure, taps, electricity points &equipments
etc. shall be borne by the Lessee.

18. That the said premises will be used exclusively for Residential Purpose & can be used for
renting it out to tourists & well educated people only.

19. That the Lessor shall be at liberty to inspect the rented premises at any time.

20. That the Lessee shall have right to let out the whole or part of the rented premises to
tourists only & there will be no liability of the Lessor if there is any issue or problem
created by the tourist to whom the room is sub-rented out.

21. That the tenancy may be terminated after giving One Month notice (after completion of
the lock-in period from Lessee Side) in advance by either of the parties.

22. The Lessee will observe all the rules and regulations of security and administration of
society.
23. That tenancy is liable to be terminated without any notice in case breach of any of the
terms and covenants hereinabove.
24. That tenancy may be terminated based on the unsuccessful Police verification.
25. That tenancy is only valid on following conditions:
a. To use the premises only as a private residence for the occupation of the Tenant
and his immediate family.
b. Not to use the premises for any business purposes, illegal purpose or not to use
or consume or allow to be used or consumed any drugs, fire items or any other
substance which is, or becomes, prohibited or restricted by law.
26. There should be no security issue from Tourist end & any such liability should be dealt
by Lessee only and Lessor have no liability whatsoever.

IN WITNESS WHEREOF both parties have signed on the said agreement, on the date, month and
year mentioned above in the presence of the witnesses.
