This agreement is made this …………….. day of ………………………………. Two Thousand and Twenty Four[2024]
between Nesbitt Mwangi of Kenya National ID No. 24308878and Post Office Box No. 628-00520 Nairobi in
the Republic of Kenya,(hereinafter referred to as "the Landlord" which expression shall include his
successors and assigns) of the one part and MELCHIZEDEK NGAO MMWARANDU of Kenyan National
Identity Card No.25894550 and of Post Office Box No Nairobi, in the Republic of Kenya,(hereinafter
referred to as “the tenant” which expression shall include his successors and assigns)on the other part.
WHEREAS
1. The Landlord is the proprietor of a 6-bedroom house with 2 servant quarters, excluding the attic located
on L.R BLOCK 136/10321 in Ruai, herein after referred to as "the premises”.
2. The Landlord has agreed to let, and the tenant has agreed to rent the said premises on the terms as
hereafter more particularly described and at the rent hereinafter reserved and upon the subjects to
the covenants, conditions, provisions and other matters hereinafter contained or implied,
NOW this agreement witnesseth as follows:
1. The monthly rent payable by the tenant shall be the sum of Kenya shillings Seventy Thousand
only (Kshs.70, 000/=), payable on or before the 5th day of every month.
2. Rent shall be deposited to the landlord's account as follows.

3. All monies shall be deemed unpaid until the bank slip is presented to the landlord or
payment confirmation forwarded to the landlord via Cell Number 0733 366 466/0722

4. The tenancy period shall be One year commencing 1st June 2024 until 1 st May 2025, both days inclusive. The
tenancy period is however renewable subject to an agreement by both parties.
5. The tenant shall pay one month's rent deposit, which shall be held by the landlord.
6. The tenant will be responsible for provision of internet and telephone facility if required. The tenant will also pay
for their electricity and water charges.
7. The tenant shall keep the premises including all doors, windows, locks, fasteners, keys, water taps, woodwork, and
glass, sanitary and electrical apparatus in good and tenable order and proper working and condition (except fair
wear
and tear) and immediately report any damage to the Landlord.
8. The tenant shall make good any damage caused by the willful neglect of the tenant, his servants, or licenses to any
portion of the premises which the tenant is bound to maintain under the covenants and conditions of this
agreement.
9.The premises are let out for residential use only.
10.The tenant shall not sub-let the premises or any portion, nor cede nor assign this lease or any of his rights without
the Landlord's prior written consent.
11.The tenant shall not permit any sale by auction to be conducted on the premises.
12.The tenant shall not cut nor permit to be cut down, any tree that is in the compound, and shall ensure the
compound is well maintained.
13.The tenant shall not suffer any part of the said premises to be used as to cause annoyance or inconvenience to
the occupiers of the adjacent premises.
14.The tenant shall not use the premises for any purposes that are unlawful, illegal, immoral or improper.
15.The tenant shall not make any structural changes to the premises without the written consent of the
landlord.
16.The Landlord or his agent shall have a right to enter upon the said premises upon reasonable notice for
the purpose of inspection, repair or renewal, and for purposes of access to the adjacent plot of land.
17.On expiration or earlier termination of this lease, the Tenant shall return the premises and the
appurtenances to the Landlord in good order and condition, fair wear and tear excepted. Immediately
before the termination of the lease, (howsoever the termination arises), the tenant shall paint the internal
wood and iron work and other internal parts of the said premises usually painted with two coats of good
quality paint and two coats of good plastic emulsion paint on all internal walls of the said premises, in
such colors as the Landlord shall determine prior to such repainting.
18.The tenant shall allow the Landlord to enter the premises and take an inventory of fixtures upon the
giving of a reasonable notice.
19.During the last two months of the tenancy, the tenant shall permit the Landlord to affix upon the
premises a notice for re-letting and to permit persons with authority from the Landlord at reasonable
times to view the said premises by appointment.
20.Any damage to the premises caused by the tenant will be paid for by the tenant.
21.The tenant hereby agrees that they shall not do or permit or suffer to be done anything by which any
insurance of the said premises against damage by fire may become void or voidable or where the rate of
the premium for any such insurance may be increased and agrees to repay to the Landlord all sums paid
by way of increased premiums and all expenses incurred by the Landlord in or about the renewal of any
such policy rendered by a breach of the covenant and all such payments shall be added to the rent
hereinbefore reserved and shall be recoverable as such rent.
22.In the event of the premises or any part thereof being damaged or destroyed by fire at any time during
the tenancy hereby created and the insurance money under any insurance policy against fire affected
thereon by the Landlord being wholly or partially irrecoverable by reason solely or in part default of the
tenant, then and in every such case the tenant shall forthwith in addition to said rent, pay to the Landlord
the whole or as the case may require, a fair proportion of the cost of completely rebuilding and/or
reinstating the same any dispute as to the amount to be so contributed by the tenant or otherwise in
respect of or arising out of this provision to be referred to the appropriate court of law or any other
dispute resolution mechanisms.
23.This lease is terminable by the tenant giving the landlord 2 months ‘notice period and vice versa,
in writing. The tenant performing the conditions of the tenancy shall be entitled to a refund of the
deposit.
24.The tenant shall have the option to renew the agreement for a further period on terms that will
be negotiated and agreed upon by both parties hereto provided a written application by the tenant is
given to herein and provided the tenant shall have conscientiously performed and observed all the
terms and conditions specified herein.
25.The Landlord shall have a right of re-entry if any rent shall be in arrears for one month or on
breach or non-observance by the tenant of any covenant herein contained or bankruptcy or
composition with creditors or suffering distress or execution.
26. In case the rent remains unpaid after the 10th day of the start of a month and continues to be so
unpaid, the Landlord shall be free to levy distress for rent in accordance with the Distress for Rent
Act.
27.Any notice given hereunder shall be delivered personally to the Landlord or tenant. The notice
may also be sent via email or WhatsApp, but each party must get confirmation of receipt of such
notice.
28.Any dispute arising out of this agreement shall be dealt with by the Kenyan courts and as per the
Kenyan Constitution.
