1.0 NOTICE INVITING TENDER


Sealed item rate tender are invited from experience and resourceful contractors for the work as per
the details content in the tender document. The tender document is organised in one-part technical Bid and
price bid / bill of quantities.

Important details of the tender of summarise below:

Note:
In support of meeting the experience criteria the Bidder shall
furnish self-declared / attested documentary evidence
comprising work order copy and completion certificate issued
by owner / Society.

Financial Criteria:
Annual turnover of the Bidder Shall be minimum Rs. 25 Lakhs as
per the audited financial reports in the preceding last financial
year.
Solvency certificate minimum amount Rs. 5 Lakhs of
nationalised bank or schedule Cooperative Bank. (Certificate to
be enclose and should not be older than 1 year from last date
of tender sale period.)

Net worth of the Bidder as per the latest audited annual


financial result shall be positive.

Note:
1. Bidder shall submit audited balance sheet and financial
statements including profit and loss account to
established conformance to financial qualification
criteria.
2. Failure to meet the above qualifying criteria will render
the bid to be summarily rejected. Therefore, the Bidder
shall in his own interest furnish complete documentary
evidence to establish that the Bidder is meeting the
qualifying criteria as given above
3. Only those Bidders who quote for the total scope of
work shall be considered for evaluation. Bids not
meeting the above mentioned criteria shall be
summarily rejected.

14 General information 1. Society reserves the right to use in house data for

2. Bidder on consortium / joint venture basis are not
acceptable.
3. Bidder submitting their bid shall not be under
liquidation court receivership or similar proceeding.
Bidder to submit an undertaking in this regard.
4. Bidders should ensure submission of complete
information documentation in the first instance itself.

furnished without seeking any subsequent additional
information.
5. Society reserves the right to complete the evaluation
based on the details furnished (without seeking any
additional information) and in-house data, survey or
otherwise.
6. Society shall not be responsible for any expenses
incurred by bidders in connection with the preparation
and delivery of their bids, site visit and other expenses
incurred during the bidding process. All the expenses
for preparation of the bid shall be borne by the bidders.
7. Society reserves the right to reject any or all bids
without assigning any reason whatsoever.

2.0 INSTRUCTION TO THE TENDERERS


1. The tender at the time of handing over of his sealed tender offer shall deposit amount of rupees
75000 as interest free earnest money deposit. The payment shall be made in accordance with the
requirement of the tender notice and non-compliance with the requirement shall make the offer
liable for rejection.
2. The deposits of unsuccessful tenders will be returned within 15 days after the society has taken the
decision to award the contract. The society shall take the decision of awarding the contract within
the validity Period of the tender or any extended period as deemed necessary.
3. EMD and security deposit will not carry any interest.
4. The tenderers shall be deemed to have inspected and examined the site and its surrounding and to
have satisfied himself before submitting the tender. All questions, clarification, doubt etc. relating to
this tender shall be discussed with the society before filling and submitting the tender.
5. Bidder should visit the site of work before submitting the bid offer so as to familiarize himself with
the site condition and the scope of work and quantities.
6. In case of partnership concern, all partners or anyone of the partners daily authorised or person with
the power of attorney may sign the bid offer. Power of attorney should be registered and shall
accompany bid document.
7. In case of company, signature should be on behalf of the company in accordance with the provision
of its articles of association.
8. In case of sole proprietary concern, proprietor should sign himself and affix rubber stamp.
9. The tenderers shall quote strictly within the requirements of this document only. Any discrepancies
shall be brought to the notice of the society in a separate letter.
10. Validity of the tender offer shall be 45 days from the tender due date or any extended period as
agreed mutually between society and tenderer.
11. The tenderers should furnish the required documents and information in the format as per serial
number 5 documentation required which will form a part of the techno commercial bid.
12. The tender offer shall be filled in need and legible writing sealed and signed on each page. Over
writing should be signed and authenticated by the bidder at each place.
13. EMD, bid document & tender offer duly filled signed will be submitted in sealed envelope and will be
addressed to Hon’ble Chairman / Secretary, Majiwade Aadarsh Cooperative Housing Society, Plot
No. 2, RSC 1 & 2, Swami Vivekanand Naga, Old Mhada Colony, Vasant Vihar, Thane West 400610.(
MH). Envelope shall be super scribed in bold letter as “Tender for Repair & painting work”
14. In case of a tender, where the unit price of any single item appear unrealistic such tender will be
considered as unbalanced and in case the tenderers is unable to provide satisfactory explanation /
revision, Society reserve the right to disqualify such tender offer.
15. The GST extra as applicable. Tenderer shall deposit such GST collected from the society and provide
satisfactory proof of payment of GST to the Society.
16. Quantities of items mention in bill of quantities are estimated quantities of the work. Contractor will
be paid for less / excess quantities at the same rate as per actual work done.
17. The tenderers when called for, shall furnish the detailed program of execution in writing to the
society. However, preferably, first program / schedule of job shall be furnished along with the tender.
18. The contractor shall perform the works mentioned in BOQ as directed by the society. The society
may add or delete some of the items of work mentioned in BOQ and in such case the contractor will
have no rights to claim any compensation for such portion of the work deleted or carry out additional
works as if it was forming the part of the contract at the same rate mentioned in the contract.

However for additional work not mentioned in BOQ but required by the society, rates will be finalised
after negotiation with the contractor.
Contractor will not carry out any additional work without written instructions from the society failing
which his claim will not be entertained.
19. The society may call eligible tenderers for discussion, if necessary, prior to offer tender.
20. The tenderers whose tender offer is accepted shall enter into a regular agreement with the Society
incorporating specifications, general and special conditions of the contract, schedule of quantities,
drawing if any, schedule of completion, liquidated damages for delay in completion, defect liability
period, security deposit / retention amount etc.
21. The Society reserve the right to adjust arithmetical or any other errors in the tender.
22. The decision of society as regards to specification, quality and workmanship, interpretation of various
items and specification of work etc. would be final and binding on the contractor.
23. If at any time during the course of execution of the work the society is not satisfied with quality and
timelines of the work carried out by contractor society reserves the right to terminate the contract
as spelled out in the “General Conditions of contract” of the tender document.
24. Bidder shall not sub contract any part of the work awarded to him by the society

3.0 SPECIAL CONDITIONS OF CONTRACT


1. The contractor shall depute during execution of work one qualified & experienced engineer for full
time supervision who is well conversant with repairs. The appointment of contractor’s site engineer
and supervisor shall be got approved by the society. If at any point of time it is found that the site
engineer of the contractor is not present at site without prior intimation the work shall be stop and
delay will be to contractor’s account.
2. Actual commencement date of contract shall be considered from 8th days after the date of issue of
letter or work order by the society.
3. Time is essence of the contract and the contractor shall submit detailed program for completion of
the work and shall obtain approval from the society.
4. The contractor will complete the work as per the program within approved time.
5. If there is delay in completion of the contract beyond 20 days of the agreed period, the Society shall
be entitled for Liquidated damages (LD) at Rs. 1500 per day subject to a maximum of 5% of the total
value for delay beyond completion date as per contract or any extension granted by society.
6. In accordance with the prevailing Income Tax regulation, society shall deduct income tax from the
running bills as applicable.
7. In case of any dispute if the work is suspended the site shall be handed over to the Society and
contractor shall remove entire scaffolding, tools and tackels etc. from the site at the direction of the
society
8. The contractor shall bear in mind that he will have to carry out certain part of the work inside the
building which is occupied. He shall take utmost care to see that:
a. Working area are kept clean.
b. Furniture or any other properties of the society / members are not to be damaged.
c. No inconvenience / nuisance is caused during the work.
d. Plastic sheets are spread on the floor to save them from staining
e. Hessian cloth curtains are hangover scaffolding.
f. Jute covering is provided over wooden Windows and other Windows wherever possible
g. Staircase and passage area including access area shall be cleaned at the end of the day before
closing the work for the day.
h. No extra cost shall be paid for the above mentioned precautionary measures. The contractor
shall replace all the broken glasses and any damage to the property. During breaking or damage
during progress of work due falling debris etc. shall be rectified by him at his own cost.
9. The society will recover cost of any damage / replacement / repair that might occur to any property
due to negligence on part of the contractor or his workers.
10. The society shall supply electricity and water free of cost to the contractor.
11. The contractor shall be responsible for disposing off the debris outside the society premises at the
designated dumping ground of the municipal corporation. He will not dump the same on the roads
/ garbage dumps in the area. He will be responsible to attend to complaint that might arise from
improper disposal.
12. The rates shall be valid for working at all heights and depths. No extra payment shall be made for
scaffolding, staging, ladders etc. for transportation of labour and material to higher or lower level.
13. The contractor shall use materials approved by society or his representative unless otherwise
specified in tender document. Society possesses right to change /disapprove material supplied
without assigning any reason.
14. The contractor will be allowed to raise maximum two intermediate bills per month subject to a
minimum amount of rupees 2,00,000/- per bill.

15. The defect liability period shall be 2 years (24 months) from the date of virtual completion.
16. Period of running bill measurement and certificate will be 7 days after bill submission date and period
of final measurement and valuation shall be one month from the date of virtual completion.
17. 50% retention amount will be refunded after 1 year from completion of entire work and balance 50%
after 2 years with satisfactory completion of defect liability period.
18. The contractor shall take third party liability, car insurance cover equivalent to rupees 10,00,000/-
for anyone accident and for any number of accident occurring during period of works.
19. Measurement of all items will be carried out on the actual area attended and as per IS 1200.
However, when the tender specifies otherwise the mode of measurement as specified in the tender
shall be final. The decision of the society regarding mode of measurement shall be final. The
contractor shall take adequate precautions to enter measurements of such items / materials which
could not be checked subsequently into measurement book on daily basis and shall also obtain
approval of the society on the same day.
20. The contractor is not allowed to put up his labour camp at site.
21. The security deposit EMD kept by the Society is part of retention that is including in retention @ 5%
and shall be converted to retention amount without any interest.
22. The amount of retention money which shall be deducted from each running Bill shall not carry any
interest. Alternatively the Society shall release the retention amount after receiving bank guarantee
of equivalent amount and in appropriate format subject to concurrence of society.
23. The contractor shall not put any sign boards bearing any names without prior approval of the society.
24. Child labour will not be allowed.
25. All legal compliances will be handed by the contractor

4.0 General Condition of Contract


1. Construction of contract:
The contract shall in all respect be constructed and operated as an Indian contract and in
conformity with the Indian law.

2. Assignment and/or sub-letting:


The contractor shall not assign the contract or part there of any other party without the written
consent of the society.

3. Contract Document:
a. Documents mutually explanatory: The several documents comprising the contract are to be
taken as mutually explanatory of one another and in case of discrepancies the same shall be
expressed and adjusted by Society who shall thereupon issue to the contractor, instruction
directing in what system the works are to be carried out.
b. Discrepancies in tender and contract: The contract documents shall be deemed to have been
constructed after mutually arriving at an agreement on various clauses and provision of the
contract. Should any clause embodied by the contractor in the tender offer conflicts with any
clause in the condition of the contract it shall be deemed to have been discuss and agreed upon.
The general condition of the contract as further modified accordingly and incorporated in the
contract shall therefore prevail.
c. The contract shall generally consist of the following:
Article of the agreement duly signed by the parties concern in token of acceptance of the
contract. General conditions of the contract as amended / modified at the time of acceptance of
tender. Special condition of the contract incorporating other term and conditions. Work
specification and drawing if any. Bill of quantities and item rates

4. General obligations of the contractor:


a. Contractor to enter into contract: The contractor shall when called upon to do so by the
society enter into formal contract for execution of the work. The contractor and the Society
shall sign all contract documents in Triplicate.
b. Provision of contractor equipment / material and other obligations: In consideration of
payment by the society as stipulated in the contract, the contractor shall provide his
equipment to execute and complete the work in accordance with the agreed program and
shall carry out all other obligations stipulated in the contract. The work shall strictly confirm
to the specifications and descriptions of items as specified elsewhere in the contract.
c. Execution of work: The work shall be completed with due diligence and in the manner
specified in the contract and to the satisfaction of the society. The contractor hereby
Undertakes that the work shall be ready for any stipulated completion not later than the
date of completion.
d. All communication in writing: All notices communication reference and complaints issued
or made by the society or by the contractor, inter-se concerning the work shall be in writing
and no notice communication references or complaints in oral form shall be valid.
e. Extension of time for completion: Should the amount of extra or additional work of any kind
or other special circumstances of any kind what so ever which may occur be such as to fairly
entitled the contractor to and extension of time for the completion of work, the society shall
determine the amount of such extension. Provided that the society is not bound to take into
account any such extra or additional work, after such work has commenced or such

circumstances have arisen and written instruction of the society has been obtained before
commencement of the work or as soon thereafter as is practicable.
f. Liquidated Damages for delay: If the contractor fails to complete the works within the time
prescribed or within the extended time, the contractor shall be liable to pay to the society
the sum specified in the contract as liquidated damages for such default. The amount for
liquidated damages shall be proportional to time elapsed between the completion time
prescribe to the extended time as the case maybe and the date of completion of the works.
The society may without prejudice to any other mode for recovery, deduct the amount of
such damages from any money in his hands due or which may become due to the contractor.
The payment or deduction of such liquidated damages will not absolve the contractor of his
responsibilities for completion of the works or of any other obligations and liabilities under
this contract
g. Excavated materials: The contractor shall not sale or otherwise dispose off / remove except
for the purpose of the work material obtained from any excavation made.
h. Debris and scrap: The contractor shall remove the debris generated due to breaking or
otherwise from the site and he shall dispose off the debris in such a manner that comply
rules and regulations of local authorities. All materials dismantled or removed from the
existing structure shall be staked in a proper manner and shall not be disposed off without
permission of the society. All scrap materials will be the property of the society
i. Damage to person and property: The contractor shall indemnify and keep the Society
indemnified for all losses and claims for injuries and damages to any person including those
under his or his sub-contractor and any damage to any property whether belonging to the
contractor for construction and maintenance of work or to the society including its member.
Proper insurance shall be taken and copy shall be submitted to the society.
j. Contractor’s supervision: The Contractor shall provide all necessary and adequate
supervision during the execution of the work. The contractor shall prepare daily reports,
progress reports and activities charts as may be required by the society.
k. Housing of staff and workmen: The contractor shall at his own cost make suitable provision
for the housing of his staff and workmen outside of society premises.
l. Safety: Where work is been carried out above ground level and there is a possibility of injury
to person or property in case of anything falling, adequate precaution shall be taken to
prevent such injury by:
 cordoning of the danger area below and display of ‘KEEP CLEAR’ notices
 By the provision of safety net / platform adequate to catch anything that might fall.
Contractor shall enforce the use of safety appliances while working at heights by his
workmen, if anything is to be dropped deliberately from a height then in addition to
the other precautions, one man shall during the period of the Drop be posted outside
the danger area whose sole duty shall be to ensure that no person enters the danger
area.
 Contractor should ensure that the scaffolding for working at heights should be made
of the required quality of materials and erected properly and should be checked
regularly by a qualified supervisor and proper records of such checks are maintained.
m. Facility of other contractors: The contractor shall afford all reasonable facilities to any other
contractor employed by the society.

5. Duties and powers of the societies representative:
The duties of the society's representative are to watch and supervise the work and to witness tests,
take measurements, examine any materials to be used or the workmanship employed concerning
the works and issue any written instruction or approval given by the society to the contractor which
shall bind the contractor.
Any failure of the society’s representative to disapprove any work or material while the work is been
executed shall not prejudice the power of the society thereafter to disapprove such work or materials
or to do or to order the pulling down, removal of breaking up thereof of such unsatisfactory work at
a later stage if the same is found to be not as per the contract.
If the contractor shall be dissatisfied by the reason of any decision of the society he shall make
presentation in writing to the society who shall thereupon confirm, reverse or vary such decision, if
deemed necessary.

6. Execution of works:
a. Commencement of work: The contractors shall commence the work within 8 days or as
stated in the contract after receiving an order in writing to this effect from the society.
b. Compliance with the society’s representative: The society representative shall direct the
contractor in respect of the several parts of works to be executed from time to time in
accordance with the agreed program.
c. Alteration of the works: The society shall have right to alter, add or omit from or abandon
any part of the works. If any work, over and above that included in the contract is required
to be executed at site the contractor shall have no right to be entrusted with the execution
of such additional work unless informed in writing and Society shall have the right to appoint
any other contractor, if it is felt necessary.
d. Materials and workmanship: Except where otherwise specified contractor shall at his own
cost supply and provide all necessary construction equipment temporary works, material
both for temporary and for permanent works, labour transport to and from the site and in
and about the works and other things of every kind required for the completion and
maintenance of the works. The contractor shall be responsible for receiving and off-loading
all equipment, materials tools etc. delivered to the site.
e. Quality of materials and workmanship and tests: All materials and workmanship shall be of
respective kinds describe in the contract and in accordance with the instructions of the
society’s representative and shall be subjected to such tests as the society may direct at the
place of manufacture or on the side or at such places where such tests are carried out. The
contractor shall provide such assistance, instruments, machines, labours and materials as are
normally required for examining, measuring and testing any work and the quality of any
material used and shall supply samples of materials for testing before incorporation in the
works. The contractor at his own cost supply all samples. The cost of conducting any test
shall be borne by the contractor

7. Examination of the work before covering up:


No work shall be covered up or put out of view without the approval of the society. The contractor
shall give due notice to the society before covering of any work.

8. Removal of improper work and materials:
The society’s representative shall during the progress of the works have power to order in writing
a. Removal of any material from site which in his opinion are not in accordance with the
contract
b. Substitution of proper and suitable materials and proper re-execution of any work which in
respect of materials or workmanship is not in accordance with the contract

9. Compliance with labour regulations:


In respect of all persons directly or indirectly employed on the works, the contractor shall comply
with the labour the regulations made by the authorities as regards to payment of wages, working
hours, wage cards etc.

10. Maintenance and defect liability:


Period of maintenance: If it shall appear to the society, at any time during the progress of the works
or at any time prior to the expiration of the period of maintenance of such works that any works has
been executed with unsound, imperfect or unskilful workmanship or with materials of inferior
description/quality or that any materials provided by the contractor for the execution of the work
are unsound or of inferior quality to that contracted for, the contractor shall pulldown, take up or
take out the works so complained. The contractor shall rectify any defects caused or done due to
the use of inferior material or workmanship at his own cost.
If the contractor replaces or renews any portion of the work, the provision of this article shall apply
to the portion of the works so replaced or renewed until the expiration of 18 months or 2 monsoons
whichever is later from date of such replacement or renewal.

11. Insurance: The contractor shall take adequate insurance cover against damaged to the property
including his equipment, material and injury to any workers, supervisors employed by him or any
personal/ third party and shall provide due evidence of such cover when asked by the Society. The
contractor shall also be responsible for any other statutory requirements in regard to personnel in
the contractor’s employment The contractor shall be solely liable for any cost, claim, expenses
caused due to loss or damage of any nature rising out of or in connection with the execution of the
works not covered under any policies the society might have taken and shall indemnify the society
in respect of such claims, costs, expenses arising out of the execution of the works.

12. Force majeure: Force majeure shall mean any circumstances beyond reasonable control of the
contractor which prevent or impede the performance of the contract including but not limited to,
the matters listed below
 war of hostility
 riot or civil commotion
 Earth quack, flood, tempest, lightening or other natural disaster
 Accident, fire or explosion on the side not caused by the negligence of the contractor
 law or order of any government or government department which impedes or delays the work
 denial of use of any railway, port airport, shipping services and other means of public transport

a mere shortage of labour, materials or utilities shall not constitute force majeure unless caused by the
circumstances which are themselves force majeure. If either party to the contract is prevented or delayed
from in performing any of his obligation under the contract by force majeure then he shall notify the
other party of the circumstances constituting force majeure and specify the obligation, the performance
of which is thereby delayed or prevented and the party giving such notice shall thereupon be excused

for the performance notice under this provision and extra time for delay in completion can be given
within 7 days of commencement of such circumstances .

13. Contractors Default:


If the contractor shall fail or neglect to execute the works with due diligence and expedition, or shall
refuse or neglect to comply with any reasonable order given to him in writing by the society
representative in connection with the works or shall contravene the provision of the contract, The
Society representative may give notice in writing the contractor to make good such failure, neglected
work or contravention. Should the contractor fail to comply with the notice within the time specified in
the notice then the society shall be at liberty to get executed such part of work as the contractor may
have failed to do without prejudice to any other rights and the society may take the work wholly or
partly out of the contractors hands and shall get it executed at contractor’s risk and cost.

14. Termination:
a. Right of the society to determine and terminate contract:
The society shall at any time be entitled to determine and terminate the contract should in their
opinion the cessation of the works become necessary owing to paucity of funds or from any other
cause what so ever in which case the cost of approved material at the side and of the value of the
work done to date by the contractor shall we paid for in full at the rates specified in the contract. In
case of partial work, decision of society final to decide part rates.
b. Termination of contract owing to default of contractor:
If the contractor shall at anytime:
 becomes bankrupt or insolvent
 make an arrangement with or assignment in favour of his creditor or agree to carry out the
contract under inspection of a committee of his creditors or
 being a company or corporation go into liquidation or
 have an auction levied on his goods or property on the works or
 assign the contract or any part thereof otherwise than as provided in the general condition
of the contract or
 Persistently disregards the instructions of the society’s representative or contravene any
provision of the contract or
 failed to remove material from the site or pull down and replace any work after receiving
from the society a notice to the effect that the said material or work have been rejected
under the contract or
 failed to take steps to employ competent or additional staff and Labour and procure material
has required to complete the work as per contract.
 failed to afford the society proper facility for inspecting the work as required

Then in any of the said cases, the society may determine and terminate the contract after giving due notice
and time. The society shall be entitled after giving due notice in writing to remove the contractor from the
whole or any portion of the works without thereby avoiding the contract or releasing the contractor from
any of his obligations or liabilities under the contract and adopt any or several of the following courses:

i) Rescind the contract in which case the security deposit of the contractor shall stand forfeited
by the society, without prejudice to the society’s right to recover from the contractor any
amount by which the cost of completing the work by any other agency, shall exceed the value
of contract.

ii) Carry out the work or any part thereof by the employment of the required labour and
materials and to debit the contractor with such cost.
iii) Measure the work executed by the contractor and to get the remaining work completed by
another contractor at the risk and expense of the contractor. In the event of any several of
the courses referred above being adopted:
 The contractor shall have No claim to compensation for any loss sustained by him by
reason of his having purchased or procured any materials or entered into any
commitments or made in advance on account of or with view to the execution of the
works. Society shall be entitled to take possession of any materials tools machinery
and to retain and employ the same in further execution of the work without the
contractor being entitled to any compensation for the use and employment thereof
or the wear and tear or destruction thereof.

15. Variations :
a. Alteration addition and omission :
Society may make any variation of the form quality quantity or scope of the work or any part thereof
that may in their opinion be necessary and for that purpose or if for any other reason able it shall in
their opinion be vital/ essential/ desirable, they shall have power to order the contractor to do so
and the contractor shall do any of the following as agreed by the society in writing:
 increase or decrease the quantity of any work included in the contract
 omit any such work.
 change the character or quality or kind of any search work
 change level, lines, position and dimensions of any part of the work
 execute additional work of any kind necessary for the completion of the work.

No such variation shall in any vitiate or invalidate contract but the value, if any, of all such
variations shall be taken into account in ascertaining the amount of the contract sum.

b. Orders for variation:


No such variations shall be made by the contractor without an order in writing from the society .

c. Variation in quantities and value:


As the bill of quantities content estimated quantities and the nature of work being of rehabilitation
the contractor shall not claim any extra for any reduced variation in quantity. Society at the same
time may accept necessary edition in scope of work or quantities and shall make payments thereof.

d. Extra items:
all items not included in the bill of quantities are called extra items and shall not vitiate the contract.
The contractor shall inform the society of the extra work and submit rate analysis within five days of
the written order. The society shall have a right to reject any claim made by the contractor. No such
work shall be carried out without written consent of the society with due approval of additional
quantities and rates including mention of addition in budget and effect on overall budget.

16. Material quality:


All materials for incorporation into the work shall be of the best quality of their respective kinds as
specified herein and shall be obtained from sources and suppliers approved by the society and shall
comply strictly with the test prescribe herein after or where test are not laid down in this specification
with the requirement of the latest edition of the relevant Indian / international standards.
