MUNICIPAL RESOLUTION NO. 2020-05-153
ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 2019-01
“PRESCRIBING NEW TRICYCLE FARE RATE IN THE MUNICIPALITY OF
VIRAC AND FOR OTHER PURPOSES SUBJECT TO ALL EXISTING LAWS,
RULES AND REGULATIONS” BY PROVIDING ADDENDUM TO THE
PROCEDURE OF PRESCRIBING FARE RATES FOR THE OPERATION OF
TRICYCLES-FOR-HIRE IN THE MUNICIPALITY OF VIRAC, CATANDUANES
WHEREAS, in response to the Novel Corona Virus Disease (CoVid-19) pandemic, His
excellency President Rodrigo Roa Duterte through Proclamation No. 922, declared a State of
Public Health Emergency throughout the Philippines;
WHEREAS, in a subsequent proclamation dated March 16, 2020 (Proclamation No.
929), a state of calamity was declared throughout the Philippines due to Corona Virus Disease
that put the entire Luzon under enhanced community quarantine;
WHEREAS, on May 1, 2020, the Enhanced Community Quarantine has been lifted over
the province of Catanduanes and replaced with General Community Quarantine where the
operation of public transport has been allowed under limited capacity;
WHEREAS, there has been a widespread clamour among the transport sector and the
riding public of the prevailing practice of “negotiated fare”;
WHEREAS, there is a need to grant additional functions to the Office of the Municipal
Mayor relative to the determination of appropriate adjustments in tricycles fares during the
occurrence of calamities, disasters whether man-made or natural, and similar emergencies for the
local government to act resolutely to deal with the crisis;

WHEREAS, under Republic Act No. 7160 otherwise known as the “Local Government
Code of 1991”, Section 444, (b), (5) empowers the municipal mayors to “Exercise such other
powers and perform such other duties and functions as may be prescribed by law o ordinance.”
NOW THEREFORE, upon motion by Hon. Reynante B. Bagadiong, duly seconded by
all other councillors present, it was;

RESOLVED, to enact “AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO.
2019-01 BY PROVIDING ADDENDUM TO THE PROCEDURE OF PRESCRIBING FARE
RATES FOR THE OPERATION OF TRICYCLES-FOR-HIRE IN THE MUNICIPALITY OF
VIRAC, CATANDUANES”
Be it ordained by the Sangguniang Bayan in session duly assembled for the purpose:

ENACTING AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 2019-
01 BY PROVIDING ADDENDUM TO THE PROCEDURE OF PRESCRIBING
FARE RATES FOR THE OPERATION OF TRICYCLES-FOR-HIRE IN THE
MUNICIPALITY OF VIRAC, CATANDUANES
Section 1. A subsection is hereby added to Section 5 of the ordinance to be
read as follows:
“Section 5. Flexi-Fare-Rate.
Section 5a. Temporary Suspension of Fare Rates- In times of disaster,
calamity, epidemic, or any other similar circumstances when the government or
any of its agencies cannot function under normal situation, the Municipal
Mayor, through an Executive Order, may temporarily suspend for a period not
exceeding six (6) months or unless such state of disaster, calamity, epidemic or
similar circumstances been lifted, the implementation of existing fare rates and
adjust it to the attune to the needs of the time.
Section 2. Section 6 of the Ordinance is amended to be read as follows:
“Section 6a.
Section 6b. Collecting more than the prescribed fare rates unless
consented to by the concerned passenger.”

Section 3. Repealing Clause. All existing provisions of ordinance inconsistent
with the provisions of this ordinance is repealed, amended or modified
accordingly.
Section 4. Separability Clause. If any reason or reasons, any part or provision
of this ordinance is declared invalid or unconstitutional, any part or provision
not affected thereby shall remain in full force and effect.
Section 5. Effectivity Clause. This ordinance shall take effect immediately
upon approval.
RESOLVED FINALLY that copies of this resolution-ordinance be transmitted to the
Sangguniang Panlalawigan for its review and approval and be furnished the honorable Mayor
Sinforoso M. Sarmiento, Jr. for approval, the Punong Barangays of Virac and the Federation of
Virac Tricycle Operators Association (FEDVITODA), for information.
