“RENT AGREEMENT”
This Rent Agreement is made at Noida on this day of 17𝑡ℎ Feb 2024
between
MR. Varun Gandhi and Mrs. Kinni Gandhi W/O Mr. Varun Gandhi,
R/O - B-142, DLF Oakwood estate, DLF Phase 2, Gurugram, Haryana
-122002 OF the first party (hereinafter called the FIRST PARTY
LESSOR/OWNER).
AND
Miss. Meena Adhikari D/O Mr. Kundan Singh Adhikari, R/0 -Jamoli
Bhikyasain, Jamoli, Jamoli, Almora, Uttarakhand- 263667
Miss. Rekha Adhikari D/O Mr. Kundan Singh, R/0 -
Jamoli(dharbakhali), Jamoli, Almora, Uttarakhand- 263667
On the other party (hereinafter called the LESSEE/TENANT).
(The words and expressions lesser and the lessee shall mean and
include their legal representative, authorised agents,assignees, successor
and legal heirs respectively).
WHEREAS the LESSOR is the absolute owner and in possession of
Residential Tower no.06 flat no-703, in The 3C LOTUS ZING
Sector-168, Noida, [Link] Budh Nagar,U.P. 2 BHK, along
with the fittings and fixtures, hereinafter referred to as the
property,
AND WHEREAS on request of the Lessee, the Lessor aforesaid has agreed to
let out the premises for Residential purpose for a period of 11 months. And
whereas the Lessee / second party have agreed to execute and sign
this deed of rent agreement/lease deed, as per terms and conditions
mentioned below: -
NOW THIS LEASE AGREEMENT WITNESSETH AS UNDER:-
1. That the term tenure of the lease of the said premises would be for
11 months beginning from 18th Feb 2023, and the lease will
expire after 11 months. For the extension of lease for next 11
months based on mutual consent between both the parties,
however the rent shall be increased by 10% if extension is mutually
agreed upon.
2. The monthly Rent Rs - 21,000/- (Rupees Twenty one Thousand
Only) Excluding maintenance charges respect of the aforesaid
premises shall be paid every month in advance by the Lessee to
Lessor on or before 23rd day of each English Calendar month.
3. If in case where the lessor has paid advance to FM then the
same amount as shown in the monthly invoice may be paid by the
lessee to the lessor to the extent of the advance adjusted by FM.
4. That the Lessee shall pay an amount of RS. 21,000/- (Rupees
Twenty one Thousand Only) Excluding maintenance as interest
free security deposit to the Lessor at the time of executing this
agreement which shall be refundable at the time of expiry of lease
and on handing over peaceful possession of the premises to the
Lessor. The said security deposit shall be refunded after adjusting
any dues / bills / damages etc.
5. The Lock in of Six Months is applicable on the rent and security of the
apartment.
6. That Rent Agreement shall expire after 11 months. For the extension
of lease for next 11 months based on mutual consent between
both the parties, however the rent shall be increased by 10% if
extension is mutually agreed upon.
7. That the Lessee shall use the demised premises for Residential
purposes for himself and his family only.
8. That the LESSEE (Tenant) shall not create any kind of nuisance in the
demised property and the Locality and shall abide by the rules,
regulations and by - laws of the concerned locality, authority.
9. That the LESSEE shall pay electricity (power and light) & water bills,
club charges & PNG(IGL) for the premises according to the actual bills
of the Local Authorities/Builder directly from the date of
occupation and till the date of handing over the possession to the
LESSOR. In the event of non-payment, the LESSEE shall be
liable for all costs, expenses and penalties for such defaults.
10. The Lessor has already provided a separate electricity meter for
the said premises. The original receipt of the water, gas (PNG)
and electricity charges paid by the Lessee shall be handed over
to the lessor every month after making such payments.
11. That in case the Lease rent, dues of the gas electricity and water etc.
are not paid regularly by the due date,the penalties or
additional charges arising from such delays and demanded by
the concerned authority shall be paid by the LESSEE and the
lease deed can be terminated by the Lessor even before the
expiry of the lease period and lease rent can be recovered
through court of law along with compensation, interest and
expenses/mental tensions/losses incurred to recover the same
through court of law.
12. That If the Lessor wants to vacate the said premises then the
lessor will give one month notice to the lessee. Similarly if the lessee
wishes to vacate the said premises, the lessee shall inform the
lessor one month prior to the date of vacating the premises.
13. That the lessee shall vacate the premises after clearing all the rental
arrears along with other bills and will handover the vacant possession
of the said premises to the Lessor. If the Lessee vacates the flat
before Six months then he/she will not get a refund of the
security amount from the lessor.
14. The Lessor will ensure that all the furnishing and electrical Items are
in good and working condition while giving the handover to Lessee.
15. That the original of this agreement will be retained by the lessor.
16. That the lessee shall not make any structural additions in the
said premises of the lessor but can install air conditioner & air
cooler by prior information and consent of the lessor and as
approved by the maintenance department of the society.
17. That the lessee shall not sublet or assign the premises in part
or whole under any circumstances to any other party or person.
18. That the Lease Agreement can however be terminated by the Lessor
one month's notice & Lessee on one month's notice. In case
the premises are vacated without any advance notice one
month's rent shall be payable in lieu of the notice period or shall be
adjusted from the security deposited by the Lessee.
19. That on the expiry of the lease period, the Lessee shall handover
peaceful and vacant possession of the said premises to the Lessor
with all the fittings and fixtures intact therein in the same good
working conditions/order as the Lessee received it.
20. That the Lessee shall peacefully permit either Lessor or his
representative to enter the premises at all the reasonable times
in order to examine the state and condition.
21. That both the Lessor and the Lessee will be bound with the terms and
conditions of the Rent Agreement. The Lessor will install a geyser
in the apartment in the coming winter season in the month of
November.
22. This Rent Agreement can be renewed with the mutual consent of both
the parties and after the enhancement of 10% or as per market rate
in the existing rent of this rent agreement. Otherwise this rent
agreement will automatically stand cancelled/terminated.
23. That all disputes related to this rent agreement are subject to the
Jurisdiction of the courts in [Link](U.P.).
IN WITNESS WHEREOF;BOTH THE LESSOR AND THE LESSEE HAVE
SET THEIR RESPECTIVE HANDS TO THIS RENT AGREEMENT,AT
NOIDA FIRST ABOVE MENTIONED IN THE PRESENCE OF THE
