Subject: Implementation of order dated 11-02-2006 passed in
SWP No 3000/2010 titled Azad Hussain and Ors V/s
State and Ors.
Sir/Madam,
Instructed by Mohd Yousif S/o Nazeer Hussain R/o Dhangri
Rajouri presently working as inspector in the office of Deputy
Registrar Cooperative Societies Jammu, hereinafter referred to
as my clients, I am to serve upon you the following legal
notice:-
1. That the Honble JK High Court at Jammu in terms of order
dated 11-02-2006 directed as under –
“considered. Admitted.
Post admission notice waived by counsel for the
respondents 1 to 3 and 6. Notice to respondents 4 and 5
returnable within 3 weeks.
Meanwhile interim direction to continue. It is, however,
made clear that respondent No. 6 Mr. Mohd Yousuf shall
be paid the salary for the post against which he is
presently working.”
Copy of the order dated 11-02-2006 is enclosed for your
perusal.
2. That the said order was not complied with which compelled my
client to file CPSW No 51/2019 titled Md Yousif v/s Ab Majid
Bhatt and Ors which is pending disposal in the Honble High
Court however due to the retirement/transfer of the
incumbents, I am serving upon you, order dated 11-02-2016
for compliance. My client is entitled to be paid the salary of the
post of inspector which position has been admitted by Deputy
Registrar Cooperative Societies J&K in terms of letter No.
DRR/ADM/439-40 dated- 24-11-2022. Copy of the same is
addressed to worthy Addl. Registrar Cooperative Societies J&k.
I therefore accordingly on behalf of my clients
through the medium of this notice request you to
implement and comply order dated 11-02-2016 in letter
and spirit within a period of 2 weeks from the date of
receipt of this notice failing which my client shall be
compelled to substitute all the incumbents in CPSW
51/2019.
A copy of this notice is retained in my office chamber for reference and record.
