CONDITIONS OF CONTRACT
1. The quote sent out by Contractor acts as an integral part of this contract.
2. Any payments made via Credit Card or Debit Card will carry a processing fee (Between 2.6% - 3.5%).
3. Any deposits made are deducted off the total price of the contract, but non refundable in the case of cancelation.
4. Contractor will not hold the client liable for any damages, claims, actions, costs, expenses and fees as a result of an injury due to reasons not caused by
Client.
5. Client gives the contractor permission to use water for any installation services that may require water.
6. Contractor shall carry general Liability and Property Damage insurance in such amount as may be required by Contractor.
7. Contractor shall not be responsible for damage to any part of the pool structure, equipment or other installations resulting from natural causes (including, but
not limited to; earthquake, ground swells, inundation, landslide, flood, wars, riots, poor water drainage, property flooding, etc.). The Contractor shall also not
be liable for damage caused by the Client or their agents (family, friends, etc).
8. Contractor shall not be liable for delays in start date or completion caused by, but not limited to; strikes, war, weather, pandemics, other contractors, delays
caused by Client or delays caused by suppliers - which are beyond the control of this contractor. Contractor shall with due diligence proceed to start the
project in a timely manner.
9. Change orders may be confirmed via text, email, or any other digital communication as long as both parties agree to changes in scope of work and
payments. Change orders must also be paid for at the time of agreement, not after.
10. Client agrees and understands that all materials are manufactured products and the dimensional specifications provided are those of the manufacturers.
Client agrees to hold Contractor harmless for variances in any material specifications.
11. Discoloration is a natural process that happens to materials over time. Client agrees to hold Contractor blameless for any discolouration in any materials.
Sealants should be applied & installed regularly, if possible, to protect materials.
12. Contractor shall not be held liable for work performed or equipment/materials supplied by any subcontractor / other party who has not been contracted by the
contractor. Hiring any other contractor to finish any portion of the mutually agreed upon “Scope of Work” will constitute in a breach of contract, thus voiding
any and all warranties.
13. Title and ownership to all equipment, accessories & installations described within this contract, whether affixed to the Client’s realty or not, shall remain the
property of the Contractor until the price agreed upon (according to the terms of the contract) has been paid in full.
14. If said price is not paid in accordance with this contract, the Contractor may, without notice, enter the premises of the Client and repossess said equipment
accessories, materials, etc. Any said entry shall not be classified as trespassing, as the client gives the contractor legal rights to enter the premises to
repossess any & or all equipment, materials, etc. Contractor, at their discretion, may elect to proceed against the Client for the balance of the unpaid fees +
cost of collection. If client decides to pay remaining balance on contract, Contractor shall return to re-install equipment, accessories, materials, etc at an
hourly rate that is seen fit by the contractor.
15. Contractor also reserves the right at any time to stop work until past due payments (according to the payment schedule of this contract) are brought up to
date. Such work stoppage shall not constitute grounds for any breach of contract. Before resuming work because of lack of payment, the full amounts of the
entire contract shall be due and payable. If collection is required, Client shall be responsible for legal interest and attorney fees. If client misses a payment
deadline, Contractor may also cancel the contract.
16. If weather (snow, flood, etc), or other unforeseen circumstances (pandemic, war, etc) cause a delay in work completion - client agrees to pay the portion of
work completed by the contractor up to that point. Failure to do so will result in a breach of contract.
17. Contractor can not add water to the pool or install the pool’s finish until city officials pass the pool enclosure permit. If anyone other than the contractor is
doing the fence - then the final invoice must be paid in full. The contractor also agrees to come back and install the pool’s finish + fill with water as soon as the
fence is put up and installed.
18. Client agrees to hold Contractor blameless for any installations or damages caused by any other specialty / licensed contractors (examples include, but not
limited to: Electrician, HVAC, Gas, Etc.)
19. Contractor shall not be held responsible for damage to patios, driveways, lawns, trees, plants, shrubs, fences, sprinkler systems or sewers which result
from normal ingress and egress to the job site by trucks and equipment. Preventative measures will be initiated (plywood to drive over, using different routes,
etc) but damage may still occur.
20. Client shall not be responsible for site preparation, including removal of trees or other vegetation and removal of pipelines or other infringements unless
mutually agreed upon (“demolition” selected in Scope of Work).
21. The Client holds harmless and indemnifies the Contractor for any installation damages caused by subsoil conditions (Quicksand, Oversaturated Wet Clay,
etc) or roots.
22. If poor subsoil conditions are present, Contractor may over excavate in an attempt to amend & strengthen sub soils. Said change order will need to be
approved by both parties.
23. If bedrock, concrete, boulders, or any other materials aside from soil, sand or clay are found while excavation, client agrees to pay for any additional time,
labour & disposal fees.
24. Contractor or client reserves the right to cancel the contract if unstable soil conditions are found at the time of excavation. Clients will pay contractors costs
(time, material + labour) on the job incurred to that point.
25. The Client holds harmless and indemnifies the Contractor for any installation damages or failures caused by improper workmanship done by anyone except
for Contractor.
26. Any increase in material cost caused by factors such as (but not limited to); shortages, inflation pandemics,, etc, will be covered by client.
27. Unless expressly specified otherwise (‘fencing’ selected in Scope of Work), this contract does not provide for fencing, alarms or other means of limiting access
to the backyard. Client is responsible for complying with all laws and code requirements governing any installations done by contractor.
28. If the municipal government requires any additional security deposit for permits, client agrees they will pay said total on their behalf - even if not stated in
quote price.
29. Client shall not encumber or sell the property during construction.
30. Client agrees to hold Contractor blameless for any of the following
a. Injury to anyone in or outside the area of construction
b. Damage to the property anywhere the Contractor is not servicing
c. Damage to any of the following, but not limited; underground wires, conduit, plumbing, etc, not marked out by the City or private locators

WARRANTY
Contractor warrants, to the original Client, that its work will be installed correctly & built to last. Contractor does not provide warranty on any other service not
directly mentioned below.
Pool Installation:
Contractor will provide a lifetime warranty on the structural workmanship which strictly includes pool structure. Pool structure warranty includes protection
against the walls cracking, breaking or caving in. If there is any clear evidence of tampering (including, but not limited to; heavy machinery near the pool,
improperly draining pool, etc) Contractor is not obligated to fulfill warranty requirements. Warranty on return fittings, main drains, lighting, spill way’s & bubblers
are not covered due to the potential of someone damaging them. Contractor advises Client (or their friends, family, children, etc) to avoid stepping on or
tampering with ‘eyeball/jet return fittings’ (where water returns to pool, commonly known as jets), main drains (where water gets sucked from the pool), skimmer,
pool lights, water features, pool equipment, plumbing, etc as they were not designed to be stepped on or tampered with.
Contractor will provide the client with a sump tube located in the deep end to be able to check the underground water levels. Contractor will also provide the
client with a sump pump, which must be used periodically to drain said sump tube.
Monthly water testing must also be done and data saved in order to prove that water chemistry was met correctly. Failure to maintain proper water balance may
result in pool irregularities, and/or damage.
Failure to check & maintain recommended underground water levels in the sump tube will also void warranty - as the sump tube is designed to be drained
periodically to relieve any hydrostatic pressure from building up underneath and around the pool.
If Client uses any company/person except for contractor (or those recommended by contractor) to winterize or open their pool - any warranty provided by
Contractor may be voided.
Digging around the pool or tampering with the backfill will also void any warranty.
If client drains the pool or hires someone else to drain the pool for whatever reason - warranty may also be voided.
Paver Installation
Contractor provides a 7 year paver warranty strictly covering settlement of pavers. Contractor does not provide warranty against discoloration, erosion, edging,
scratching, chipping or any other aesthetic asides from settlement. Settling of pavers is described as the following; a 1.5” sag over the span of 3 feet.
Settlement of pavers will not be warrantied if:
a) Heavy Duty Trucks (1 Ton trucks or more) or machinery are driven over driveways
b) Any vehicle or machine is driven over walkway, patio, or any other surface excluding driveways
