A revised version of Practice Direction CA06 came into effect on June 1st 2022 a copy of which is available on
the Courts website [Link].
In the event that the books are not lodged within the time fixed, the appeal shall be relisted in the next
directions list in the Court of Appeal for mention. If the books are not lodged by the latter date, the Court may
make an order extending the time for the late filing of the books of appeal for such short period as it deems
appropriate subject to an order that the appeal shall stand struck out for failure to comply with the directions of
the court. In the event of a failure to comply with such order the appeal shall be struck out. Where an appeal is
listed in the directions list by reason of the foregoing, the party in default may be liable for the costs arising
from attendance at the directions list.
Parties should lodge the books of appeal (including the books of authorities) in hardcopy (x 4) and also in soft
copy via the ShareFile platform.

Tuesday.
Parties will be aware that the purpose of the Callover is to confirm that the submissions and books of appeals
(including books of authorities) have been lodged, and that there has been compliance with any other directions
previously given by the Court. It is vital therefore that there be an attendance at the Callover by all parties to an
appeal.

basis to confirm that there is a list scheduled on a Friday where a matter is required to be listed for case-management.
The court office will also be able to confirm the dates of such lists.

VIRTUAL MEETING ROOM (VMR) DETAILS FOR FRIDAY LISTS - IMPORTANT
Parties are asked to note that the Virtual Meeting Room (VMR) details for the Case Management List on each Friday will
be furnished to them directly by e-mail from the Court of Appeal Office on the Tuesday preceding the Friday listed.
Parties are advised, in this regard, to ensure that e-mail contact details furnished to that Office remain valid /are fully up
to date. Any party may attend the Court physically.
DELIVERY OF JUDGMENTS
Judgments are delivered physically in the Courtroom and parties will be notified prior to the date.
Written judgments of courts may be delivered electronically if directed by the Court and in such cases will be delivered
by means of a copy of the judgment being sent electronically to the parties and a copy, subject to such redactions as
would ordinarily apply, being posted as soon as possible on the Courts Service website. The date and time of delivery will
be notified to parties. The parties may be invited to communicate electronically with the Court on issues arising (if any)
out of the judgment such as the precise form of order which requires to be made or questions concerning costs or they
may be requested to attend physically to address the Court on these issues. If there are such issues and the parties do not
agree in this regard concise written submissions should be filed electronically with the Office of the Court of Appeal by
emailing courtofappealcriminal@[Link] within 14 days of delivery subject to any other direction given in the
judgment.
Chief Prosecution Solicitor – service of documents and notification of any intended application
Practitioners are reminded of the requirement to serve on the Chief Prosecution Solicitor for the Director of Public
Prosecutions written submissions lodged in or transmitted via email to the court office. Except for the documents referred
to in Order 86C Rule 7 (1) (a notice of appeal or a notice of application pursuant to section 2 of the Criminal Procedure
Act 1993) and in Order 86C Rule 15(1) (a notice of abandonment) notice of which the Registrar is required to give to
various parties including the Chief Prosecution Solicitor all other documents lodged in or transmitted via email to the
court office must be served on the Chief Prosecution Solicitor. Notice of any intended application to the Court must be
given to the Chief Prosecution Solicitor as well as to the court office.

DELIVERY OF MOTION PAPERS IN ALL COMMON LAW LISTS
A paginated and indexed booklet of motion papers in respect of all motions is required to be lodged no later
than 4.30 pm on Thursday 18th April 2024 for both physical and hybrid hearings. Failure to do so will lead to
the motion being adjourned.
The booklet of motion papers for all four parts of the Common Law List must be in an envelope clearly marked
with the wording “Common Law List Monday 22nd April 2024”. This should be delivered to the List Room
which is situated on the Ground Floor of the Four Courts Building (beside the Central Office).
Please email listroomhighcourt@[Link] to make an appointment to lodge the papers. Please indicate in that
email the name of the person who will deliver the booklet of motion papers.
When a matter has been dealt with (an Order made or motion adjourned), the papers must be collected from the
List room by Wednesday noon by emailing listroomhighcourt@[Link]. Papers will not be retained in any
circumstances.
The Virtual Courtroom Number and relevant instructions for practitioners will be made available to members
shortly through the Law Society of Ireland and the Bar of Ireland websites
Please note that as per the direction of The President of the High Court dated the 8th day of July 2021
(HC 108), the Practice Direction HC 89 (emailing Consent Orders relating to the Common Law List) has
been discontinued.
Applications to adjourn motions on consent and applications for Orders on Consent will be dealt with remotely
at 10.30 o'clock by the Registrar in the Court to which the lists are assigned.
On the day, parties are requested to advise the Court of any Motion where the hearing of which is likely to
exceed 15 minutes. Any Motion which is likely to exceed 15 minutes but less than 30 minutes will be
considered for transfer to the Non-Jury List to get an appropriate hearing date or subject to the management of
the list will be dealt with on the Monday in the Common Law List.

Parties in Asylum, Immigration and Citizenship List hearings should note that the Tuesday deadline supersedes
the deadline for lodgement of papers for hearings included in in Asylum Practice direction HC81.
Any application for late lodgement of papers must be made to the List Judge at the callover on the Thursday of
the week prior to the Hearing date.

Correspondence to the registrars/mailbox/Judicial Assistant seeking permission for the late lodgement of papers,
requests to change the mode of hearing or applications to re-instate hearings that have been struck out will not be
acknowledged. No additional/missing documents will be accepted by email. Any further applications must be
made to the Court at the end of the list any day.
Papers for hearings will not be returned and will be shredded. They must be re-lodged prior to any new hearing
date.
5. Judicial Review and Asylum- Applications to Open and Adjourn (to stop time)
Applications to open a Judicial Review for the purposes of stopping time only can be made at the end of the list
any day, provided the case has been issued by the Central Office and a record number has been obtained.

Ex Parte Applications
Moving parties are required to email the Registrar at chancery@[Link] in advance with a soft copy of the papers
for the Judge no later than 10.00 a.m. on the morning of any intended ex parte application. Hard copy papers
should be lodged with the Registrar in Court by 10.30 a.m. Such applications are not listed in advance. The
original stamped Ex Parte Docket should be handed to the Registrar in Court. A hard copy draft Notice of Motion
should be brought to Court where an order for short service may be made.
Matters appearing in the Monday list are not ready for hearing unless the Court has been furnished with papers.
These hard copy papers are to be lodged by appointment in the List Room (not the Central Office) by 2 p.m. on
the Thursday preceding the Monday List where the application is to be opened. Papers should include a
paginated, bound and indexed booklet of motion papers clearly marked ‘Chancery Motions 1’ and be compliant
with all relevant Practice Directions.

The Court / List Room does not retain papers for matters adjourned in the List. Papers are returned to the
List Room for collection within a week, and not retained thereafter. It is for practitioners, and in particular the
moving party, to ensure that papers were lodged (or re-lodged) the week preceding any application to the Court.

Adjournment Applications
All applications for adjournments (including adjournments on consent) must be made to the Judge.
Where a motion is likely to exceed 15 minutes an application must be made to the Judge to transfer to a List to
Fix Dates (heard each Friday during term). When applying, practitioners should be able to advise the Court
whether the affidavits are closed and if the matter is ready for hearing and to give an estimate of how long it is
likely to take to hear. The Registrar can deal with consent applications.
Default of Pleading
Practitioners should note the changes to the Rules of the Superior Courts with regards to default of pleading
applications. Some consent orders are no longer permitted; e.g. extensions of time for delivery of Defence can
only be made for a stated reason and there is a requirement to file a Defence in the Central Office where an
extension is granted. Consent orders not compliant with the rules cannot be made. Applications for Unless
Orders, including consent applications, must be made to the Judge.
For anyone who is a party to a case before the High Court and who does not have legal representation, please

Pursuant to S.I. No.418/2011 - Finance (Transfer of Departmental Administration and Ministerial Functions)
Order 2011 the Respondent in all Garda Compensation Special Summons is now the Minister for Public
Expenditure and
Reform. The effective date of this Order is 29th July 2011. References to the Minister for Finance shall from
the commencement date of this order be construed as references to the Minister for Public Expenditure and
Reform. New Summons issued in Garda proceedings should name the Minister for Public Expenditure and
Reform as the Respondent.
Garda Compensation Special Summons are made returnable to the Master's List for purely procedural reasons.
They are not called in the master's list and there is no need for practitioners to attend in respect of the listing.
The practice is that all such cases are automatically transferred to the Garda Compensation list.
The High Court Garda list deals only with applications under 1941 Act.
Once automatically transferred into the Garda Compensation list, the summons will sit in the list until such time

than the Tuesday of the week prior to the Hearing date. (Please note, this deadline does not apply to the

Parties in Asylum, Immigration and Citizenship List hearings should note that the Tuesday deadline supersedes
the deadline for lodgement of papers for hearings included in in Asylum Practice direction HC81.

SEPTEMBER PILOT PROJECT
All cases listed for hearing in September 2024 will be listed for mention on 29 July 2024. All schedules of
directions must require the completion of all papers, submissions and the statement of case, uploading of
authorities and the full population and organisation of the ShareFile Folder, by the very latest deadline of 24 July
2024, with a strict requirement on all parties to contact the List Registrar to re-list the matter before then if there
is any slippage in compliance with any directions that is likely to affect compliance by that deadline. In view of
the longer than usual term for the List commencing in September, 2024, it is envisaged that writing weeks will
be synchronized for the week of Tuesday 29 October 2024, so that it is not anticipated that cases would be listed
for substantive hearing that week
