APPEALS FOR HEARING

All Appeals are heard by way of a physical hearing unless otherwise directed by the Court.

A revised version of Practice Direction CA06 came into effect on June 1st 2022 a copy of which is available on
the Courts website [Link].

LODGING OF BOOKS OF APPEAL

Parties are required to lodge complete books of appeal (in hard and soft copy) not later than 4 weeks prior to the
date of the appeal in accordance with Practice Direction CA06 or such other date as shall be fixed by the Court.
This must include the transcript of the DAR or approved note of the judgment of the High Court where
appropriate and a joint book of authorities. A party who has been authorised to file the books of appeal may file
An Dialann Dleathach – Cásanna An Lae Inniu Dé Luain 22ú Aibreán 2024
The Legal Diary – Today’s Cases Monday 22nd April 2024
the books in accordance with this direction notwithstanding the failure of another party to the appeal to furnish
its written submissions to such party for inclusion in the books of appeal.

In the event that the books are not lodged within the time fixed, the appeal shall be relisted in the next
directions list in the Court of Appeal for mention. If the books are not lodged by the latter date, the Court may
make an order extending the time for the late filing of the books of appeal for such short period as it deems
appropriate subject to an order that the appeal shall stand struck out for failure to comply with the directions of
the court. In the event of a failure to comply with such order the appeal shall be struck out. Where an appeal is
listed in the directions list by reason of the foregoing, the party in default may be liable for the costs arising
from attendance at the directions list.

Parties should lodge the books of appeal (including the books of authorities) in hardcopy (x 4) and also in soft
copy via the ShareFile platform.

A revised version of Practice Direction CA06 came into effect on June 1st 2022, a copy of which is available
on the Courts website, [Link].

DIRECTIONS LIST AND MOTION LISTS

From 12 January, 2024 the weekly directions and motions lists before Ms. Justice Costello will no longer be
conducted routinely by way of hybrid hearing in Court of Appeal Court 1, Old Public Records Building, The
Four Courts. This means that all parties must attend in person, save where the court directs otherwise.

In accordance with provisions of Order 86A Rule 16(1) the directions book is to be lodged in the office by close
of business on the preceding Friday. In accordance with the provisions of Order 86 Rule 12(5) (dealing with
interlocutory applications) the motion book is to be lodged in the office by close of business on the preceding
Tuesday.

FRIDAY CALLOVER OF APPEALS LISTED FOR HEARING

From 12 January, 2024 the weekly advance Callover of appeals listed for hearing are conducted in person
before Ms. Justice Costello unless otherwise directed by the court. The Callover lists for each respective Friday
list are published in advance in the Legal Diary. The Legal Diary list is updated on a daily basis. It is the
responsibility of the parties in listed appeals to check the Legal Diary for the date of the relevant Callover
(usually scheduled for six weeks in advance of the appeal hearing date).

Parties will be aware that the purpose of the Callover is to confirm that the submissions and books of appeals
(including books of authorities) have been lodged, and that there has been compliance with any other directions
previously given by the Court. It is vital therefore that there be an attendance at the Callover by all parties to an
appeal.

VIRTUAL MEETING ROOM (VMR) DETAILS FOR FRIDAY LISTS - IMPORTANT

Parties are asked to note that the Virtual Meeting Room (VMR) details for the Callover / Directions / Motion
list on each Friday will no longer be furnished unless directed by the court. If any party is unable to attend in
person, they may apply to the Office of the Court of Appeal for leave to appear remotely for a decision by the
judge in charge of the list, which application should be supported by a medical report which details the medical
reasons why the party concerned is unable to attend in person. Without prejudice to the foregoing, the court
may in any case for good and sufficient reason permit a party to appear remotely.

COURT OF APPEAL ORDERS

Due to the recent upgrade to the High Court case management system, it is not currently possible to view when
Court of Appeal Orders are perfected on High Court Search.
Please email courtofappealcivilorders@[Link] for updates on the perfection of Orders.

DELIVERY OF ELECTRONIC JUDGMENTS

An Dialann Dleathach – Cásanna An Lae Inniu Dé Luain 22ú Aibreán 2024
The Legal Diary – Today’s Cases Monday 22nd April 2024
Written judgments of courts may be delivered by means of a copy of the judgment being sent electronically to
the parties and a copy, subject to such redactions as would ordinarily apply, being posted as soon as possible on
the Courts Service website. The date and time of delivery to the parties will be notified in the Legal Diary.
The parties may be invited to communicate electronically with the Court on issues arising (if any) out of the
judgment such as the precise form of order which requires to be made or questions concerning costs or they
may be requested to attend physically to address the Court on these issues. If there are such issues and the
parties do not agree in this regard concise written submissions should be filed electronically with the Office of
the Court, courtofappealciviljudgment@[Link], within 14 days of delivery subject to any other direction
given in the judgment.
CIVIL APPEALS FOR HEARING IN THE CRIMINAL COURTS OF JUSTICE
Civil appeals with a custody element i.e. Article 40 habeas corpus, extradition, bail and judicial review arising
out of criminal proceedings are now dealt with by the criminal office which is situated on the 4th Floor of the
Criminal Courts of Justice Building, Parkgate Street, Dublin 8. The civil office will continue to issue the Notice
of Appeal and identify whether the appeal comes within the category of appeal to be heard in the Criminal
Courts of Justice and allocate the next available case-management list in the Criminal Courts of Justice for a
directions hearing. The file will then be transferred to the criminal office and all subsequent documents in the
appeal process are to be lodged in the criminal office which will have responsibility for the management and
listing of the appeal. Any enquiries in relation to such appeals should be made to the criminal office by email
to courtofappealcriminal@[Link] or by telephone on (01) 7988004.

APPEALS FOR HEARING

All Appeals are being conducted by way of a physical hearing unless otherwise directed by the Court.

LODGING OF DOCUMENTS FOR CRIMINAL APPEAL HEARINGS

Parties are required to lodge all document pertaining to criminal appeal hearing not later than 2 weeks prior to the hearing
date.

LODGING OF BOOKS OF APPEAL (CIVIL APPEALS ONLY)

Parties are required to lodge complete books of appeal (in hard and soft copy) not later than 4 weeks prior to
the date of the appeal in accordance with Practice Direction CA06 or such other date as shall be fixed by the
Court. This must include the transcript of the DAR or approved note of the judgment of the High Court
where appropriate and a joint book of authorities. A party who has been authorised to file the books of
appeal may file the books in accordance with this direction notwithstanding the failure of another party to the
appeal to furnish its written submissions to such party for inclusion in the books of appeal.

In the event that the books are not lodged within the time fixed, the appeal shall be relisted in the next directions list in the
Court of Appeal for mention. If the books are not lodged by the latter date, the Court may make an order extending the
time for the late filing of the books of appeal for such short period as it deems appropriate subject to an order that the
appeal shall stand struck out for failure to comply with the directions of the court. In the event of a failure to comply with
such order the appeal shall be struck out. Where an appeal is listed in the directions list by reason of the foregoing, the
party in default may be liable for the costs arising from attendance at the directions list.

Parties should lodge the books of appeal (including the books of authorities) in hardcopy (x 3) and also in soft copy via
the ShareFile platform.

A revised version of Practice Direction CA06 came into effect on the 1st day of June 2022, a copy of which is
available on the Courts website, [Link].

CIVIL APPEALS FOR HEARING IN THE CRIMINAL COURTS OF JUSTICE

Civil appeals with a custody element i.e. Article 40 habeas corpus, extradition, bail and judicial review arising out of
criminal proceedings are now dealt with by the criminal office which is situated on the 4th Floor of the Criminal Courts of
Justice Building, Parkgate Street, Dublin 8. The civil office will continue to issue the Notice of Appeal and identify
whether the appeal comes within the category of appeal to be heard in the Criminal Courts of Justice and allocate the next
available case-management list in the Criminal Courts of Justice for a directions hearing. The file will then be transferred
to the criminal office and all subsequent documents in the appeal process are to be lodged in the criminal office which
will have responsibility for the management and listing of the appeal. Any enquiries in relation to such appeals should be
made to the criminal office by email to courtofappealcriminal@[Link] or by telephone on (01) 7988004.

Sentence appeals and undue leniency applications

See Practice Direction (CA02) for requirements as to materials (reports, testimonials etc) for the use of the court in
sentence appeals and undue leniency applications. Practitioners are urged to ensure that any such materials are furnished
to the court office at least two weeks in advance of the remote hearing date to facilitate the transmission of the materials
to the Court. Practitioners are also reminded that there is no necessity to apply to Court for the preparation of a
Governor’s Report or an Educational Report so that such Reports are available in the event of the Court finding an error
in principle in the sentence imposed by the court of trial. On receipt of an email to the court office (in good time in
advance of the hearing date) specifying the nature of the Report required, the date of the appeal hearing and the prison
where the appellant or respondent (as the case may be) is incarcerated the office will request the required Report from the
relevant prison.

Chief Prosecution Solicitor – service of documents and notification of any intended application
Practitioners are reminded of the requirement to serve on the Chief Prosecution Solicitor for the Director of Public
Prosecutions written submissions lodged in or transmitted via email to the court office. Except for the documents referred
to in Order 86C Rule 7 (1) (a notice of appeal or a notice of application pursuant to section 2 of the Criminal Procedure
Act 1993) and in Order 86C Rule 15(1) (a notice of abandonment) notice of which the Registrar is required to give to
various parties including the Chief Prosecution Solicitor all other documents lodged in or transmitted via email to the
court office must be served on the Chief Prosecution Solicitor. Notice of any intended application to the Court must be
given to the Chief Prosecution Solicitor as well as to the court office.

A paginated and indexed booklet of motion papers in respect of all motions is required to be lodged no later

NOTES ON THE OPERATION OF THE LIST

Ex Parte Applications

Moving parties are required to email the Registrar at chancery@[Link] in advance with a soft copy of the papers
for the Judge no later than 10.00 a.m. on the morning of any intended ex parte application. Hard copy papers
should be lodged with the Registrar in Court by 10.30 a.m. Such applications are not listed in advance. The
original stamped Ex Parte Docket should be handed to the Registrar in Court. A hard copy draft Notice of Motion
should be brought to Court where an order for short service may be made.

Motions for Hearing – Papers for the Court

Matters appearing in the Monday list are not ready for hearing unless the Court has been furnished with papers.
These hard copy papers are to be lodged by appointment in the List Room (not the Central Office) by 2 p.m. on
the Thursday preceding the Monday List where the application is to be opened. Papers should include a
paginated, bound and indexed booklet of motion papers clearly marked ‘Chancery Motions 1’ and be compliant
with all relevant Practice Directions.
An Dialann Dleathach – Cásanna An Lae Inniu Dé Luain 22ú Aibreán 2024
The Legal Diary – Today’s Cases Monday 22nd April 2024
The Court / List Room does not retain papers for matters adjourned in the List. Papers are returned to the
List Room for collection within a week, and not retained thereafter. It is for practitioners, and in particular the
moving party, to ensure that papers were lodged (or re-lodged) the week preceding any application to the Court.
(email listroomhighcourt@[Link] for appointments)

Adjournment Applications

All applications for adjournments (including adjournments on consent) must be made to the Judge.

Transfers to the List to Fix Dates

Where a motion is likely to exceed 15 minutes an application must be made to the Judge to transfer to a List to
Fix Dates (heard each Friday during term). When applying, practitioners should be able to advise the Court
whether the affidavits are closed and if the matter is ready for hearing and to give an estimate of how long it is
likely to take to hear. The Registrar can deal with consent applications.

Default of Pleading

Practitioners should note the changes to the Rules of the Superior Courts with regards to default of pleading
applications. Some consent orders are no longer permitted; e.g. extensions of time for delivery of Defence can
only be made for a stated reason and there is a requirement to file a Defence in the Central Office where an
extension is granted. Consent orders not compliant with the rules cannot be made. Applications for Unless
Orders, including consent applications, must be made to the Judge.

Matters listed for hearing will be heard physically unless otherwise directed by the Judge.

Where parties wish to have a matter for hearing heard remotely, they may apply to the Court when the matter is
set down for hearing.

Matters listed by the Court for hearing take priority over matters listed for mention.

Filing papers:

Motion Papers or Special Summons must be filed in the Central Office by appointment using the following link:
[Link]

The hearing day granted to Motions / Special Summons by the Central Office is subject to the number of priority
matters before the Court on any given hearing day.

Matters for Mention

Where a matter is listed FOR MENTION in the Chancery Special Summons List, it WILL NOT be necessary
to file papers with the List Room.

Matters for Hearing

Where a matter is listed FOR HEARING in the Chancery Special Summons List, it WILL be necessary to lodge
an indexed, paginated bound booklet of pleadings in advance. Such booklets must be lodged in the List Room
of the High Court on or before 1.00 pm on the Wednesday immediately preceding the Monday upon which the
matter is listed for hearing. No late filings or lodgements to the list Room can be accepted.

When a matter has been adjourned the papers must be collected from the List room, at the very latest, by
Wednesday noon of that week. An appointment to collect the papers may be made by emailing
listroomhighcourt@[Link]. If papers are not collected by that date, same will be disposed of securely. When a
matter has concluded the papers will be disposed of securely.

As of 6th of June 2022 only matters that are transferred to the Chancery Special Summons list from another court
listing that are FOR HEARING OR FOR MENTION must adhere to the above guidelines.

Matters that are coming before the Court the following Monday will be published in the Legal Diary each
Thursday and will be clearly marked as listed for mention or for hearing. Matters for mention will be listed to
commence at 2pm. Matters listed for hearing will commence shortly after the conclusion of the matters listed for
mention and, in any event, not before 2.30pm.

There will be a call-over of the matters listed for hearing at 2pm prior to the commencement of the List. This is
to facilitate the scheduling of hearings so attendance of the parties would be of assistance but is not compulsory.

Pursuant to S.I. No.418/2011 - Finance (Transfer of Departmental Administration and Ministerial Functions)
Order 2011 the Respondent in all Garda Compensation Special Summons is now the Minister for Public
Expenditure and
Reform. The effective date of this Order is 29th July 2011. References to the Minister for Finance shall from
the commencement date of this order be construed as references to the Minister for Public Expenditure and
Reform. New Summons issued in Garda proceedings should name the Minister for Public Expenditure and
Reform as the Respondent.

Garda Compensation Special Summons are made returnable to the Master's List for purely procedural reasons.
They are not called in the master's list and there is no need for practitioners to attend in respect of the listing.
The practice is that all such cases are automatically transferred to the Garda Compensation list.

The High Court Garda list deals only with applications under 1941 Act.
Once automatically transferred into the Garda Compensation list, the summons will sit in the list until such time

Non-Jury, Judicial Review and Asylum, Immigration and Citizenship List Notice- Lodgement of Papers
and Correspondence with Registrars
31st October 2023
Please take notice of the following directions regarding the lodgement of papers and correspondence with
registrars:
1. Non-Jury, Judicial Review and Asylum Hearings and Callover of Hearings
Papers for hearings in Non-Jury, Judicial Review and Asylum Lists must be lodged in the List Room no later
than the Tuesday of the week prior to the Hearing date. (Please note, this deadline does not apply to the
Monday Judicial Review ex parte list and the Monday Asylum and Immigration ex parte list- for information on

APPLICATIONS IN THE LIST

An Dialann Dleathach – Cásanna An Lae Inniu Dé Luain 22ú Aibreán 2024
The Legal Diary – Today’s Cases Monday 22nd April 2024
Parties and practitioners are referred to Practice Direction HC124 (effective 11 December 2023) and to guidance
notices issued by the Judge in Charge of the List, which are available from the List Registrar
(environment@[Link]). Where it is intended to make an application in the list either for ex parte leave, for
admission of a case to the list, or otherwise, parties are encouraged to make contact with the List Registrar in the
first instance as early as possible so that appropriate directions can be given.

SHAREFILE
As per High Court Practice Direction 124 to practitioners in the Planning and Environment List each case in this
list will be allocated a Sharefile for the uploading of soft copies of core documents, pleadings and exhibits related
to the proceedings. Solicitors and Counsel are advised to contact sadhbhmooney@[Link] to gain access
to the Sharefile folder for their case.
SEPTEMBER PILOT PROJECT
All cases listed for hearing in September 2024 will be listed for mention on 29 July 2024. All schedules of
directions must require the completion of all papers, submissions and the statement of case, uploading of
authorities and the full population and organisation of the ShareFile Folder, by the very latest deadline of 24 July
2024, with a strict requirement on all parties to contact the List Registrar to re-list the matter before then if there
is any slippage in compliance with any directions that is likely to affect compliance by that deadline. In view of
the longer than usual term for the List commencing in September, 2024, it is envisaged that writing weeks will
be synchronized for the week of Tuesday 29 October 2024, so that it is not anticipated that cases would be listed
for substantive hearing that week
