Policy. It is hereby declared to be the policy of the State to promote peace and order, ensure public safety, aimed towards the effective delivery of the basic services to the citizenry through the establishment of a highly efficient and competent police force that is national in scope and civilian in character. Towards this end, the State shall bolster a system of coordination and cooperation among the citizenry, local executives and the Jaw enforcement, The police force shall be organized, trained and equipped primarily for the performance of police functions. {ts national scope and civilian character shall always be paramount. Sec. 2. Composition of the Philippine National Police.- The Philippine National Police (PNP) is hereby established, initially consisting of the members of the police forces who were integrated into the Integrated National Police (INP) pursuant to Presidential Decree No. 765, and the officers and enlisted personnel of the Philippine Constabulary (PC). Officers and enlisted personnel of the PC shall include those assigned with the Narcotics Command (NARCOM), Criminal Investigation Service (CIS) together with its civilian operatives, and those of the technical services of the AFP assigned with the PC. Also included are the absorbed regular operatives of the abolished Inspection, Investigation and Intelligence Branch of the National Police Commission. Sec. 3. Organization of. The PNP shall be headed by a Chief, with the rank of Director General, who shall be assisted by two (2) Deputy Chiefs: one (1) for Administration, who is the second in command with the rank of Deputy Director General, and one (1) for Operations, who is third in command with the rank of Deputy Director General. The PNP Regional Offices corresponding to the 15 regions (Regions 1 to 12, NCR, CAR, ARMM), composed of the following: 1) The Office of the Regional Director 2) The Office of the Deputy Regional Director for Administration 3) The Office of the Deputy Regional Director for Operations 4) The Office of the Chief, Regional Directo- rial Staff with the staff divisions, as follows: a) Regional Personnel and Human Resource Development Division b) Regional Logistics and Research and Development Division ¢) Regional Comptrollership and Finance Division 4) Regional Intelligence Division 2) Regional Operations and Plans Division f) Regional Police-Conmunity Relations Division 9) Regional Investigation Division 5) The Regional Inspectorate Division under the Office of the Regional Director 6) The Regional Headquarters Support Group 7) The Regional Mobile Force 8) The Regional Administrative Support Units whose presence is necessary in the regional level which are limited only to the following: Medical & Dental Unit and « Communications Unit. 9) The Regional Operational Support Units whose presence is necessary in the regional level. i) iD kK) yD m) The five (5) District Offices of the National Capital Region (NCR), each headed by an NCR District Director and assisted by a Deputy District Director. The PNP Provincial Offices corresponding to all Provinces throughout the country, each headed by a Provincial Director and assisted by a Deputy Provincial Director. The PNP District Offices which are organized in large provinces with four (4) or more Congressional districts, in which case, a police district shall be organized for every two (2) or three (3) Congressional Districts. A PNP District office shall be headed by a District Director under the direct command and control of the Provincial Director. The City Police Stations of highly urbanized cities outside of NCR which shall be under the direct command and control of the PNP Regional Director and equivalent to a provincial office. A police station headed by a Chief of Police which is established in every component city and municipality, under the direct command and control of the Provincial Director or District Director, as the case maybe, classified as follow 1) Compo a) Type "A" for cities with population ranging from 100,000 and above; b) Type "B" for cities with population ranging from 75,000 to less than 100,005 c) Type "C" for cities with less than 75,000 population 2) Municipalities a) Type "A" for those with population ranging from 75,000 or mores b) Type "8" for those with population ranging from 30,000 to less than 75,000: c) Type "C" for those with population of Jess than 30,000. Sec. 4. Manning Levels - On the average nationwide, the manning levels of the PNP shall be approximately in accordance with a police-to-population ratio of one (1) policeman for every five hundred (500) persons. The actual strength by cities and municipalites shall depend on the state of peace and order, population density and actual demands of the service in the particular area. However, the minimum police-to-population ratio shal? not be less than one (1) policeman for every one thousand (1,000) persons. Urban areas shall have a higher minimum police-to-population ratio as maybe prescribed by regulations promulgated by the NAPOLCOM, Sec. 5. Rank Classification - For purposes of efficient administration, supervision and contrel, the rank classification of the members of the PNP shall be as follows: PNP Ranks AFP Ranks Director General General (Four-Star) Deputy Director General Lt. J: Officials - The head of the PNP with the rank Fe shall have the position title of Chief of the PNP. The second in command with the rank of Deputy Director General shall be the Deputy Chief for Administration. The third in command also with the rank of Deputy Director General shall be the Deputy Chief for Operations. The head of the Inspectorate Division with the rank of Chief Superintendent, snall assune the position title of Inspector General. At the Regional Offices - The heads of the Regional Offices with the rank of Chief Superintendent, shall assume the position title of Regional Director. At the National Capital Region (NCR) - The head of NCR with the rank of Director, shall assune the position title of NCR Director. To maintain peace and order and enforce the laws in their respective assigned jurisdictions; b. To prevent crimes and exercise the general Powers to make arrests, searches and seizures in accordance with law, and provide for the detention of such arrested persons; c. To investigate the commission of all crimes and offenses and bring the offenders to justices and d. To make all necessary steps to insure public safety and protection of lives and properties. The Chief of the PNP, the Regional Directors, the Director of the NCR and the Provincial Directors shall be deemed persons in authority; and all other officials and members of the Philippine National Police shall be agents of persons in authority. Sec. 2. Powers 0 4 f the PNP. - The Chief of the PNP as head of the Philippine National Police, shall have command, supervision and control of all elements thereof. He may issue from tine to time such detailed instructions regarding personnel, funds, records, property, correspondence, intelligence, operations, training and such other matters as may be necessary to effectively carry out the functions of the Philippine National Police. He shall Prescribe, subject to the approval of the NAPOLCOM, the table of the organization and equipment, functions, duties and powers of various staffs, Services, installations and other units of the Philippine National Police. The Chief of the PNP or the subordinate official he may authorize, shall have the power to issue subpoena and subpoena duces tecum in connection with the investigation of cases. 3. a. Powers of the Deputy Chief for Admi The Deputy Chief for Administration shall assist the Chief of the PNP in the exercise of responsibilities relative to PNP personnel, logistics, comptroller and plans activities. He shall likewise assist the Chief of the PNP in -.- directing, controlling and supervising the national administrative support units such as Crime Laboratory, Civil Security Unit, Logistics Support Command, Computer Center, Finance Center and Medical-Dental Center. As the second in command, he shall act for and in behalf of the Chief PNP in the latter's absence, incapacity or as directed. b. Powe, (sof the Deputy Chief for Ope The Deputy Chief for Operations shall assist the Chief of the PNP in the exercise of responsibilities relative to PNP operations, training, intelligence, community relations and investigation activities. He shall likewise assist the Chief of the PNP in directing, controlling and supervising the national operational support units such as Traffic Manage ment Command, Criminal Investigation Command, Narcotics Command, Special Action Command, Intelligence Command, Civil Security Command, Aviation Security Command, Naritime Command Security Command, and Police Community-Relations Command. As third in command, he shall exercise duties that may be delegated to him or as directed by the Chief of the PNP. Sec. 4. The Chief of the Directorial Steff, - The Chief of the Directorial Staff shall assist the Chief of the PNP in the general coordination and supervision of the various activities of the Directorial Staff. As the principal coordinating directorial staff of the Chief of the PNP, he coordinates, supervises and directs members of the Directorial Staff and Services Staff in the performance of their respective fugctions. He directs and issues detailed implementing policies and instruction regarding personnel, intelligence, operations, funds, logistics, police relations, plans, investigation and other matters as may be necessary to effectively carry out the powers, responsibilities, functions and duties of the Chief of the PNP. Sec. 5. The Pirectorial Staff - The: Directorial Staffs for Personnel and Records Management, Human Resource and Doctrine Development, Intelligence, Operations, Logistics, Plans, Police Relations, Comptrollership, Investigation, Research and Development shall perform the functions inherent to their respective offices and such other functions as competent authorities may assign. In addition, the Directorial Staffs shall have the following powers and duties: a. Study and analyze requirements of the police and develop plans for effective acquisition and distribution of such requirements or resources. to units and offices concerned. Formulate criteria for determining priorities for proposed projects, indicate the desired areas for development and devise ways and means to finance, implement and pursue such approved projects. Develop plans for the standardization — and measurement of police services, as well as plans for the improvement of administrative, managerial and operational activities. Set schedules and timetables for project execution. e. Evaluate basic policies and guidelines for the efficient performance of duty by their respective personnel. 1) Office of the Dire Records Hanagement (DPRH)- for Personnel and MISSION: To assist the Chief, Philippine National Police in the exercise of command pertaining to management of PNP uniformed and non-uniformed personnel as individuals; manpower Procurement and control; personnel records and reports; discipline, law and order; administration of prisoners of wars morale, personnel services and personnel procedures; and the internal organization of the headquarters and its administrative functionings and the miscellaneous functions assigned by the Chief, PNP, Deputy Chiefs, PNP or TCDS, PNP. FUNCTIONS/DUTIES: The 0 ector for Personnel, PNP assists the Chief, PNP byt 1, Studies and serves information pertaining to the personnel activities of the Command; 2, Furnishes estimate, advice and analysis to the Chief of Philippine National Police on personnel * matters; 3. Prepare personnel plans and projectionss 4. Translates decision into directive concerning personnel information and movement or deployment of elements of the Command; -13- 5. Recommends changes in plans, policies and orders’ to insure the efficient procurement and employment of the human resources of the Command. 2) of ice of the Directorate for Intelligence (o1)- MISSION: To assist the Chief, PNP in attaining intelligence objectives through staff direction, planning, coordination control and supervision of ‘all intelligence and counterintelligence activities of the PNP. FUNCTIONS: 1. Prepares intelligence plans, policies, and Programs of the PNP and to coordinate, control, direct and supervise the implementation of such Plans, policies and programs; 2. Evaluates “and integrates all intelligence projects of the PNP. 3. Provides intelligence for use of C, PNP and disseminate same to all PNP units and offices; 4, Determines PNP foreign intelligence objectives and to prepare and implement plans for the attainment of such objectives; 5. Directs and control the PNP foreign intelligence efforts through the effective management of the PNP attache systems, including the selection and Projection of PNP personnel for foreign intelligence assignments 6. Serves as the initial point of contact with foreigners having official dealings/transact ions with the PNP 7. Develops and maintains an integrated computerized intelligence system in support of PNP intelligence information requirements and-to provide electronic data processing services forthe PNP intelligence communitys 8. Represents the C,” PNP as directed on intelligence matters with government departments/agencies and with representatives of foreign governments: > 9. Waintains close supervisory direction, control and coordination of operational. activities of all Operating Units and Regional Offices of the PNP; 7. He is responsible for the planning, programming ang formulating of policies and procedures of the PNP logistics ‘organization .and Systems, materiel management, and overall logistics readiness of the PNP. FUNCTIONS: 1. Exercises supervision over the logistics related activites of the Regional offices and separate unitss Exercises control and supervision over the PNP Logistics service staff and functioanal supervision to operating unitss 3. Prepares broad logistics plans, programs, policies and procedures and guidelines relative to logistics activities of the PNP; Provides guidelines for the direction and control of the functions of supply, maintenance, facilities and installation, transporation, services and other logistics related activities in the PNP; Formulates broad policy guidance for the development of logistics concepts, doctrines, systems, organization and operations in order to develop PNP Wide logistics objectives: 6. Develops and coordinates the education and training program on logisticss 7, Prepares and supervises the preparation and execution of the PNP logistics activity program; + Manages foreign procurement program of the PNP; Evaluates/assesses the performance of the PNP logistics organization and takes remedial steps to improve/upgrade the PNP logistics system. 5) Office of the di ectorate for Plans (DPL) MISSION To assist and advise the Chief, PNP in the areas of plans and programs that are beyond the immediate operational and tactical ranges organizational and force development policies, doctrines and regulations; legislative, inter- agency and international affairs; arms and equipment research and development; and special studies, research projects and requirements that are needed for the effective and efficient aduinistration and operation of the PNP. Formulates Police-Community Relations programs, Plans and policies geared towards promoting community and citizen's participation in the maintenance of peace and order and public safety. Formulates Police-Community Relations implementing plans in support of PNP operational plans and prograns. 4, Undertakes activities that would bring about positive public perception towards the government in general and the Philippine National Police in particular. 5. Conducts studies and researches for the purpose of assisting national policy makers and legislators in developing national plans and programs and laws geared towards the promotion of community and citizen's participation in the maintenance of peace and order and public safety. 6. Conducts training activities to enhance the level of professionalism and efficiency of PNP personnel in the conduct of Police Relations. 7. Liaisons and assists other government agencies and non-government orgnizations in the conduct of religious, socio-economic, sports and cultural activities contributory to the maintenance of peace and order and public safety. 8. Performs such other tasks and functions as the Chief, Philippine National Police may direct. 8) _the Directorate for Investigation om) MISSION: To assist and advise the Chief, PNP in the direction, control, coordination and supervision of investigative activities especially the investigation of major crimes and sensationalized cases. Office of the ectorate for Research and Developme: To act as the principal service staff of the DPL pertaining to the conduct of Research and Development Activities of the PNP. Assists the Director for Plans in all of the activities related to research and developmeht, test and evaluation of items pertaining to mobility, weapons and chemical, communications and electronics and general materiel requirements of the PNP. Evaluates and recommends changes on new maintenance concept related to materiel development to insure its effectiveness and proper utilization. Reviews and comments on proposed modification of concerned items which needs improvement to insure their compatibility with the PNP requirements. Provides _technical/intelligence information on matters of acquisition of foreign items and other foreign/locally captured enemy material. Initiates and coordinates with the RDC, AFP and other appropriate government as well as private agencies on the participation of PNP in research and evelopment, test and evaluation of concerned items. Performs such other functions as the Director for Plans may direct. ~21- Sec. 6. Ihe Inspector General - The Inspector General shall, among others, conduct regular and - periodic inspection and audit of the different police districts stations, sub-stations and beats; posts and units of the PNP: collect, record, evaluate and analyze information and conduct investigations relative to police anomalies and irregularities. The Regional Director of the Philippine National Police shall have command, supervision and control of the PNP elements/Units in his area of operation which” shall include tactical and strategic movements, deployments, placements, and/or utilization of the entire police or any of its elements and components, equipment, facilities and other resources within his territorial jurisdiction, the training of the members thereof and such other powers that may be necessary to effectively accomplish the missions and functions of the police therein. The Deputy Regional Director for Operations, - The Deputy Regional Director for Operations shall have the following duties and responsibilities: 1. Assist the Regional Director in supervising, directing and coordinating the operations of the PNP at the regional level. 2. The Assistant Provincis Adwinistration/Metropolitan District tor far A = fration.- The Assistant Provincial Director for Administra- tion/Metropolitan District Director for Administration shall assist the Provincial Director in the exercise of command, specifically in supervising and coordinating the administrative and auxiliary services of the command in support of its missions and functions. As second in command at the provincial level, he shall act as Provincial Director in the absence or inability of the latter, He shall perform such other functions as may be entrusted to him by the Provincial Director or by higher authorities. Sec. 11. The Assistant Provincial. director for D Operations/Metropolitan District Director for dperat ion The Assistant Provincial Director for Operations/metropol itan District Director for Operations shall assist the Provincial Director in the exercise of command, supervision and contro? uf the police and as third in command at the provincial level, shall act as the Provincial Director in the absence and inability of the latter and of the Deputy Provincial Director for Administration. In addition, the Deputy Provincial Director for Operations shall directly supervise and coordinate the functions of the command pertaining to operations. He shall Perform such other functions as may be entrusted to him by the Provincial Director or by higher authorities. Sec. 12, The District Director/NCR Dist. Pirector.- The head of a police district shail be the District Director. He shall take charge of the performance of Specified PNP functions applicable to his area of responsibility, including supervision of PNP Support Units assigned thereat. Sec. 43. The City/Muni _Chief of Police. - A City/Municipal Police Stati aded by aC of Police with the rank of Chief Inspector. As Chief of Police, he shall be charged with the effective execution and accomplishment of the law enforc&ment and public safety missions and functions of the PNP in their respective operational area. The principal operating units of the stations shall be the Patrol Division/Section: for crime prevention, general preservation of peace and order, crime suppression and other public safety services; Investigation Division/Section: for Crime Investigations Vice Control Division/Section: for the - 25 - neutralization or suppression of vices, such as gambling, Prostitution and drug abuse; Juvenile Division/Section: for the control of juvenile delinquents and correction and abilitation of youth of fenders; Intelligence Division/Section: for the detection of syndicated crimes and subtle criminal activities, including subversion and threats to the security of the state; Traffic Division/Section: for the enforcement of traffic laws and regulations. Sec. 14. Duties of the Deputy Chief of Police .- In case of absence on ‘teave, sickness, or temporary incapacity of the Chief of Police, the Deputy Chief of Police shall_act in his place and perforn the duties and exercise the powers of the Chief of Police except the power of reorganization and designation or reassignment, and recommendation on appointments and promotions. He shail also perform such other duties as may be assigned to him by the Chief of Police or as may be prescribed by law, ordinance, or rules and regulations. Sec. 15. The J ipal Police Sub-Station. - the Municipal Police Sub-Station shall maintain peace, order and public safety within their respective jurisdiction. Tt shall Consist of two (2) principal sections with corresponding functions as follows: a. Patrol 1) Preservation of peace and order 2) Suppression of criminal activities 3) Crime prevention 4) Inspectional activities b. Inves gation Section 1) Crime investigation 2) Vice control 3) Control of juvenile delinquency 4) Intelligence Sec. 16. . dut Supervisor.- A PNP sup and responsibilities: He shall familiarize himself with all the Jaws, ordinances, police rules and regulations, as well as all the policies of the PNP, and shall strictly enforce and implement them accordingly. He shall perform supervisory duties which shall include planning, organizing and directing the activities of assigned personnel and the maintenance of harmonious relations with other divisions or units of the PNP. He shall be responsible for all matters related to the operation of all the units under his command and shall exercise authority commensurate with his responsibility and be accountable for its use. He shall supervise and control, subject to the orders of the commander, al] members assigned to his command and he shall be responsible for the efficiency and effectiveness of his men and his unit He shall maintain the desired standard of discipline and morale of all members of his unit. He shall take prompt and appropriate action of the discovery of any failure, error, violation, misconduct or neglect of duty by a subordinate. In case the dereliction is committed by a member of the force not within his command, he shall take immediate corrective and/or appropriate action as may be necessary and a report shall be forwarded to the Proper commanding officer, He shall take necessary steps to insure the proper care, economical use and serviceability of supplies and equipment issued to his command, He shall at irregular and unannounced times, visit all units under his command inspecting them for condition, efficiency or operation and initiating corrective action or disciplinary measures as may be necessary and proper. He shall promptly obey and transmit all lawful orders of his superiors, insuring uniform interpretation and full compliance. He shall see to it that duty hours are observed in accordance with the assignments published and needs of the department and the units under him. In case of special need or emergency, he shall be available for duty at all times. -27 - He shall make daily examination of assignment sheets, attendance, command records, and all miscellaneous reports to insure proper utilization and control. He shall submit to his ‘superior officer, in the prescribed forms, such reports as may be required to accurately reflect the problems, services and activities of the various units under him. He shall report immediately any emergency, serious crime, or unusual occurrence to his superior. He ‘shall respond personally to any emergency or occurrence of a serious or unusual nature which arises within his jurisdiction, unless his presence at his station cannot be dispensed with He shall strictly account for the condition of personnel assigned under him including their appearance and personal equipment. He shall give particular attention to the morale of his subordinates. He shall inspect or cause to be inspected all members under his command at the beginning of their respective tours of duty in addition to a general inspection which shall be conducted at least once a week. He shall at all times keep himself informed of the affairs of his unit and assure that the duties of his subordinates are properly discharged. He shall analyze crime incidence reports using facilities of the records division to determine trends as a basis for practical employment of resources and direction of operations. He shall examine reports for conformity with the procedure for complete investigation and reporting, returning improper or incomplete reports through proper channels, for correction and explanation of failure. He shall act promptly on all official notices, summons or subpoenas which may be sent to him by proper authority. He shall exercise authority with firmness, kindness and justice. - 28 - t. He shall perform such other duties as may be assioned to him by his superior officer or higher authority. Sec. 1 uti ssponsibilities of Policemen, A policeman in the PNP shall have the following duties and responsibilities: a. He shall be ready at all times to perform his duties and obey the lawful orders of his superior officers or higher authority. b. He shall be responsible for the efficient performance of his duties and adequate coverage of his beat or post. c. He shall cooperate and coordinate with other members of his relief, district or other division segments so that their teamwork may insure continuity Ff purpose and maximum achievement of the objectives of the department. d. He shall be available for duty at all times in case of special needs or emergencies. e. He shall respond readily and report punctvally to all assignments. f. He shall familiarize himself With all administrative and operational policies of the police station. 9. He shall execute the service program within his area of responsibility providing crime prevention, protection of life and property, apprehension and prosecution of offenders, preservation of peace and enforcement of regulatory measures. h. He shall be in the prescribed uniform and have the required equipment whenever he reports for duty. i, He shall be attentive to instructions and record information given during the briefing or roll call training and shall likewise record his activities during his tour of duty in the prescribed manner. He shall, unless otherwise ordered, report to his superior for inspection and instruction at the conclusion of his tour of duty. When on patrol, he shall be constantly alert, observing everything that takes place within his sight or hearing. He shall not hold conversations with anyone except in the discharge of his duty. At night time, he shall exercise close vigilance by watching and frequently examining and trying accessible doors or entrances and windows of commercial or, public buildings, including vacant or unoccupied houses on his beat. He shall promptly investigate all suspicious circumstances he may encounter. ‘In like manner, he shall check all uninhabited buildings or dwelling places in the day tine. As far as practicable, he shall exert efforts to know the identities and other circumstances of permanent residents of the area assigned to him and shall keep track of movements of the newcomers or strangers transferring to or merely loitering in the place. He shall report his findings without delay. a He shall take note of vehicles parked by day or staying overnight in the different streets of his beat, recording their plate numbers, and whenever possible, the owners thereof and/or drivers or operators. He shall undertake close surveillance over the movements of suspicious persons and vehicles and keep a record: of his observations for ready use when the need arises. He shall take note and report all known suspected Places of vice, such as gambling dens, houses of ill-repute, opium dives, hide-outs of persons of doubtful conduct and places frequented by vagrants. He shall keep himself informed of the places in ‘his area where violations are known or reputed to exist, and he shall plan and take necessary action, duly advising -his superior officer as to the steps being taken. He shall at all times, whenever in uniform, keep his official badge properly displayed and courteously give his name and badge number when duly requested to identify himself. He shall, in the event of any disturbance of the peace within his beat or in its immediate vicinity, Proceed to the particular spot and exert efforts to restore order. If a crime has been committed and the offender can be placed under custody, he shall take immediate steps to bring him to the police station. He shall endeavor to save life and protect or preserve the crime scene until the arrival of the investigator. He shall not leave his beat until properly relieved, except when required by the exigencies of the service and for unavoidable reasons. He shall keep record of the same in his memorandum book indicating the time he left his beat, the reason for leaving and the time he returned and resumed control of duty. He shall take care of lost children by taking them to the residence of their parents, if located within or near the vicinity of his beat and shall promptly notify his station of such action. If the residence is not known or at some distant location, he shall take such necessary action as may be required by the circumstances. He shall be observant of school children who are not in classes during the proper hours, and after making inquiries, as to the reasons therefor shall take appropriate action on any case of truancy which may come to his notice. He shall take note of all obstructions in the streets or sidewalks from which accidents may occur, removing them when practicable. He shall also take appropriate action on all nuisances and other matters affecting the safety and convenience of the public or the interest of the city/municipatity. He shall exercise vigilance in order to prevent fire or avoid waste of water; take note of ail garbage dead animals or other offensive matters thrown int the streets and shall take appropriate action thereon. He shall in order to summon aid, give three (3) blasts with the whistle and in extreme emergency, he may discharge his firearm in the air. He shall familiarize himself with the location of the street traffic signs and if he sees then misplaced or tampered with in any manner, he shall rectify the same. If such signs are missing from
