BeYouASU Constitution
2022-2023
PREAMBLE
We the members of BeYouASU, and subscribing to the regulations and policies of Arizona
State University, establish this Constitution to govern the matters within our organization.
Article I - Name and Purpose
Section 1 The name of this organization shall be: BeYouASU
Section 2 The purpose of BeYouASU at Arizona State University is to establish a supportive
environment for LGBTQIA students at ASU. This group seeks to foster an
academic friendly environment and also provide a sense of community and
support among its members. We also seek to advocate for the interests of
LGBTQIA students and the LGBTQIA community in general, from issues related
to mental health, academic issues, social issues, and political issues. LGBTQIA
students face unique challenges, and we seek to unite members of the LGBTQIA
community and their allies from across all of ASU’s campuses.
Article II – Non-Discrimination Statement
Section 1 Membership and all privileges, including voting and officer positions, must be
extended to all students without regard to age, ethnicity, gender, disability,
color, national origin, race, religion, sexual orientation, or veteran status. Title IX
of the Educational Amendments of 1972, Section 106.14, makes an exception
for social fraternities and sororities, in regard to gender, for membership criteria.
Religious student organizations will not be denied registration solely because
they limit membership or leadership positions to students who share the same
religious beliefs. These groups, however, may not discriminate in membership or
leadership on any other prohibited basis (i.e., age, ethnicity, gender, disability,
color, national origin, race, sexual orientation, or veteran status).
Article III - Membership
Section 1 Membership shall consist of Full Members and Associate Members. Membership
is open to all ASU students.
Section 2 Full Membership is defined as members who are current ASU students enrolled
in at least one credit hour. Full members may attend organization meetings and
participate in organizing meetings and events. Full members also have the ability
to: (1) run for office; (2) be appointed to officer positions by club leadership; or
(3) to vote in elections.
Associate Membership is defined as alumni, faculty, and other guest members.
Associate members may attend organization meetings and participate in
organization meetings and events but may not: (1) vote; (2) run for office; or (3)
be appointed to officer positions.
Section 3 Membership Removal: Members may be removed for the following reason(s):
(1) hate speech or bullying other members; (2) academic dishonesty; (3)
endangering, harassing or outing others; (4) intentionally misgendering or
refusing to use the preferred pronouns of another person; or (5) any violations of
the ASU Student Code of Conduct. Members may be removed by a majority (two
thirds) vote by the Executive Officers.
Other Sanctions: Members may be muted by any of the Executive Officers
without a vote, but the Executive Officer taking the action must inform the other
Executive Officers and provide evidence of the muted member(s)
transgression(s). An Executive Officer may move to vote to remove a member
who has been muted.
Article IV - Officers
Section 1 Elected Executive Officers of this organization shall consist of: President, Vice
President of Operations, and Vice President of Communications. Appointed
Officers of this organization shall consist of: Community Engagement
Officer(s), Logistics Officer(s), Marketing Officer(s) and Senior Student Advisor(s),
to be filled or altered as needed. The titles and addition or removal of Appointed
Officer positions is up to the discretion of a majority (two thirds) of the Executive
Officers.
Section 2 Executive Officers must have completed at least 12 credit hours at ASU prior to
election, whether as an undergraduate or graduate student. Executive Officers
must be enrolled in at least 3 credit hours at ASU and maintain a GPA of 2.0,
while fulfilling the requirements of full membership throughout their tenure.
Appointed Officers must have completed at least 6 credit hours at ASU prior to
appointment, whether as an undergraduate or graduate student. Appointed
Officers must be enrolled in at least 3 credit hours at ASU and maintain a GPA of
2.0, while fulfilling the requirements of full membership throughout their tenure.
Section 3 Club meetings: Executive officers are expected to be in attendance of all club
meetings to the best of their ability and must notify the President if they are
unable to attend for any reason, prior to the meeting.
Appointed officers are highly encouraged to attend all club meetings to the best
of their ability and must notify the Executive Officers if they are unable to attend
for any reason, prior to the meeting.
Section 4 Social Media: All Executive Officers and Appointed Officers are expected to
maintain activity within all club channels.
All Executive Officers will maintain full access to club social media channels and
be able to promote the club and club related concerns and activities through
those channels. Appointed Officers may have access to social media channels as
delegated by Executive Officers.
Section 5 Duties for Executive Officer positions: President: (1) oversee all club functions,
meetings, and events; (2) implement and enforce the constitution and policies of
the club; (3) perform all matters of diplomacy and alliances with other clubs and
organizations; (4) seek and employ faculty advisers; (5) oversee the duties of all
Executive Officers; (6) oversee and assign the duties of all Appointed Officers; (7)
uphold the integrity of the club’s values and mission statement as outlined in the
constitution; (8) serve as the point of contact for the faculty advisor or ASU
administration as it relates to all club activities; (9) setting the calendar for club
events and meetings; and (10) ensures all club activities adhere to ASU
guidelines and rules for student organizations.
Vice President of Operations: (1) second to the President, performs all of the
President’s duties in the absence, sickness, leave, or incapacitation of the President; (2)
oversee the duties of Appointed Officers or special events, meetings or other
special assignments as assigned by the President; (3) oversee and facilitate the
group roster and membership roles; (4) oversee and facilitate the election
process, including candidate eligibility, while ensuring the process is maintained
with integrity and adheres to the process as outlined in the constitution (5)
oversee the duties of the Vice President of Communications; (6) to remain up to
date on the current happenings within ASU as it relates to official policies,
procedures, and club functionality; and (7) field grievances and complaints as
given and escalate them to the President as necessary, serves as point of contact
for member concerns.
Vice President of Communications: (1) third to the President, oversee all social
media channels; (2) oversee and serve as the point of contact for Appointed
Officer duties as it relates to media and public image, digital or otherwise; (3)
keep track of and record meeting minutes and attendance; (4) record all official
meetings and upload them to the relevant social media channels; and (5)
promote community engagement and maintain an active and/or visible role
within the club.
Section 6 Duties for Appointed Officer positions: The duties and assignments of
Appointed Officers are defined and assigned by the President. The President
may delegate the decisions as it relates to duties and assignments to the Vice
President of Operations or Vice President of Communications.
Section 7 Term of office shall be: President: 1 full academic year, while maintaining
credit hour requirements throughout the academic year of their term.
Vice President of Operations: 1 full academic year, while maintaining credit hour
requirements throughout the academic year of their term.
Vice President of Communications: 1 full academic year, while maintaining
credit hour requirements throughout the academic year of their term.
Appointed Officers (all positions): 1 full academic year, while maintaining credit
hour requirements throughout the academic year of their term. While the
intended term of appointed officers is 1 full academic year, officers may be
recalled by executive leadership if they do not adequately meet their ascribed
duties or participate actively within the organization.
Section 8 Provisions for removal of an Executive Officer shall be: Any violations of
Article III, Section 3, or inactivity by an Executive Officer can result in a vote for
removal by Executive and Appointed Officers. This vote should be initiated by an
Executive Officer with the knowledge of the faculty adviser. A three fifths
majority vote by all officers currently filling a term of office must vote in the
affirmative for the removal of an Executive Officer to take effect.
Provisions for removal of an Appointed Officer shall be: Any violations of
Article III, Section 3, or inactivity or insufficient performance by an Appointed
Officer, can result in a vote for removal by a simple majority (two thirds) vote by
Executive Officers. Removal of an Appointed Officer does not require the
notification of the faculty adviser.
Section 9 Vacancy of an Office: In the event of an unfilled Executive Officer position, a
special election will be scheduled by incumbent Executive Officers with the
knowledge of the faculty adviser.
In the event of an unfilled Appointed Officer position, Executive Officers will
select a candidate and may formally or informally interview the candidate. This
candidate will become an Appointed Officer by a simple majority (two thirds)
vote by Executive Officers. Any personal relationship of any nature between an
Executive Officer and an Appointed Officer candidate should be disclosed prior
to a vote.
Article V - Elections
Section 1 Election of officers shall be held: The Summer session of the preceding
academic year, annually opening on the first Sunday in April and ending after
72 hours. The election for Executive Officers assuming positions for the 2022-
2023 school year will be held in the 2021-2022 academic calendar, on April
18, 2022. Voting will take place over the next 72 hours with polls closing on
April 20, 2022 at 11:59 PM AZ Time.
Section 2 Provisions for filling vacancies: Special elections will be held in the event of
an unfilled Executive Officer position. A special election is defined as an
election which takes place outside of the constituted election day (the first
Sunday in June and the next 72 hours).
Special elections will be called when: (1) there is a currently unfilled Executive
Officer position; and (2) with the knowledge of the faculty adviser.
Section 3 Term of office shall be one (1) academic year. There will be no restrictions
placed on the number of terms of office a member may hold. Incoming Executive
Officers will transition into leadership prior to the start of Fall Semester.
Section 4 Procedures for voting shall be: (1) An application will be made available to all
qualified members. No candidate can run for more than one Executive Officer
position; (2) Interested Full Members who meet the requirements will submit
completed applications to the Vice President of Operations who will check
eligibility of everyone who wants to run and upload the applicants into the Sun
Devil Sync Election; (3) Online voting through Sun Devil Sync will be open for
seventy-two (72) hours. In the case of a tie, a repeat election shall be held
between the tied candidates, and the winning candidate shall be the one
receiving a majority of the votes from Full Members. The results of the election
will be published on Sun Devils Sync and formally announced to the club by the
outgoing President.
Article VI - Meetings
Section 1 Regular meetings of this organization shall be held: Monthly, on a date and time
deemed suitable by the President. Meetings held more than on a monthly basis may also
be determined by the President for the needs of the organization. To encourage full
participation of members from all of ASU’s campuses, all meetings will be conducted
in an online format unless otherwise noted or designated at the discretion of the
President.
Section 2 Official meetings: Meetings deemed official club meetings must meet two
requirements: (1) the presence of at least one Executive Officer; and (2) all
official meetings must be sanctioned by the President. In the event that an
Executive Officer can’t be present at an in-person meeting, the President may
waive this first requirement.
Official meetings conducted over Zoom or in another virtual format will be recorded and
uploaded to YouTube for members who can’t attend. By joining an official and/or
formal meeting you understand and consent to being recorded.
Section 3 Executive meetings: An Executive Officer meeting will take place once a month.
At least two thirds (2/3) of the Executive Officers must be present. The purpose
of this meeting will be to determine the needs and direction of the organization,
as well as discuss opportunities and events for the club.
Section 4 In person meetings/events: Potential meetings and events in person which are
sanctioned as official by the President may include graduation ceremonies or
other on-
campus events deemed of interest to the organization and the President.
Article VII – Faculty Advisors
There shall be (1) or more faculty/staff advisors who shall be member(s) ex-

officio with no voting privileges.
Section 2 Method of selecting advisor: The advisor(s) is/are selected on a volunteer
basis by the acting or incumbent President.
Section 3 Duties or responsibilities of advisor shall be to provide guidance, input and support to
students and Executive Officers.
Article VIII - Amendments
Section 1 The constitution may be amended by a unanimous vote of Executive
Officers, effective immediately or as soon as is permitted in accordance
with the vote and discretion of the Executive Officers.
