COMPLAINT-AFFIDAVIT
(For Small Claims)

I, JAN MICHAEL DE JESUS MAGLINAO of legal age, Filipino, and a resident of


_______________________________, after having been sworn in accordance
with law, hereby deposes and state THAT:

1. I am the plaintiff in a complaint for small claims for collection of sum of


money amounting to SEVENTY FIVE THOUSAND FIVE HUNDRED THIRTY
EIGHT THOUSAND AND 73/100 (PHP75,538.73) against SPOUSES JEFFREY
AND CHARISMA CATAPANG who is a resident of B004 Rosario, Batangas
Namunga, herein referred to as Defendant;

2. That on March 21, 2021, the defendant obtained a loan from the plaintiff
amounting to One Hundred Eighty-Two Thousand One Hundred Sixty
Thousand and 42/100 Pesos (Php182,160.42), as evidence by a Promissory
Note and a copy of which is hereto attached as “Annex A”;

3. That based on the promissory note executed the amount of the loan was
payable as follows:

a. Sixty Thousand Nine Hundred Ninety-Six Thousand and 99/100 Pesos


(Php60,996) on or before May 2021;

b. Seven Thousand Two Hundred Seventy and 87/100 (Php7,270.87)


per month commencing on May 21, 2021 to February 15, 2022; and

c. Four Thousand Six Hundred Forty-Three and 80/100 (Php4,643.80)


per month commencing May 21, 2021 until April 21, 2022.

4. That the portion of the loan amounting to SEVENTY-FIVE THOUSAND FIVE


HUNDRED THIRTY-EIGHT THOUSAND AND 73/100 (PHP75,538.73) is now
long overdue due and demandable and despite of repeated demands of the
Plaintiff the Defendant refuse and fail to pay;

5. On July 13, 2021, a final demand letter to pay was sent by the Plaintiff for the
payment of the portion of the loan that was already due and demandable;
however, the same was ignored by the Defendant. A copy of the final
demand letter to pay is hereto attached as Annex “B”;

6. Notwithstanding the Plaintiff’s repeated demands, the Defendant failed and


refuses to heed to the former’s just and valid demands, leaving the Plaintiff
no other recourse but to litigate and file this action;

7. I am executing this affidavit to attest to the truth of the foregoing statements


and for whatever legal purpose it may serve.
