TO REMAND CASE TO LOWER COURT
COMES NOW, the plaintiff, through undersigned counsel and
before this Honorable Court, most respectfully states:

1. That the instant case was filed on July 23, 2021;

2. That on August 21, 2021, Republic Act No. 11576, entitled


an Act Further Expanding the Jurisdiction of the Metropolitan Trial
Courts, Municipal Trial Courts in Cities, Municipal Trial Courts, and
Municipal Circuit Trial Courts, Amending for the Purpose Batas
Pambansa Blg. 129, was enacted;

3. That in the said law, the jurisdictional amount of the Lower


Courts when it comes to civil cases involving real properties was
increased to P400,000, based on its Assessed Value;

4. That the total Assessed Value of the land subject matter of


this instant case is only P122,440 based on the Tax Declaration 1;

5. That the undersigned counsel is mindful of the docket of the


Honorable Court thus, there is a possibility of a longer litigation
should the plaintiff pursues the instant case with the original court;

6. That remanding the instant case to the lower court will also
help in decongesting the docket of the Honorable Court, THUS, this
motion;

WHEREFORE, in view of the foregoing, plaintiff prays that the
instant case be REMANDED to the Lower Court in accordance to
Republic Act No. 11576.

Such other reliefs, just and equitable under the premises are
likewise prayed for.
