MEMORANDUM OF DEPOSIT TITLE DEEDS
This Memorandum of Deposit of Title deeds executed on
this 05th day of October Two Thousand Twenty Three
(05.10.2023). For securing agricultural credit Purpose.
By Mrs. PERAMU, (AADHAR Number 4737 9082 9186 ) Wife
of Chellaiah residing at No: 5, Perumal Therku Madaveethi,
Palayamkottai, Palayamkottai Taluk, Tirunelveli District,
Tamilnadu State. (Hereinafter referred to as Borrower mean any or
each of the aforesaid individual and shall include his respective
heirs, legal representatives, executors, administrators and
permitted assigns).
IN FAVOUR OF ICICI BANK LIMITED a public company
incorporated under the Companies Act, 1956 and a Banking
Company with the meaning of the Banking Regulation Act, 1949,
having its Registered Office at ICICI Banks Towers, Bandra Kurla
Complex, Mumbai - 400 051 and having among others a branch
office at TIRUNELVELI JUNCTION herein after referred to as the
Bank. (Which expression shall whenever the context so requires or
admits mean and include it successors and assigns).
WHEREAS on the request of the Borrower the bank has
sanctioned to the Borrower the agriculture credit facilities of Kissan
Cash Credit and Agricultural term Loan up to limit of
Rs.16,00,000/- (Rupees Sixteen Thousand Only) on conditions
that repayment of the said sum shall be Secured inter-alia by way
of deposit of title deeds of immovable properties belonging to the
borrower.

NOW THESE PRESENTS WITNESS AS FOLLOWS:-
That in consideration of the sum of Rs.16,00,000/- (Rupees
Sixteen Thousand Only) together with interest and other monies
there on that may become due and payable, the borrower has
deposited on 05.10.2023 with the bank at Tirunelveli the title
deeds more fully described in Schedule A relating to Borrower’s
property more fully described in Schedule B hereunder with the
intent to create an Equitable Mortgage by deposit of title deeds of
the said property together with the all structures standing thereon
to secure the loan of Rs.16,00,000/- (Rupees Sixteen Thousand
Only) due and owing by the Borrower, including interest, penal
interest, commitment charges, cost, charges and other monies that
may become due payable from time to time by the Borrower to the
Bank.
The Borrower hereby covenant that the said property is not
subject to any mortgage, lien, charge or any other kind of
encumbrance whatsoever and the Borrower is an absolute owner of
the same and is well and truly seized of the property. The Borrower
further agrees to keep the bank indemnified against all claims and
demands whatsoever by any person lawfully or equitable claiming
under him or by any other person whatsoever.
Since this borrower is availing the Agricultural Loan, Stamp
duty is exempted Under GO MS.No 73 dated 22-07-2006, Issued by
Commercial Taxes and Registration department.
