MOST RESPECTFULLY SHOWETH:

1. That the present complaint has been filed in 2019 by the complainant
under section 138-142 of the Negotiable Instrument Act, 1881 against
the accused name therein and the same s pending adjudication before
this Hon’ble court and fixed for appearance of accused on
11.12.2023.

2. That the Hon’ble Court was please to take cognizance against the
accused vide its order dated 15-05-2019 and issue summon for
appearance against the accused for ________. The accused herein had
appeared on _______ before this Hon’ble Court when the Hon’ble
Court had issued the warrant of arrest against the accused but agan
failed to appear before the Hon’ble Court on subsequent dates of
hearing.

3. That on 16.03.2021. the accused appeared before this Hon’ble Court

sent to Mediation cell on same day and accused admitted his liability in
respect of cheque is question and gave statement in respect of
 amicable settlement between the parties and agreed to pay a sum of
Rs.____________(___________) as full and final settlement amount
and it was further recorded that the settle amount shall be paid in
before _______.

4. That it is not of place to mention herein that accused person was not
only default in making the payment but the at the same time also
misguided to the complainant company that he is making payment
towards the agreed and settled amount but on verification of same
only Rs 40,000/- paid to complainant against …………….it was revealed
that no amount is received from the accused till the date of filing of
present application.

5. That the present application is being made by the complainant

company before this Hon’ble court for recovery of admitted amount by
the accused in view of liberty given by the Hon’ble Court as the
accused made default in making the payment as per agreed schedule
before this Hon’ble Court.

6. That the complainant shall suffer irreparable loss if the Hon’ble Court
failed to incline the present application.
PRAYER
It is, therefore, in the above-mentioned facts and circumstances, most
respectfully prayed before this Hon’ble Court that this Hon’ble Court
may kindly be please to pass an order for recovery of amount as
admitted and settled by the accused before the Hon’ble Court vide its
order dated …….in favor of the complainant company in view of
statutory provision of the Code Criminal Procedure, 1973 in the interest

7. The provisions of Sections 357, 421, 431 of the Cr.P.C. which

enable the court to direct payments of monetary amounts and
enable recovery thereof, by the trial courts also may be extracted
and read as follows :

“357 . Order to pay compensation

(1) When a Court imposes a sentence of fine or a sentence

(including a sentence of death) of which fine forms
a part, the Court may, when passing judgment, order the whole or any
part of the fine recovered to be applied –

(a)in defraying the expenses properly incurred in the prosecution;

(b) in the payment to any person of compensation for any loss or injury
caused by the offence, when compensation is, in the opinion of the Court,
recoverable by such person in a Civil Court;

(c)when any person is convicted of any offence for having caused the
death of another person or of having abetted the commission of such an
offence, in paying compensation to the persons who are, under the Fatal
Accidents Act, 1855(13 of 1855 ), entitled to recover damages from the
person sentenced for the loss resulting to them from such death;

(d)when any person is convicted of any offence which includes theft,

criminal misappropriation, criminal breach of trust, or cheating, or of
having dishonestly received or retained, or of having voluntarily assisted
in disposing of, stolen property knowing or having reason to believe the
same to be stolen, in compensating any bona fide purchaser of such
property for the loss of the same if such property isrestored to the
possession of the person entitled thereto.

(2) If the fine is imposed in a case which is subject toappeal, no such

payment shall be made before the periodallowed for presenting the appeal
has elapsed, or, if an appeal be presented, before the decision of the
appeal.
(3)When a Court imposes a sentence, of which fine does not form a part
 , the Court may , when passing judgment, order the accused person to
pay , by way of compensation ,such amount as may be specified in the
order to the personwho has suffered any loss or injury by reason of the act
forwhich the accused person has been so sentenced.

(4) An order under this section may also be made by an Appellate

Court or by the High Court or Court of Session when exercising its
powers of revision

(5) At the time of awarding compensation in anysubsequent civil suit

relating to the same matter, the Courtshall take into account any sum paid
or recovered as compensation under this section.”

421. Warrant for levy of fine

(1) When an offender has been sentenced to pay a fine ,the Court passing
the sentence may take action for the recovery of the fine in either or both
of the following ways that is to say, it may-

(a) issue a warrant for the levy of the amount by attachment and sale of
any movable property belonging to the offender;

(b) issue a warrant to the Collector of the district,

authorising him to realise the amount as arrears of land revenue
from the movable or immovable property, or both, of the defaulter:
Provided that, if the sentence directsthat in default of payment of the fine,

the offender shall be

imprisoned,
and if such
offender has
undergone the

imprisonment
in default, no
Court shall

special
reasons to be
recorded
inwriting, it
considers it
necessary so
to do, or
unless it
