RESPONDENTS’ MOTION TO CONSOLIDATE CASES

RESPONDENTS’ MOTION TO CONSOLIDATE CASES

Respondents, APELLIDO, NOMBRE, and APELLIDO, NOMBRE, file the following

Motion to Consolidate Cases and in support thereof, Respondents allege as follows:

1. Respondents are all in removal proceedings. Respondent NOMBRE APELLIDO 1

is scheduled for a Hearing on FECHA DE AUDIENCIA 1 before this honorable

court. Respondent NOMBRE APELLIDO 2 is scheduled for a Hearing on FECHA

DE AUDIENCIA 2 before the Honorable NOMBRE DEL JUEZ DE

AUDIENCIA 2.

2. Respondent NOMBRE APELLIDO 1 is the RELACION of Respondent

NOMBRE APELLIDO 2, (Exhibit A – COMPROBANTE DE RELACION).

3. Respondent NOMBRE APELLIDO 1 has applied for TIPO DE REMEDIO

ANTE LA CORTE before this Honorable Court. (Exhibit B COPIA DE

REMEDIO ANTE LA CORTE).

4. Respondent NOMBRE APELLIDO 1 has included Respondents NOMBRE

APELLIDO 2 an as his derivative in his pending Form I-589 application.

5. The interests of procedural efficiency and the finality of proceedings will also be

better served if Respondents NOMBRE APELLIDO 1 and Respondent NOMBRE

APELLIDO 2 proceedings are consolidated and transferred to Your Honor’s

administrative control.

6. Any decision on the merits, of the three cases, will not lead to inconsistent results,

thus safeguarding procedural efficiency, given that the same Immigration Judge will

weigh evidence and decide on all cases. Likewise, the Court will avoid expending

resources, given that instead of having two Immigration Judges, along with their staff,
working on three separate cases, the consolidated cases can be administered and

decided by a single Immigration Judge.

7. The Department of Homeland Security will not suffer any inconvenience if the instant

motion is granted. In fact, the DHS will likely expend less resources in trying a single

consolidated case, in comparison to trying factually similar cases before two different

Immigration Judges.

8. Therefore, Respondents respectfully request that this Honorable Court grant the

instant motion.

WHEREFORE, Respondents request that their cases be consolidated under the case of

the Respondent NOMBRE APELLIDO 1.
