Motion for Reconsideration of Judgment

1) ABC filed a petition for reissuance of an owner's duplicate copy of an original land title with the regional trial court against the Register of Deeds. 2) The court denied the petition due to insufficient evidence as key exhibits submitted were photocopies instead of originals. 3) ABC's counsel is filing a motion for reconsideration to admit the original documents, which were inadvertently not presented earlier but are attached now. The counsel asserts this is made in good faith and not to delay proceedings.

MOTION FOR RECONSIDERATION

COMES NOW, the undersigned counsel, and unto this Honorable Court,
most respectfully states that:

1. The undersigned received a Notice of Judgment from the court dated

June 27, 2023 resolving the instant case;

2. The court denied the petition on the ground of insufficiency of

evidence, the same being premised on the nonadmission of Exhibits
“B” and “D”, the Affidavit of Self-Adjudication with Absolute Sale and
Release of Real Estate Mortgage, respectively, for being mere
photocopies;

3. Unfortunately, due to inadvertence and oversight, the undersigned

were unable to present the original and certified true copy of the
documentary evidence in question during the formal offer of exhibits
as these documents were in the possession of the Petitioner;

4. In view of the foregoing, the undersigned respectfully requests that

this Honorable Court reconsider its prior ruling and admit the original
and certified true copy of the documentary evidence (Exhibits “B” and
“D”) hereto attached.
5. This motion is made in good faith and is not intended to delay the
proceedings in the instant case.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed of this

Honorable Court to reconsider its Decision and to admit the attached
documentary evidence.

Respectfully submitted. ________________ at ___________________________
