REPLY-AFFIDAVIT

WE, FRANK DARWIN DEMILLO and LILIBETH CARCILLAR, Filipinos, of


legal ages, common-law spouses, and residents of Brgy. Zone 1, Sta. Fe,
Leyte, Philippines, after being sworn to in accordance with law, depose and
state:

1. That the Joint Counter Affidavit filed by respondents are mere


scraps of paper, being unsigned(hereto attached as Annex “A”);

2. That for the sake of argument, we refute the statements of


respondents in the said Joint Counter Affidavit;
3. That they alleged that they are not criminally liable since the
contract between them and the us is only a simple loan
guaranteed by a real mortgage, hence, they are only civilly liable;

4. That while it may be true that we entered a simple contract of


loan with them, we were deceived by them into entering such
contract;

5. That the purpose on why we lent them money is because of the


reason that Anna will use it in her wedding;

6. That Anna together with Emma and Eric Rosel deceived us


because the real purpose of the money was for the hospitalization
of Anna’s mother;

7. That we found out later on that it was Emma and Eric Rosel who
used the Php 100,000 which they appropriated for their personal
use without us knowing it(Copy of chat message of Anna Almadin
is hereto attached as Exhibit “A”);

8. That had we known that we were not told the truth about how
and who will use the money, we would not have entered into
such contract;
