Respectfully returned to MS. ANGELA RODRIGUEZ-PEÑA, Secretary to the Sanggunian,
Sangguniang Panlalawigan ng Palawan, the herein Ordinance entitled, “AN ORDINANCE
CREATING THE PEOPLE’S LAW ENFORCEMENT BOARD (PLEB) IN THE
MUNICIPALITY OF BROOKE’S POINT, PALAWAN LIKEWISE DESIGNATING ITS
OWN SECRETARIAT AND APPROPRIATING FUNDS THEREOF”, with the following
comments to wit:
The creation of the Board is warranted by Section 43 of Republic Act No. 6975, or the
"Department of the Interior and Local Government Act of 1990", which provides,
Section 43. People's Law Enforcement Board (PLEB). –
(a) Creation and Functions. – Within thirty (30) days from the issuance of
the implementing rules and regulations by the Commission, there shall be
created by the sangguniang panlungsod/bayan in every city and
municipality such number of People's Law Enforcement Boards
(PLEBs) as may be necessary: Provided, That there shall be at least one
(1) PLEB for every municipality and for each of the legislative districts
in a city. The PLEB shall have jurisdiction to hear and decide citizen's
complaints or cases filed before it against erring officers and members of
the PNP. There shall be at least one (1) PLEB for every five hundred
(500) city or municipal police personnel.
Under Nos. 3.4 and 3.5 of DILG Memorandum Circular No. 2017-154 dated November 16, 2017
provide for the policy guidelines on the implementation of the People’s Law Enforcement
Boards (PLEB) Program stating that,
3.4. PLEB SECRETARIAT
3.4.1. Designation of a PLEB Secretariat Head, who should at least be a
holder of a plantilla position and have completed a Bachelor’s Degree, to
be determined by the LGU concerned, is highly encouraged.
3.5. FUNDING FOR THE IMPLEMENTATION OF THE PLEB
PROGRAM. – Pursuant to Republic Act No. 10924 or the General
Appropriations Act of FY 2017:
3.5.1. The amount of One Hundred Million Pesos (P100, 000,000.00) shall
be used for the implementation and capavity enhancement of the People’s
Law Enforcement Board to ensure its functionality and effectiveness in
accordance to the provision of R.A. No. 6975 and R.A. No. 8551.
Hence, the subject ordinance, which served as a check and balance mechanism whereby an
ordinary citizen can have redress of his grievance against law enforcers who abuse their
authority, it appears to be valid and well within the power of Sangguniang Bayan of Brooke’s
Point to enact.
