The Petitioner, Mrs. J. Habiba Farheen, appeared before the Mental Health Review
Board along with her Sister J. Asma Afrin (Intellectually disabled sister) with necessary
documents for enquiry and for examination, held on 02.03.2023, at Mental Health Review
Board office, Vellore -01. Perused documents, examined patient and passed.

ORDER:
1. The Petitioner filed this petition to appoint her as a legal guardian for her intellectually
disabled sister, J. Asma Afrin and to direct the Indian Bank Manager to open the Joint
account of J. Asma Afrin along with the Petitioner to receive the government benefits.

2. The Petitioner and the disabled sister are daughters of Mr. Jalal and Mrs. Afrose Jahan.
J. Asma Afrin, 90% Intellectually disabled, for which she had received Government
benefits from 2006 through her father Jalal as natural guardian till his death
(21.10.2021). Because of her age and numerous illnesses, her mother, Mrs. Afrose
Jahan, is unable to take care for her disabled daughter. Therefore, her sister has filed
this petition for guardian.

3. Our Board examined the said J. Asma Afrin and perused the produced documents.
“The Department for the Rehabilitation of the disabled” certificate Dated: 31.01.2006,
reveals that J. Asma Afrin is permanent 90% disabled.
4. Upon observing the patient clinically, our Review Board Psychiatrist Dr.
[Link], and our board member have found J. Asma Afrin to be 90%
intellectually disabled and in need of representative for assistance and supervision
towards meeting her day to day needs and to achieve proper social and self-care skills
eventually.

5. MHRB has not conferred any power to pass order regarding bank transaction. The
Petitioner can seek the remedy before the appropriate forum.

6. The Mother of the disabled is old and sick and so she is unable to take care of the
patient. The petitioner being sister of the disabled and is also willing to take care of her
intellectually disabled sister, this Board appoints the petitioner Mrs. J. HABIBA
FARHEEN as Nominated Representative for the 90% intellectually disabled sister J.
Asma Afrin until she attains normal status in the society.

The petitioner, Mr. V.M. Venkatachalapathy , appeared before the Mental Health
Review Board along with his disabled sister Ms. M. Sumathi with necessary documents for
enquiry and for examination, held on 02.03.2023, at Mental Health Review Board office,
Vellore -01. Perused documents, examined patient and passed.

ORDER:
1. The Petitioner filed this petition to appoint her as a guardian for his
intellectually disabled sister Ms. M. Sumathi and pray for payment of family pension
of her late father Mr. V.S. Mani.

2. The Petitioner is the brother of the intellectually disabled. Their father Mr. V.S.
Mani died on 31.05.1994 and mother Mrs. M. Panchavarnam died on 30.10.2022.
After their mother’s death, the Petitioner has been taking care of his disabled sister.
His brother and sisters gave No Objection Certificate for taking care of their mentally
disabled sister by the Petitioner.
 3. The Board perused the documents, and clinically examined the disabled.

4. The Form VII Certificate of disability, dt 14.02.2023, Vellore District Medical

Board reveals that the said Ms. M. Sumathi is diagnosed as 60% intellectually
disabled (moderate). Upon observing clinically, our Review Board Psychiatrist, Dr.
M. Selvakumar and our Board Members have found Ms. M. Sumathi to be
intellectually disabled and in need of a guardian for assistance and supervision
towards meeting her day to day needs and to achieve proper social and self-care skills
eventually.

5. The Mental Health Review Board has not been conferred with any power to
pass order regarding family pension. The Petitioner can seek the remedy before the
appropriate forum.

6. The Intellectually disabled Ms. M. Sumathi is already under the care of the
Petitioner, and he is also willing to take care of her in the future. Hence the Board
appoints, Mr. V.M. Venkatachalapathy as Nominated Representative for Ms. M.
Sumathi, intellectually disabled until she attains normal status in the society.

The petitioner, Mrs. E. Krishna Kumari, appeared before the Mental Health Review
Board along with her Husband Mr. T. Ezhil Murugan with necessary documents for enquiry
and for examination, held on 02.03.2023, at MHRB office, Vellore -01. Perused documents,
examined patient and passed.

ORDER:
1. The Petitioner filed the petition to appoint her as a guardian for her intellectually
disabled husband Mr. T. Ezhilmurugan and pray for payment of family pension of his late
father Mr. [Link].

2. Mr. T. Ezhilmurugan intellectually disabled is the third son of the deceased Mr. R.
Thirunavukarasu who died on 05.09.2022. His father had worked in Tamil Nadu Electricity
Board and received pension after his retirement till his death. As a wife, the Petitioner pray
for family pension for her intellectually disabled husband from her deceased father-in-law.
But Mental Health Review Board has not conferred any power to pass order regarding family
pension. The petitioner can seek the remedy before the appropriate forum.

3. The Documents perused. Disability Certificate reveals that Mr. T. Ezhilmurugan is

permanent intellectually disabled (Moderate).
4. Upon observing clinically, our Review Board Psychiatrist Dr. M. Selvakumar and our
Board Members have found Mr. T. Ezhil Murugan to be intellectually disabled and in need
of a guardian for assistance and supervision towards meeting his day to day needs and to
achieve proper social and self-care skills eventually.

5. Hence the Board appoints, Mrs. E. Krishnakumari as Nominated Representative for

her husband Mr. T. Ezhil Murugan, intellectually disabled. Under section 14 of Mental
Health Care Act 2017.
