URGENT MOTION TO SET HEARING THROUGH VIDEOCONFERENCE

The above-named accused, represented by the undersigned, unto this Honorable Court, most
respectfully aver as follows:

1. On 29 May 2020, Chief Justice Diosdado M. Peralta issued Administrative Circular No. 41-2020 (Re:
Court Operations Beginning 1 June 2020) which states, among others, that the hearings of cases,
regardless of the stage of the trial, shall all be in-court, except in cases involving Persons Deprived of
Liberty (PDLs) who shall continue to appear remotely from the detention facility, and in cases with
extraordinary circumstances as may be determined by the justices and judges, which shall be heard
through videoconferencing.

2. Subsequently, On 01 December 2020, the Supreme Court issued Administrative Memorandum

(AM) No. 20-12-01 SC to establish the guidelines on the conduct of videoconferencing to address the
restricted movement and travel of court users during the pandemic. AM No. 20-12-01 SC took effect
on 16 January 2021 and it will remain effective even after the pandemic, unless revoked by the
Supreme Court;

3. The conduct of hearing through video conference is pragmatic as it will safeguard all the party and
their counsel as well as the judge and the court staff against the risk of possible COVID-19 infection.
Should the instant motion be granted the above-named accused and counsel may be invited to join
the videoconference through this email address: attycarlocaramto@[Link]
