The Terms SELLER and PURCHASER, unless repugnant to the context, shall mean and
include their respective heirs, executors, administrators, assigns and nominee.
WHEREAS the SELLER is the absolutely seized and possessed of or otherwise well and
sufficiently entitled to the property more particularly described in the schedule below which
property has been acquired by purchase vide Sale Deed Document has been registered in
the Office of Sr. Sub Registrar, _________________.
Now the SELLER is in need of funds to meet their family legal necessities, and better
investment, and hence have decided to dispose of the schedule property in sale for which
the PURCHASER has come forward to purchase, hence this SALE AGREEMENT has come
into force:-
NOW THIS DOCUMENT OF SALE WITHNESSETH
THAT the SELLER hereby agree to sell and get conveyed the schedule property in favour of
the PURCHASER, free of all claims, lien, charges, objections and encumbrances and the
PURCHASER hereby agrees to purchase the same for the sum of Rs. ____________/-
(Rupees _____________________), being the full sale value of the schedule property, as
offered by the SELLER and well accepted by the PURCHASER.
In pursuance thereof, the PURCHASER has paid a total sum of Rs. _________.00 (Rupees
______________________) as and towards advance sale consideration by way of cash
on _________________. in presence of the following witnesses and the same is hereby
acknowledged by the SELLER. The SELLER have agreed to receive the balance sale
consideration of Rs. _______________/- (Rupees ______________ Only) at the time of
executing Deed of Conveyance which shall be within a period of 03 months (i.e., on or
before _______________)
The SELLER shall obtain all the required documents from the concerned authorities
including Khatha Certificate etc., and get the schedule site conveyed within the said
stipulated time.
The sale will be completed by the SELLER by executing a Deed of Conveyance in favour of
the PURCHASER or his nominee against the PURCHASER or his nominee paying the said
purchase price, less the amount of advance money paid as aforesaid. The PURCHASER
shall have the right of legally proceeding against the SELLER in case of failure on the part
the SELLER in conveying the schedule property within the stipulated time at the costs and
consequences of the SELLER thereof, under Specific Contract Act.
On the other hand, when the SELLER is ready to get executed the Sale Deed in favour of
the PURCHASER and if the PURCHASER makes default in completing the sale, within the
stipulated period, the SELLER shall be entitled to make time essence of the contract and to
cancel this agreement thereafter by giving atleast fifteen days notice in writing to the
PURCHASER to that effect and the Sale Advance shall be refunded to the PURCHASER.

However, if the registration gets delayed due to Government policies, the SELLER shall not
insist for further advances and that both the SELLER and the PURCHASER shall wait for
registration till the registration gets resumed.
The SELLER shall hand over the possession of the schedule property to the PURCHASER
at the time of registration.
The SELLER this day handed over Xerox copies of Sale Deed and other related documents
pertaining the schedule site and shall hand over the original documents, including up to date
paid tax receipt, e-khata in the name of the SELLER, up to date encumbrance certificate
etc., pertaining to the schedule property, at the time of registration.
Also the SELLER hereby declare that SELLER has not entered into any transactions with
respect to the schedule property with any other person/s and agreement/s or commitment/s
entered into prior to this agreement, if any, such agreements / commitments shall stand
cancelled with respect to the schedule property. The SELLER also declares that the
schedule property was acquired by him with his own earnings and thus has the sole right to
convey the same on sale as per his will and wish and such conveyance shall not be objected
by any of his family members. However, in the event of any litigation, the SELLER shall be
solely responsible to settle such litigations at his own cost and consequences.

With full rights of absolute ownership, alienation, drainage, water ways and easementry
